A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY,
FLORIDA, CALLING FOR A REFERENDUM TO BE HELD IN CONJUNCTION
WITH THE GENERAL ELECTION OF NOVEMBER 3, 2009 ON THE
QUESTION OF WHETHER THE CITY OF SEBASTIAN MAY GRANT
ECONOMIC DEVELOPMENT AD VALOREM TAX EXEMPTIONS PURSUANT
TO THE STATE CONSTITUTION; AUTHORIZING THE CITY CLERK TO
INCLUDE THE QUESTION ON THE BALLOT; PROVIDING AN EFFECTIVE
DATE; PROVIDING FOR THE REPEAL OF RESOLUTIONS IN CONFLICT
HEREWITH; AND PROVIDING FOR ADOPTION.
WHEREAS, pursuant to s. 3, Art. VII of the State Constitution, the City of Sebastian is
authorized to call a referendum to determine whether the City Council may grant economic
development ad valorem tax exemptions; and
WHEREAS, at its July 29,2009 meeting, the Sebastian City Council unanimously voted to
place such a question on the November 3, 2009 ballot.
NOW THEREFORE, BE IT RESOLVED BY THE CITY OF SEBASTIAN, FLORIDA:
SECTION 1. That the following question shall be submitted to the electors of the City of
Sebastian at the general election to be held November 3, 2009:
ECONOMIC DEVELOPMENT AD VALOREM TAX EXEMPTION
Shall the City Council of the City of Sebastian be authorized to grant, pursuant to
s. 3, Art. VII of the State Constitution, property tax exemptions to new businesses
that create jobs and expansions of existing businesses that create new jobs?
Yes For authority to grant exemptions
No Against authority to grant exemptions
SECTION 2. That the City Clerk is authorized and directed to include this question on
the ballot at the general election to be conducted on November 3, 2009.
SECTION 3. That this resolution shall become in full force and effect in accordance with
the Charter of the City of Sebastian.
SECTION 4. That all resolutions or parts of resolutions in conflict herewith are hereby
repealed.
SECTION 5. This resolution shall take effect immediately upon its adoption.
The foregoing Resolution was moved for adoption by Coy The
motion was seconded by Hill and, upon being put to a vote, the vote
was as follows:
The Mayor thereupon declared this Resolution duly passed and adopted this 9th day of
Sept. 2009.
