Requested Action: Variance requested from Section 54 2 5.2.3(d)(5) to allow an existing residential structure to be 9 feet from the side property line and 24.3 feet from the front property line, whereas the code requires a 10 -foot side yard setback and a 25 -foot front yard setback. 3. Narrative of proposed action: Russell and Kimberly Salmon are requesting a variance to allow an existing residential structure to be 9 feet from the side property line and 24.3 feet from the front property line, whereas the code requires a 10 -foot side setback and a 25 -foot front setback. b. Staff Comments: The owners of the subject property have it under contract to sell. The title company handling the transaction discovered the encroachment and will not issue title insurance until the matter is resolved. Staff has reviewed the Building Department records to determine the history of the property. In 1974 a residence was constructed on Lot 2, south of the subject property. By some error, that residence was constructed encroaching onto Lot 3. At that time, Lots 2, 3 and 4 were under common ownership. To correct the encroachment, a portion of Lot 3 was combined with Lot 2. In 1978, a residence was constructed on Lot 3 (the subject property). Although the proposed plot plan (attached) indicated that the structure would meet the required setbacks, it did not, as shown on the 2009 survey (attached). The subject structure is now 31 years old. Removal of those portions of the structure which encroach into the required setbacks does not appear to be a practical solution. 9. Board Criteria for Determining Variances: See attached analysis. 2 Staff Recommendation: Staff recommends approval of the variance granting a reduction of the side setback to 9 feet and the front setback to 24.3 feet. Board Action: Hold quasi-judicial hearing to consider the request for each variance. ared by Jana Date Growth Manag ent Department 3 to z2,-c BOARD CRITERIA FOR DETERMINING VARIANCES Section 54 -1 -2.5 In order to authorize any variance from the terms of the land development regulations, the Board of Adjustment must use the following criteria for approving or denying a variance: a. Existence of special conditions or circumstances. That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures, or buildings in the same zoning district. Meets Standard Yes B' No The problem has existed since construction of the residence 31 years ago. The City has no record of any complaints from neighboring property owners, nor from any other governmental or utility agencies. b. Conditions not created by applicant. That the special conditions and circumstances do not result from the actions of the applicant. o Meets Standard Yes RV The current owners did not create the encroachment. c. Special privileges not conferred. That granting the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, buildings, or structures in the same zoning district. Meets Standard This is an older home. When an encroachment issue is discovered, it is handled on a case by case basis involving staff research of best available records. d. Hardship conditions exist. That literal interpretation of the provisions of the ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of the ordinance and would create unnecessary and undue hardship on the applicant. Only the minimum variance granted. That the variance granted is the minimum variance that will make possible the reasonable use of the land, building, or structure. That the granting of the variance will be in harmony with the general intent and purpose of the comprehensive plan and this code, and that such variance will not be injurious to the area involved or otherwise detrimental to the public welfare. In granting any variance, the board of adjustment may prescribe appropriate conditions and safeguards in conformity with chapter 163 F.S., the comprehensive plan, and any ordinance enacted under its authority. Violation of such conditions and safeguards, when made a part of the terms under which the variance is granted, shall be deemed a violation of the ordinance.
