Ginsburg City Manager, Al Minner City of Vero Beach Canvassing Board Members: City Clerk, Tammy Vock City Attorney, Charles Vitunac City Manager, Jim Gabbard Supervisor of Elections and Other Officials Present: Supervisor of Elections, Kay Clem Attorney Brian Connelly, representing the Supervisor of Elections Deputy Supervisor of Elections, Leslie Swan Absentee Coordinator, Marge Diehl IT Manager, Gary Gordon One Deputy Sheriff Call to Order The Canvassing Board Meeting convened in the Canvassing Room of the Supervisor of Elections Office and called their meeting to order at 5:00 p.m. Mr. Ginsburg witnessed the opening of the sealed transfer box (seal #10374) from the vault followed by removal of the provisional ballots and two uncounted ballots. The Supervisor of Elections explained that her staff found the two uncounted ballots from precincts and she recommended they be counted. It was noted the voters voted provisional ballots though an explanation could not be provided by the poll workers. MOTION by Mr. Ginsburg and SECOND by Ms. Maio to count the two ballots passed on a 3 -0 vote. There were also an additional 28 provisional ballots for consideration. MOTION by Mr. Ginsburg and SECOND by Ms. Maio to accept the 28 provisional ballots passed on a 3 -0 vote. Ms. Swan announced the Post Election Audit to be conducted on Tuesday, November 10, 2009 at 9 am, whereby an audit is conducted on ballots from one precinct randomly selected by the Board at the last meeting. The two additional uncounted ballots were opened and found to be good and were accepted. Sebastian Canvassing Board Meeting November 5, 2009 Page Two The Canvassing Board moved to the tabulation room to witness the count of the remaining ballots. One provisional was not counted because there were no votes marked at all. Seven ballots had not been counted by the machines because of write -ins, so the Board decided to count them on a 3 -0 vote. Mr. Gordon provided the Canvassing Board with the Final Official Cumulative Totals and the Board initialed it (see attached) and he provided a Statement of Vote by Precinct (see attached). The Canvassing Board signed three original Conduct of Election Report forms provided by the Supervisor of Elections (see one original attached). The Canvassing Board then signed four Certificate of Canvassing Board Official Returns forms and retained two copies (see copy attached). This certificate will be attached to a City Council resolution for acceptance by City Council at its Special Meeting on November 9, 2009. All remaining ballots and certifications were sealed in the transfer case with seal #0011706. After reviewing the results tape with the clerk all numbers were reconciled. Pct 105 Elks Lodge Assistant Clerk Mary Fox, 772 589 -1799 Operator Sheila Lemoi, 772 205 -5364 Lady inserted ballot and it kicked back as defective ballot. After an explanation was given to her about her choices (another ballot or over ride), she chose to have her ballot over ridden. Pct 106 North County Library Clerk Polly Coe, 772 571 -1621 Clerk states that a lady inserted the ballot into the Insight and the ballot kicked back as being defective. She declared that she had marked her ballot correctly and she showed the clerk on a sample ballot how she had connected the two parts of the arrow. They spoiled that ballot and offered her another. That second ballot kicked back also. Since the lady needed to get back to work, she chose the option to over ride her ballot. CERTIFICATE OF CANVASSING BOARD OFFICIAL RETURNS ANDREA B.
