Mayor Barnes called the Special Meeting to order at 6:00 p.m.

Public Forum on Capital Sanitation
A. Public Input
Kevin Paukner, complained about lack of pickups and late pickups for several
years.
Tut Connelly, Sebastian, said Capital had only missed him one time, and the only
problem he had was with the office.

Joan Giltinan, 461 Azine Terrace, Sebastian, said she had no problem with
Capital Sanitation.
Eugene Wolff, Wimbrow Drive, Sebastian, vehemently opposed any increase in
fee for trash pickup.
Julio Cares, Michael Street, Sebastian, said he had a can cover missing, and
noted oil in front of his house.
Mickey Groepler said she was in favor of retaining Capital Sanitation, noted
people put their trash out in front of other people's houses, expressed concern
for oil spills from the trucks, and said this is not the time to put people out of
work.
Mr. W. O'Donnell, cited the times that Capital would not pick up yard trash.
Carolyn Corum cited problems she had with Capital over the years, noted that
some people have problems and some never have any, discussed an oil leak
near her home, stated she believed their equipment was part of their problem,
discussed the back charge from Capital for the franchise fee which city staff
agreed Capital could not charge, and said she was willing to pay more money to
get good service.
B. City Council Dialog Relative to Capital Sanitation Service Provision
The City Manager said complaints provided previously were accumulated for
year 2001, stated since he had been on board his expectation has always been
to provide the best customer service possible and explanation for any deviation
in service.
Mr. Barczyk discussed the 70 complaints received by staff relative to Capital
Sanitation, which he stated, were minor in content and in proportion to the
number of customers. He further stated that personnel and equipment issues
might need some work.
Mr. Majcher said he had not seen problems in his neighborhood, but he did have
some concerns about the oil spills and EPA concerns; said it was not Council's
job to help any company, and that fire trucks had been called out because of the
oil spills.
The City Manager said staff had been cleaning up the spills and charging Capital
Sanitation.

Mr. Hill said anyone can ride around the streets and see the damage that has
been done to newly paved City streets. He said Council must make a decision
that will affect the public, that the amount of complaints received and lack of
customer service is unacceptable.
Mayor Barnes said a City franchises out to provide a service to avoid problems,
but the problems are being turned back to the City; stated it is not fair for staff to
be cleaning up after Capital; and said something needs to change here pretty
quick.
Mr. Bishop agreed with Mr. Hill, stated he had personal problems with Capital;
said there are a lot of people not happy with the company, that he was tired of
discussing the matter, and that it was time to look at alternatives.
The City Attorney said it was his understanding that this forum was to gauge
public sentiment, and Council could, if it wishes to conduct a public hearing on
whether or not to declare them in violation of their contract.
Mayor Barnes inquired whether Council could place an item on an agenda in
October.
C. Direction of City Council
It was the consensus of Council to set up an agenda item to discuss whether or
not Capital is formally in default of their contract by the end of October.
4. Being no further business Mayor Barnes adjourned the meeting at 6:50 p.m.
