The hearing was called to order at 2:01 p.m. by Special Magistrate David Hancock. 2. Present: Special Magistrate David Hancock, City Attorney Robert Ginsburg, Building Official Wayne Eseltine, Code Enforcement Officers Richard Iachini and Curtis Bloomfield, Code Enforcement Clerk Laura Parr. 3. Mr. Hancock swore in staff and respondents. 2. Initial Hearing of Code Violation: Case No. 10 -02534 Rita Curry 661 Sebastian Blvd. Sect. 54- 3-16.6(c) General Requirements. (c) Maintenance. All signs within the city limits including all supports, braces, guys and anchors shall be kept in good repair. The building official may order the removal of any sign that is not properly maintained. The expense of which will be the sole responsibility of the owner or lessee of said sign. Both Officer lachini and Respondents presented testimony concerning the signage violation at 661 Sebastian Blvd. Mr. Hancock found the Respondents in violation of the ordinance and ordered Respondent to 1) repair the existing pedestal sign by September 16, 2010, or 2) erect a monument sign within stated time period with all required permits, or 3) demolish the sign, obtaining all permits required by the Building Department, within 60 days. If the Respondent does not bring property in compliance within time period, a fine of $20 per day will be imposed for each day the property remains in non compliance with the order. Additionally, a fine of $64.85 for administrative costs was levied. 1 Case B10 -1001 (Building Dept.) Ernesto and Elena Davilla 1534 Haverford Lane Building Official Wayne Eseltine and the Davillas presented testimony concerning the lack of building permits for the bedroom and bathroom addition to 1534 Haverford Lane. Mr. Hancock found the Respondents in violation of the ordinance and ordered that they obtain the required permits and have all inspections approved by September 16, 2010. Failure to comply with the order will result in the imposition of a fine, beginning September 17, 2010, of $20 for each day the property remains in non compliance. Further, the Respondents were ordered to pay $252.36 in administrative costs to the Building Department. Case No. 09 -40554 (consent order) Clarence Barton 491 Kumquat Ave Section 54 -3 -14.7. Tree Removal, grubbing, and land clearing permits. (b) Tree removal and land clearing permit. All lands within the city are required to obtain a permit for protected tree removal, grubbing or land clearing. Respondent was not present but had signed a consent order. He did not contest the violation and complied with the requirements of the order. The Consent order signed by Mr. Barton was presented to and signed by Mr. Hancock. 4. The hearing was adjoumed at 3.45 pm. 2
