R -10 -42 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, VACATING A PORTION OF A CERTAIN EASEMENT ON LOT 6, BLOCK 257, SEBASTIAN HIGHLANDS UNIT 10; PROVIDING FOR CONFLICTS HEREWITH; PROVIDING FOR RECORDING; PROVIDING FOR EFFECTIVE DATE. WHEREAS, Michelle D. Napier and David P. Reisinger, owners of the land at 667 Benedictine Terrace, Sebastian, Florida, has filed a request for a partial abandonment of the public utility and drainage easement along the northwestern lot line of the site; and WHEREAS, the providers of telephone, electric, cable, water, and drainage utilities have all consented to abandonment thereof. NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SEBASTIAN, as follows: Section 1. VACATION OF EASEMENT. The City Council of the City of Sebastian does hereby vacate, abolish, abandon and discontinue all of that portion of land previously dedicated for a public utility and drainage easement described as follows: The southeastern ten (10) feet of the northwestern twenty (20) foot public utility and drainage easement located on Lot 6, Block 257, Sebastian Highlands Unit 10, less the northeastern and southwestern most six (6) feet thereof, as recorded in Plat Book 6, Page 37 of the Public Records of Indian River County, Florida. all located within the City of Sebastian, Indian River County, Florida. 2097291 THIS DOCUMENT HAS '3 =EN RECORDED IN THE Pl. 3_IC RE:;OFDS OF INDIAN RIVER COL INTY FL BK: 2452 PG:1449, Page of 2 10/11D/2010 at 02:36 PM, '!2 DC STAMPS D $0.70 JEFFREY K BARTON, CLERK _RK C)'= Ci. ;URT Section 2. CONFLICT. All resolutions or parts of resolutions in conflict herewith are hereby repealed. Section 3. RECORDING. This resolution shall be recorded in the public records of Indian River County, Florida. Section 4. EFFECTIVE DATE. This resolution shall take effect immediately upon its adoption.
