I budgeted for FY 2010 -2011 in accordance with your response. Please let me know what happened to make it go to $2 per registered voter which is what we paid in 2009 in the off year election. You have assured me in the past that even year elections will cost less because you are running an election. R -10-43 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, PERTAINING TO THE MUNICIPAL ELECTION; PROVIDING FOR CERTIFICATION OF RETURNS FOR THE NOVEMBER 2, 2010 GENERAL ELECTION; DIRECTING THE CLERK TO ENTER THE CERTIFICATION OF RETURNS OF THE ELECTION IN THE OFFICIAL MINUTES OF THE MEETING OF THE CITY COUNCIL; PROVIDING FOR REPEAL OF RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council, pursuant to Section 4.07 of the City Charter, adopted Resolution No. R -10 -19 on July 14, 2010, specifying the official polling places for the City of Sebastian for the November 2, 2010 general election, naming the offices to be filled; and authorizing the Supervisor of Elections to administer the election; and WHEREAS, the City Clerk of the City of Sebastian, pursuant to Section 100.021 of the Florida Statutes, published notice of the general election on July 23, 2010, and August 6, 2010 in the Vero Beach Press Journal, a newspaper of general circulation. Mr. Wolff nominated Mr. Gillmor. ix Vice -Mayor Wright thanked the other Members for the nomination; said he was optimistic for the next year; and it was important to continue working for the betterment of all the citizens. Mr. Gillmor thanked everyone that supported him; invited all citizens, even the ones that didn't vote for him, to call him; and said he would continue to work as hard as he has. The city council shall then declare the results of the election and enter them in the minutes of the special meeting. Any oath of office required to be administered to the newly elected council members shall be administered at such special city council meeting or at the next city council meeting where the newly elected council members are in attendance." The Indian River County Canvassing Board will provide a certified result of the election for the City of Sebastian following the Board's canvass on Friday, November 5th, which will be Exhibit "A" to Resolution No. R- 10 -43. Recommended Action: Move to adopt Resolution No. R- 10 -43, official receipt of the returns for the November 2, 2010 general election as certified by the Indian River County Canvassing Board. 1) Investiture of Newly Elected City Council Members and Seating at the Dais: In accordance with Section 2.04 (b) of the City Charter, (b) The term of each newly elected council member shall begin on the Monday following the election, at a special meeting of the city council to be held for the purpose of swearing in such newly elected officials. If a regular city council meeting is to be held the Monday following the election, the newly elected officials shall be sworn in at the conclusion of such regular meeting. Recommended Action: The City Clerk will call each newly elected official to the podium individually to be sworn in and then each will take his /her place at the dais after being sworn. 2) Election of Mayor Sec. 2.06. Mayor; vice mayor. (a) Mayor- Selection and term. [A]fter the seating of any newly elected council members at the special city council meeting held pursuant to Section 2.04, the new city council shall, as the first order of business, elect a mayor from among its members. The incumbent mayor or in his or her absence, the vice -mayor or in his or her absence, the senior member of city council, shall ask for nominations for mayor. After all nominations have been made, the nominations shall be closed. The city clerk shall then call the roll of the council members and each council member shall cast an affirmative vote for the council member of their choice. The council member that receives a majority vote shall be elected mayor. In the event no council member receives a majority of the votes cast on the first ballot, balloting with sequential roll calls shall continue until a council member receives a majority vote. Council members shall not nominate themselves. Only elected council members shall be eligible for the office of mayor. (1) If there is no mayor seated on the new or existing city council, a temporary city council chairperson may be elected from the incumbent members of the city council for the purpose of electing a mayor as set forth above. (2) In the event there is only one nomination and second for mayor, the nominee shall be seated as mayor. Recommended Action: Incumbent Mayor Gillmor will call for nominations for Mayor and once nominations for Mayor are closed, the City Clerk will call the roll and each Council member who shall state the name of their choice of the nominees. The first nominee that receives a majority of affirmative votes shall be elected Mayor. 3) Election of Vice Mayor In accordance with Section 2.06(c), (c) Vice mayor- Selection and term. Immediately subsequent to the selection of a mayor, the city council shall elect a vice -mayor from among its members. The term of the vice -mayor shall be for one year or until his or her successor is elected. The vice -mayor shall be elected using the same procedure as for the election of mayor. Recommended Action: The newly elected Mayor shall call for nominations for Vice Mayor, and once nominations for Vice Mayor are closed, the City Clerk will call the roll and each Council member shall state the name of their choice of the nominees. They become effective November 7th. Attached is the final text with changes annotated from the current rules, along with the forms that are incorporated by reference into the rule. The amendments to Rule 1 S- 2.0001 change its title and text to include requirements for candidate qualifying papers for all qualifying offices and incorporate the forms to be used for qualifying. On and after November 7 candidates must use the newly adopted qualifying documents when filing qualifying papers with the qualifying officer. The amendments to Rule 1S-2.045 modify the candidate petition form, DS -DE 104, and clarify the requirements to verify a candidate petition as being valid. ROBERTS Interim Secretary of State This letter responds to a request for an advisory opinion submitted by the Hillsborough Transit Authority's General Counsel on behalf of its Board of Directors. Because the Board has questions relating to the propriety of political activities it may take under Florida's Election Code, the Division of Elections has authority to issue you an opinion pursuant to section 106.23(2), Florida Statutes (2009). Your counsel states that the Hillsborough Transit Authority is a regional transportation authority and an independent special taxing district. Your counsel further states one of the Hillsborough Transit Authority's specific statutory duties and powers set forth in section 189.438(1), Florida Statutes (2009), as an independent special district, is that it may "take all steps reasonable, necessary, or advisable, to generate local support for the development of projects." However, he posits that section 106.113, Florida Statutes (2009), which became effective on July 1, 2009, seemingly contradicts that statutory authority. Section 106.113 provides: 106.113 Expenditures by local governments.- (1) As used in this section, the term: (a) "Local government" means: 1. A county, municipality, school district, or other political subdivision in this state; and 2. Any department, agency, board, bureau, district, commission, authority, or similar body of a county, municipality, school district, or other political subdivision of this state. R. A. This subsection does not apply to an electioneering communication from a local government or a person acting on behalf of a local government which is limited to factual information. (3) With the exception of the prohibitions specified in subsection (2), this section does not preclude an elected official of the local government from expressing an opinion on any issue at any time. Your counsel poses three questions regarding section 106.113, Florida Statutes (2009), as it relates to the activities of the Hillsborough Transit Authority. We address your counsel's questions in seriatim, but also call your attention to Division of Elections Opinion 10 -06 (June 14, 2010), which also interprets section 106.113, Florida Statutes (2009). First, do the provisions of section 106.113 as they relate to "electioneering constraints" (a term used by your counsel, which we interpret in the context of section 106.113 to mean "electioneering communications remain effective and if so, are they applicable to the Hillsborough Transit Authority despite the rulings in Broward Coalition of Condominiums The short answer is Florida electioneering communication laws have now changed to overcome the constitutional infirmities discussed in Broward Coalition. Because the current definition of "electioneering communication" now only applies to candidates and not issues, that portion of section 106.113 containing a prohibition on any activity that relates to an "electioneering communication concerning an issue, referendum, or amendment, including any state question, In Broward Coalition of Condominiums, et. al. v. Browning, et. al., 2009 WL 1457972, Case No. 4:08cv445- SPM/WCS (N.D. Fla. May 22, 2009), the court permanently enjoined the Secretary of State and the Florida Elections Commission, their officers, agents, servants, employees, and attorneys, along with persons in active concert or participation with them from enforcing Florida's electioneering communication laws. 2 Effective May 28, 2010, the definition of "electioneering communication" applies only to certain communications about candidates. The definition does not apply to communications about issues. Ch 2010 -167, 19, at 18, Laws of Fla. Furthermore, the communication is limited to those that are publicly distributed by a television station, radio station, cable television system, satellite system, newspaper, magazine, direct mail, or telephone that refers to or depicts a clearly identified candidate for office without expressly advocating the election of defeat of a candidate, but which is susceptible of no reasonable interpretation other than an appeal to vote for or against a specific candidate. The communication must be made within 30 days before a primary or special primary election or 60 days before any other election for the office sought by the candidate and be targeted to the relevant electorate in the geographic area the candidate would represent if elected. The restrictions on the ability of "local government" to expend public funds on political advertisements remain intact. Because section 106.113 was enacted later than section 189.438(1), Florida Statutes, it "may be viewed as the clearest and most recent expression of legislative will on the ability of "local government" to expend public funds on political advertisements. Applying applicable principles of statutory construction, to include construing the statutes together to give both meaning, the later expression merely imposes a limitation upon the powers and duties otherwise found in the enabling statute for independent special districts. Therefore, the Hillsborough Transit Authority is able to comply with the provisions of section 189.438, Florida Statutes (2009), and any other enabling legislation, but now must do so within the restrictions found in section 106.113, Florida Statutes (2009). However, when applying section 106.113, it must do so with an understanding that the portion of section 106.113 concerning an "electioneering communication concerning an issue, referendum, or amendment" is meaningless based upon the Legislature changing the definition of an "electioneering communication" in 2010. Second, does the definition of "local government" in section 106.113 apply to a state agency and an independent special district, such as the Hillsborough Transit Authority? The answer is that the definition of "local government" in section 106.113 applies to the Hillsborough Transit Authority. As a regional transportation authority, the Hillsborough Transit Authority is a "body politic" and a "special tax district." 163.566(1) and 163.570. Fla. Stat. (2009). Section 1.01(8), Florida Statutes (2009), defines both a "body politic" and "political subdivision" as including "counties, cities, towns, villages, special tax school districts, special road and bridge districts, bridge districts, and all other districts in this state." [Emphasis supplied.] Section 106.113(1)(a)1, Florida Statutes (2009), defines "local government" in relevant part as "[a] county, municipality, school district, or other political subdivision in this state." [Emphasis supplied.] Based upon the above definitions, the Hillsborough Transit Authority satisfies that portion of the section 106.113(1)(a)1 definition which includes "other political subdivision[s] in this state;" therefore, it is subject to the prohibitions found in section 106.113, Florida Statutes (2009). Third, can an independent special district, such as the Hillsborough Transit Authority, use public funds to educate the public about the importance, subject matter, and/or date of a scheduled referendum as long as they do not advocate a specific result? The definition of "political advertisement" requires a paid expression consisting of express advocacy, so providing factual information without expressing a position in support or opposition to the issue would not be a "political advertisement." Also, the current definition of "electioneering communication" does not include communications about an issue. Therefore, section 106.113, Florida Statutes (2009), would not be violated by expending public funds on communications consisting only of factual information. Section 106.113(2), Florida Statutes (2009), prohibits a "local government" from expending or authorizing the expenditure of public funds for a "political advertisement" or an "electioneering communication" that concerns an issue. Because the Legislature changed the definition of an "electioneering communication" in 2010 to include communications only about candidates, the use of "electioneering communication" in section 106.113 "concerning an issue, referendum, or amendment" is meaningless. The definition of "local government" for purposes of section 106.113 includes an independent special district such as a regional transportation authority created under chapter 163, Florida Statutes. However, section 106.113 does not prohibit a local government from expending or authorizing the expenditure of public funds for a communication that is limited solely to factual information. NEW LEGISLATION MEMORANDUM TO: All Indian River County Candidates FROM: Kay Clem RE: Absentee mailings, new disclaimers and laws, miscellaneous DATE: June 29, 2010 Congratulations on making it through the qualifying process. We are almost there just 60 days to go. We are busy proofing ballots and getting them ready to go to the printer. I have a few things I wanted to bring to your attention as we start into the final countdown. The Legislature has again made changes to the political disclaimers statute. There is a new shortened alternative disclaimer a candidate can use on political advertising. "Paid by (name of candidate) (party) for (office sought)." I believe they meant to eliminate the "approved by (candidate)" language from the disclaimer. However, while the language is left out of the first part of the statute for the new alternative disclaimer, the "approved by" language is still required in a subsequent part of the statute. I recommend using the old disclaimer until this is clarified by the Legislature, but the decision is yours to make. For a candidate paying for political advertising, you would use "Political Advertisement paid for and approved by (name of candidate), (party affiliation), for (office sought)." Note that a candidate's advertising is not permitted to abbreviate, Pd. Pol. Adv. Abbreviations can be used for any other political advertising but not that paid for by a candidate. I have included a copy of the new law, which has extensive new language regarding technology -based advertising disclaimers, such as what is required on the Internet and social websites. ABSENTEE (VOTE BY MAIL) BALLOT CHANGES Some of the biggest changes for our office which will affect you are the requirements of the federal MOVE Act which primarily governs military and overseas absentee voters. We will be establishing a free access system via our website. A voter will be able to look up his name and determine if we have received his absentee request and its status (where the request is in the process). It will show when and if we have received the request as well as when we mailed the ballot out to the voter. Military and overseas voters will have special procedures available to facilitate their ballots being received in time to be counted. However, all voters will be able to track their absentee requests. A couple of years ago the law was changed to require us to ask all absentee voters if they wanted to put their name on a list to send ballots for every election they were eligible for during the upcoming two general elections (4 years). That law has just been reduced to one year. However, when we mail out our initial absentee mailing this year (approximately July 14) with just over 11,000 requests on file now, do not be surprised if you have a large number returned as undeliverable. The addresses in some cases are two years old. Most of the addresses were added in the 2008 Presidential election. In August of 2009, in a special election, we had an overall turnout of precincts (Senate District 28) of 22 Election Day turnout was 7%. In just those few months, over one third of those absentee voters had moved and we received their ballots back as undeliverable. We scrub our list through the USPS National Change of Address program every 90 days to try to keep the lists as clean as possible but we have a very transient population in Florida. If you want to get mailings ready for absentee chasers then you need to get the list from our I.T. Manager, Gary Gordon at 226 -3438 or ggordon@voteindianriver.com. Again, we will mail the initial list on approximately July 14` You can be placed on our list to receive daily emails of the lists of voters who request absentees. The list that you receive before 4:00 PM everyday will be the absentees that will be mailed the following day at 10:00 AM. If we don't have any requests we will send an email by 4:00 PM letting you know. Our initial mailing will be sent by a vendor this year. The ballots will be folded additional times in order to reduce the size and cost of mailing the ballots and for the voter sending it back. Military/overseas mail ballots will go out the week before July 14 as required by law. We usually have 300/400 of those to mail. We have combined 54 precincts into 35 polling locations to save money. Many voters received letters /cards prior to the November '09 city elections and letters /cards are going out now to the remainder to notify them of the changes.
