City Hall is closed for a furlough day on Friday, October 21St, and during evenings, furloughs, weekends and holidays when City Hall is closed, all doors lock automatically and A/C systems shut down. As I stated in a letter to you dated September 13, 2011 and in subsequent emails, City Hall was to be closed on September 23, 2011 and if the report was to be walked-in, it must be in by September 22, 2011 or mailed in accordance with FS 106. Your report was received by US mail on Monday, September 26, 2011 with the envelope postmarked on September 22, 2011. In reviewing the report, it was noted that you had not signed the summary page in either the candidate or treasurer sections. You were notified by email that your report was unsigned and on Tuesday morning I contacted the City Attorney and the Florida Division of Elections to determine whether a report submitted by mail on time but lacking signatures was considered �led in a timely manner, merely incomplete and needing an amended page, or because it was incomplete due to lack of the signatures, was it subject to penalty for not being timely filed. Kristi Bronson, Bureau Chief, Florida Division of Elections responded that the Division of Elections, before they went to electronic fiting, which the City of Sebastian does not provide for, considered an unsigned report not timely filed, and therefore subject to penalty. In a later email she advised that Division of Elections Opinion 91-07 provides that the calculation of late days begins on the day after the due date, and includes weekends and holidays. In communicating this to the City Attorney he agreed that I had received the information that I needed to determine that a penalty would be warranted for the report not being timely filed. You visited my office on Tuesday September 27, .2011 and then submitted a new report to me this morning, September 28, 2011. In accordance with FS 106.07 (8) and DE opinion 91-07 in regard to calculation of penalties, this is notification that your report was considered four days late and the fine is $165.50 which is based on 25% of the greater amount reflected in your contributions for the period for which you were reporting, which was $662.03. FS 106.07 (8) requires that the fine must be paid from personal funds, not the campaign account, is due within twenty days of receipt of this notice, is payable to and will be deposited in the general funds of the City of Sebastian, unless you appeal the penalty to the Florida Elections Commission.
