Dear Ms. Murphy:
We are in receipt of your letter and Power of Attorney and our City Attorney has provided the
following information regarding the sale of the cemetery lot in question.
Since Mrs. Leddy has passed away, any Power of Attorney she had executed is no longer valid
under Florida law. The City will need certified documentation from the Probate Court that either
appoints an administrator of her estate (if the estate is still being processed), or bestows the
cemetery lot (either specifically or as part of the residual property of the estate) to a named
beneficiary. The City would then be authorized to repurchase the lot from that
administrator/beneficiary, or a person with their valid power of attorney.
We apologize if this seems unnecessarily convoluted, but once a person dies, the transfer of their
property is tightly regulated by law.
