After researching and receiving input from residents thru questionnaires and petitions, the Committee presented the idea to City Council and requested funding for the park during the budget process. Monies were granted and the City Manager was directed to begin development. The Committee then reviewed ten available city-owned properties for location of the park, examined aerials of each, performed on-site visits, and considered existing landscaping and environmental situations. They compiled a prioritized list of the properties indicating their choices in order, with the Schumann Drive location and a parcel on the east side of the St. John's Stormwater Park as their first two preferences. After consulting with the city engineer and environmental planner, and taking into consideration total funds available, the City Manager selected the Schumann Drive location. There were environmental concerns with the St. John's Stormwater Park location because of its proximity to scrub jay breeding areas. Attached is the proposed site plan for the Schumann Drive Dog Park for your review. The site is located on Lot 9 and a portion of Tract B, Block 406, near the intersection with US Highway #1, consisting of 21,199.44 SF or .48 acres. There is an existing lake (not included in the acreage), oak trees, and a landscape buffer to the north. The city will be providing perimeter fencing with gates, 6 grass parking spaces with wheel stops, a Schumann Drive Dog Park Page Two stabilized handicapped parking space, and landscape buffering around the parking area. The parking requirement for public parks is two spaces per acre. As required for public hearings,. a legal ad was published in the Press Journal, and notices were mailed to surrounding property owners. RECOMMENDED ACTION: Conduct Quasi-Judicial Public Hearing and make a motion to approve the site plan for the Schumann Drive Dog Park 7 M M M M M M M M 1225 MAIN STREET ^ SEBASTIAN, FLORIDA 32958 TELEPHONE (772) 589-5518 ^ FAX (772) 388-8248 DATE: December 21, 2007 TO: Planning and Zoning Commission FROM: ~~" Jan King RE: Request for Site Plan Extension Bristol Lakes Townhouses On October 5, 2006, the Planning and Zoning Commission approved a site plan for Bristol Lakes Townhouses, an 84-unit townhouse development located northwest of Barber Street and Park Place Mobile Home Park, east of Bristol Street and south of Palm Lake Club Mobile Home Park. The project consists of 15 residential buildings and a swimming pool facility, together with associated parking, water and sewer service; drainage, and landscaping. Access to each unit will be accomplished via an internal road network with the primary access on Barber Street and a secondary emergency and utility access further east on Barber Street. Proposed water service will be accomplished via connection to an Indian River County Utilities water main, and wastewater service will be provided by connection to the Indian River County Utilities sewer system. Stormwater runoff for the proposed development will be routed to multiple on-site retention areas. The site consists of 10.9 acres, of which, 4.78 acres will be impervious (43.8%) and 6.12 acres will be open space (56.2%). A swimming pool with restroom facility will also be provided. The approval included 8 conditions noted on the original staff report, as well as 2 conditions added by the Planning and Zoning which are listed below: 1. When palm trees are used as canopy trees, they shall be clustered at the ratio of 3 palms to equal one canopy tree. 2. Trees shall have an overall height of 12 feet, with a 21/2" DBH at planting. 3. At least 50% of trees shall be draught tolerant. 4. Tree requirement along north property line is 1 tree/25 LF. Correct tree count to 39 trees. 5. Site provides 183 parking spaces. Correct off-street parking calculation to 183 parking spaces x 1 tree/5 spaces = 37 trees. 6. Total tree requirement to be corrected to 210 trees. 7. Growth Management Director must approval final selection of specific trees and shrubs to be utilized. 8. Additional landscaping to be required at the rear of the pool area to provide better separation between this recreational facility and the private residence. 9. Lights in parking areas to be shielded to minimize light overflow. 10. Establish line-of--sight easement on property near Barber & Bristol street intersection. The original site plan was approved for aone-year period to expire on October 5, 2007. The engineer of record, Joseph Schulke, submitted an application for an extension of the site plan on September 28, 2007, and paid the requisite fees (half of the original fees). Pursuant to the Land Development Code Section 54-4-18.7, the Growth Management Director may extend a site plan approval for 12 months upon finding that the applicant has demonstrated "reasonable cause" for the extension. However, since this request is for an 18-month period to run concurrently with the preliminary plat, staff has placed this on the agenda for Planning and Zoning approval. For your review, staff has provided a copy of the letter of request from Joseph Schulke dated September 26, 2007, a copy of the approved site plan and the original staff report. The site plan reflects compliance with current RM-8 zoning townhouse requirements, including minimum lot size, setback standards, open space requirements, parking, water and sewer service, drainage, and landscaping. On January 10, 2007, City Council adopted Resolution R-06-24 approving the preliminary plat for Bristol Lakes Townhouses, which will expire on January 10, 2008. Application has also been made (and requisite fees paid) for an 18-month extension to the preliminary plat, which has been scheduled for consideration by the City Council on January 9, 2008. Staff recommends approval of the request for an 18-month extension to the site plan, to run concurrently with the extension to the preliminary plat, conditional upon the following: 1. Reinstall or remove the existing silt -fence along the property boundaries. This fence. was intended to stop the migration of gopher tortoises onto the property, but is in disrepair. 2. Update the environmental study prior to any onsite construction. 3. Convert gopher tortoise "take" permit into a "relocation" permit through Fish and Wildlife. 4. We respectfully request extension for both the Preliminary Plat and Site Plan Approval for 18 months. We understand the site plan was approved on October 5, 2006 and the preliminary plat on Januazy 10, 2007. As you know, the site plan and permits were issued and clearing was going to commence last spring. However, a scrub jay pair nested on the site in the spring which put a halt to construction. The developer has since been working with Trish Adams / USFW to resolve the issue and is in the process of preparing an H.C.P. plan. Unfortunately, these plan revisions take time for review and approval. I recently spoke with Trish Adams, and she indicated that H.C.P. processing is now moving quicker from what was 2 yeazs, to a little over a year. With this in mind we would like an extension for 18 months for both approvals and would prefer that the new expiration date be the same for both, that is, 18 months from January 10, 2008 which would be July 10, 2010. Exit from these spaces will direct the vehicles westbound to an alley between Complete Electric and 512 Plaza (645 Sebastian Blvd.) which connects to CR 512, or further west to S. Wimbrow Drive. The intent of the alleyway, which runs for most of the length of the 512 commercial corridor behind the buildings is for delivery trucks, trash pick-up, and usually only one or two rear employee parking 7 spaces. Because of the convenient access and exit from the rear of this site, staff feels the amount of rear parking will not create any hazards or nuisances for the site or adjacent residences. However, the exit alley to CR 512 has numerous potholes and a deteriorating apron on Sebastian Blvd which staff has requested the developer to repair as an off-site improvement in consideration of the increased usage of this alleywa~r.
