APPROVAL OF MINUTES: Regular Meetings of 3/06/08
MOTION by Dodd/Buchanan to approve the minutes of 3/06/08. A voice vote was taken
and all were in favor. Motion passed unanimously.

QUASI-JUDICIAL PUBLIC HEARING -SITE PLAN ~ CONDITIONAL USE PERMIT -
GOOD YEAR TIRE CENTER - 6,864 SF RETAIL ~ VEHICULAR SERVICE BUILDING
- 9260 SEBASTIAN BOULEVARD, SEBASTIAN CROSSINGS COMMERCIAL
SUBDIVISION -THE SHERON GROUP, INC. - CG ZONING DISTRICT
Mr. Cardinale opened the hearing and asked for any ex parte communications;
there were none. He then swore in anyone wishing to speak. Mr. Mark Wallace
of Acme Architects, 3575 Linden Lane, Miami, Florida, presented the application.
He introduced the developer, Scott Sheron, also Robert Leon and Aaron Bowles
of MBV Engineering. Based on staffs' recommendation for approval, he offered
to answer questions from the board.
After the exact location had been established, Ms. Bosworth reviewed the staff
reports for the conditional use and the site plan. There will be no outside storage
or display of tires. They are providing 30 parking spaces, three over the
requirement. A truck loading/unloading area has been provided in the southwest
corner. The building colors will compliment the colors of the Auto Zone, which
was previously approved. The county required traffic impact studies for both the
Advance Auto Zone and Good Year Tire Centers, even with the current CR 512

improvements underway. TIA's for both sites were submitted, and the county has
approved those traffic impact reports. There is also the required ten-foot
landscape perimeter, with the east perimeter being shared with Advance Auto,
previously approved by the Commission. Staff recommends approval of the
conditional use permit and the site plan.
Ms. Bosworth and Ms. Grohall answered questions about recycling water, waste
oil handling, and plant species for ground cover and screening.
No one in public attendance spoke in favor or opposition of the site plan.
MOTION by Simmons/Dodd to approve the conditional use permit for Good Year Tire
Center located at 9260 Sebastian Boulevard.

for the Good Year Tire Center.

Mr. Simmons asked about the new site plan on U.S. 1, location of the recently
constructed Indian River National Bank and Sebastian Medical Suites, north of Walmart,
particularly the safety of the access drive in regards with its location in the middle of the
turn lane for Walmart.. Ms. Grohall said we have very little control over that as it is an
FDOT decision. Commissioners discussed their concerns, especially the fact that these
driveways are just to the north of the worse intersection in the city. They believed that it
is a major traffic problem with a strong potential of numerous and severe accidents.
DIRECTOR MATTERS:
Ms. Grohall mentioned that there will be a meeting on April 17~' and expect to have both
meetings in May.

SUBJECT: Proposed 2,000 SF Accessory Structure
St. Sebastian Catholic Church Site Modification
St. Sebastian Catholic Church has applied for a site modification to construct a 2,000 SF storage
building/garage on their property. Within the past year, two administratively reviewed site plan
modifications were approved by staff for an addition to the rectory, and a foyer and storage
addition to the church's community building. Staff requested an up-dated site plan be submitted
with this application.
SITE PLAN INFORMATION:
The proposed location of the storage building is to the west of the rectory, east of the 134th Street
rear entrance. The structure meets all Public Service zoning district requirements, including "No
building or structure in PS district shall be located closer than 30 feet to a residential district."
(Note: the original church site plan was built when the property was zoned Commercial General,
and as such, some of the original buildings are grandfathered in with regards to meeting the 30
foot setback requirement.)
Ten grassed parking spaces in the area of the storage building are being eliminated, and the
dumpster pad and enclosure are being relocated. In 2000, parking requirements for churches
were changed from 1 parking space for every 3 seats to 1 parking space for every 4 seats.
Current parking required for St. Sebastian is 280 spaces. Parking being provided, including the
elimination of the 10 spaces, is 384 spaces, with future overflow parking to be available to the
south when the Sebastian Medical Suites site plan is completed. The new dumpster enclosure
must match the finish material and color of either the new storage building or rectory.
The proposed storage building meets all Riverfront Performance Overlay District requirements
including roof pitch and materials. Colors were not provided as of yet, and will need to be
approved by the Growth Management Director before the building is painted.
Also, a copy of the SJRWMD permit for the new construction is required, or verification that the
recent additions and storage building are exempt or covered on the existing permit. The IRC
Fire Department requires fire hydrants be installed within 500 ft. of the most remote portion of
any new buildings.
ADDITIONAL CONSIDERATIONS:
The Riverfront Overlay District requires foundation plantings for the main building on a site, and
Section 54-2-7.5 requires one shrub for every three lineal feet for accessory structures over 750
SF to 1,000 SF. It will be the Commission's discretion to require foundation landscaping for the
storage building as a condition of approval.
The up-dated site plan also revealed that two 12' X 32' existing sheds, in the proposed location of
the storage building, were improperly relocated, unknowingly into the adjacent Short Street
ROW to the north. A representative for the church informed staff that after the new storage
building is completed, and the existing sheds emptied, the church would most likely eliminate
and/or re-sell the two off-site sheds. If the church decides to keep the sheds, relocation is
absolutely required, with the Building Department requesting new permits be applied for. In
case of this scenario, staff requested that the new location of the sheds be shown on this site plan.
The off-site, illegal sheds must be addressed within 30 days of final inspection of the new
storage building.
RECOMMENDATION:
Staff recommends approval of the site plan modification with the following conditions:
1. New dumpster enclosure must match the finish materials and color of either the new
storage building or rectory
2. Paint colors for the new storage building must be approved by the Growth
Management Director
3. Copy of SJRWMD permit or exemption verification
4. Receipt of IRC Fire Department site plan approval letter
5. Removal or relocation of the two off-site sheds within 30 days of the final inspection
of the new storage building
6. Foundation landscaping??
