A voice vote was taken and all were in favor. Motion passed unanimously. OLD BUSINESS: NONE NEW BUSINESS: QUASI-JUDICIAL PUBLIC HEARING -SITE PLAN MODIFICATION - ST. SEBASTIAN CATHOLIC CHURCH - 2,000 SF STORAGE BUILDING - 13075 US HIGHWAY #1 - PS ZONING DISTRICT Chmn. Paul opened the hearing and asked for any ex parte communications. He mentioned that the engineer, Todd Howder, is his neighbor. There were no other comments. He then swore in anyone wishing to speak. Mr. Todd Howder with MVB Engineering, Vero Beach reviewed the plans -for the board. He added that the application is only for the maintenance building. This building will house lawn and yard equipment. Ms. Bosworth reviewed the staff report. She explained that since this storage building would have to go before the commission they felt an updated site plan for the whole facility would be in order. Setbacks, removal of 10 parking spaces, and two off-site sheds were discussed. Staff recommends approval of the site plan with the conditions listed in the staff report. The commission discussed the building color, landscaping, parking and dumpster screening. PLANNING AND ZONING COMMISSION MINUTES OF REGULAR MEETING OF APRIL 17, 2008 Adrienne Dissis, 7775 134th Street, asked for clarification of the location of the garage, and concerns about parking overflow into her front yard during holiday church services. Ms. Bosworth said there is a parking agreement in discussion between the church and the new medical facility and the bank to the south. Mr. Howder said he would work with Ms. Dissis on her concerns as the church definitely wants to be a good neighbor. Ms. Dissis approached with another question regarding the sheds to be moved and landscaping. Mr. Pat Gilligan with Trendsetters Construction, who is the contractor for the project, stated that he believed the church was going to get rid of the off-site sheds. MOTION by Dodd/Buchanan to approve the site plan with the six conditions noted in the staff report and modified as follows; (1) instead of saying "either" state "the color of the new storage building"; (5) state removal of the sheds and not relocation from the condition; (6) we would ask for foundation landscaping. ROLL CALL: Mr. Blais yes Mr. Paul yes Mr. Simmons -yes Mr. Cardinale yes Mr. Dodd yes Mr. Buchanan yes The vote was 6-0. Motion passed unanimously. MEMBERS MATTERS: Mr. Dodd said he would not be able to attend the May 1St meeting. DIRECTOR MATTERS: Ms. Grohall said she is following up with the MPO on some of the questions from the previous meeting about vehicular safety on U.S. 1 in front of the new Indian River National (RBC) Bank. CHAIRMAN MATTERS: Mr. Paul asked for an update on the Firehouse Garage issue. Ms. Grohall reviewed the details of a January meeting but to date has not seen any compliance with what was agreed upon. He asked the status of the CR512 car wash and Ms. Grohall said they have not contacted her. Mr. Paul asked Mr. Stringer if he knew why the speed limit on Barber Street drops from 35 to 30 after the bridge just before Periwinkle. Mr. Stringer had not heard of any traffic study taking place and Ms. Grohall would look into- the matter. ATTORNEY MATTERS: Next Wednesday City Council will see the draft of the Interlocal Service Boundary Agreement. Chmn. City Engineer's review: Applicant must provide additional information regarding the alternative paving material proposed for use with regard to the 90% permeable note as stated on the site plan. Proof of St. Johns River Water 8 Management District approval of the material must also be provided. Also, a • detailed maintenance plan must be made a part of the site plan to insure the continuing function of this material. 25. Conclusion: The proposed 50-room, 26,734 SF hotel site plan is consistent with the Comprehensive Plan, Land Development Code, and Riverfront Overlay District requirements. 26. All jurisdictional permits need to be submitted to Growth Management Department, and all the permit types listed on the plans. The following permit types are missing. A. Army Corp of Engineers permit or waiver of permit B. SJRWMD permit, and notice of commencement. C. FDEP in Tallahassee, NPDES, Generic Permit for Stormwater Discharge from Small or Large Construction Activities, NOI (notice of intent). 2. Preservation of recharge potential. Development shall preserve the predevelopment conditions with regard to soil type, drainage rates, grade elevation, and shall be designed so as to minimize the reduction or recharge of the surficial aquifer. The groundwater level and fluctuations shall be substantially the same as predevelopment conditions. 3. Soil removal. Removal of soil from a development site or any portion thereof, which is located above 25 feet mean sea level, is prohibited. 4. Clearing. No clearing of soil or vegetation may occur before a permit for such activity is issued. 5. Excavation. Excavation, which cuts below the seasonal high water table, shall be prohibited unless a qualified engineer prepares adesign/plan and approved by the city engineer that demonstrates that the work can be completed in a manner that will not detrimentally impact the groundwater table. The excavated area may be excavated during the dry season when excavation is done below the seasonal high water level, but higher than the seasonal low groundwater table. The burden of proof of the seasonal levels is by the developer's engineer. 6. Impermeable surfaces. Impermeable surfaces of recharge areas shall be regulated as follows: a. Development on sites with any land having an elevation no greater than 25 feet above mean sea level (MSL) shall restrict impermeable surfaces to 50% of the total area of the site which is 25 feet or less MSL. b. Development on sites with any land exceeding 25 feet mean sea level (MSL) shall restrict impermeable surfaces to 35% of the total area of the site which is above 25 MSL. 7. According to the Phase I Environmental Report by Bio-Tech Consulting, the Giant Airplant (Tillandsia Utriculata), a species listed as endangered with the Florida Department of Agriculture and Consumer Services (FDACS) will require staff approved mitigation. 8. Exfiltration trenches are high maintenance items. If this system type is approved by St John's River Water Management District, the plan detail needs to show 2-3 foot sumps at all inlets and removable skimmers placed over the pipe entrances. -2- Monthly maintenance will be required to minimize re-suspension. The typical life span of the exfiltration trench is 2-3 years and not recommended under pavement in the event of needed maintenance or replacement. 9. The porous parking lot (flex-pave) proposed can easily become clogged with dirt, oil, metals, etc., for proper maintenance it should be cleaned annually with a pavement vacuum truck, not a sweeper or leaf blower, as this will cause an increase in clogging. Additionally, pressure washing on an annual basis should be conducted to remove dirt and oils that may be clogging pores. 10.
