RECOMMENDATION TO CITY COUNCIL - REVIEW OF CAPITAL
IMPROVEMENT PROGRAM & CAPITAL OUTLAY ITEMS GREATER THAN
$50,000 - 6-YEAR SCHEDULE FY6 2008/09 THROUGH FY 2013/14
Mr. Cardinale asked Mr. Minner for the presentation of the CIP. Mr. Minner reviewed the
CIP process for the board. He explained the various funds of the budget. He detailed
some of the projects like police car replacement, continuation of the quarter-round
project, and the Barber/Schumann intersection improvement project. Mr. Minner offered
details on ongoing and upcoming .projects. Mr. Mintier answered questions from the
commission.

The Commission discussed looking into better fuel efficient vehicles for the Police
Department, and their preference to improve the older, existing parks (Schumann &
Riverfront) rather than create a lot of smaller "pocket parks".
MOTION by Dodd/Buchanan to favorably recommend to city council approval of the
Capital Improvement Plan with the modifications discussed.

REVIEW, COMMENTS, AND RECOMMENDATION TO CITY COUNCIL -
INDIAN RIVER DRIVE 8~ MAIN STREET IMPROVEMENT PROJECT
Mr. Minner gave an overview of the project and introduced the engineer of the project
Joe Schulke. Mr. Cardinale asked Mr. Stringer to outline the purpose of the commission
in its revievr of the project. Mr. Stringer quoted LDC 54-1-2.4 (3) i, the commission shall
consider, review and make recommendations concerning studies of city public land
needs and recommend site acquisition for the same, including development plans and
requisite facilities.
Mr. Schulke reviewed the plans and answered questions about timeline, parking, the
actual boat ramp, sidewalk, restrooms, and traffic flow.
Mr. Blais had concerns with the boat parking area having atwo-way directional drive
aisle.
MOTION by Blais/Dodd to recommend city council move forward with the plan. and the
engineer and city manager consider the issues discussed by the commission.

PUBLIC HEARINGS -RECOMMENDATION TO CITY COUNCIL -LAND
DEVELOPMENT CODE AMENDMENTS:
1. Ordinance 0-08-05 -LDC Section 54-3-11.4(f) -Electrical 8~ Lighting
Plans for Marinas and Dock Facilities
Mr. Stringer explained this is from the direction of city council involving a dock. Staff had
not approved the electrical layout to all the slips in a dock where the original marina-had
more slips than were currently authorized for use. The owner had traded out the use of
some slips for additional facilities added to the site. Council wanted to provide some
relief and we do have a provision concerning marinas and dock facilities in the LDC.
What is added is (h) as noted in the ordinance material. After discussion it was
determined the wording should be: "An electrical and lighting layout plan: docks may

provide electrical service to each available boat slip or otherwise provide convenient
service to provide for the lighting and maintenance needs of the dock." Mr. Buchanan
suggested the beginning be changed to the electrical service may be provided to
permitted docks in addition to electrical outlets that may be necessary for the
maintenance or lighting of the docks. That way we would be differentiating between
having docks that are usable and providing electricity to those slips for customers versus
lights and just power washers, etc. on the dock. Ms. Grohall said the city attorney
suggested the terminology to read utility and lighting layout plan which would cover a
wide variety of services.
Mr. Stringer reviewed what was discussed: "A utility and lighting layout plan: service
may be provided to slips that have been permitted and authorized for use as well as
incidental service for maintenance and lighting of the docks."
MOTION by Dodd/Blais to recommend to city council that they adopt revisions to
Ordinance 08-05, Section 54-3-11.4(f) based on the language changes that were stated.

2. Ordinance 0-08-06 - LDC Section 54-3-15.2 - Parking Spaces
Required for Marinas 8~ Waterfront Restaurants
Mr. Stringer presented the backup material. He explained that the parking requirements
for marinas are exactly what the board recommended. Within restaurants, a provision
was added to say, "When co-located with marina facilities, up to five percent (5%) of the
required spaces may utilize designated temporary docking facilities." So, within their site
plan for the parking, they have to designate where these spaces are and then we can
use them in their parking calculations. Ms. Bosworth asked if a definition for temporary
docking facilities be added to the code. Ms. Grohall thought it would be easier to define
it by not adding the temporary definition and removing the transient definition. There
was discussion on the calculation method of parking spaces and dock spaces. It was
determined to use one parking space for every three boat slips. Mr. Dodd suggested the
wording of two spaces plus one parking space for every three boat slips, and take out of
that to accommodate employees.

MOTION by Dodd/Cardinale to recommend to city council approval of Ordinance 0-08-
06 with modifications to section 54-3-15.2 specifically for marinas, two parking spaces
plus one parking space for every three boat slips and including existing language
already in restaurants, when co-located with marinas up to ten percent (10%) of the
required spaces may utilize designated temporary docking facilities. Also authorize
deletion of transient live aboard from the definition.

3. Ordinance 0-08-07 -Temporary Relief Measures for Specified
Commercial Signage
Mr. Stringer explained that this came about from the current economic climate and we
need to be sensitive to the business community. The sign codes are stringent; they
were put in around 1999 because things were getting out of hand. What staff has
suggested is allow sandwich board signs to denote specials, banners for special events
like grand openings, and extend the timeframe from thirty days to sixty days. The
reason they are addressing this as an ordinance and not a code change is to see how
well it works and prevent the changes from becoming grandfathered, if the economy
picks up in a year it gives the commission a chance to say, it helped a little but not worth
the clutter. This would be a temporary measure that would sunset in one year.
MOTION by Cardinale/Dodd to recommend city council approve Ordinance 0-08-07
Temporary Relief Measures for Specified Commercial Signage with a re-evaluation
period of one year including the measures as presented, sandwich boards, banners
sixty-days, addressing the issue of a single site plan.

a. Narrative of proposed action: The applicant is requesting approval of
a conditional use permit for a Dunkin Donuts restaurant with adrive-
though facility to be located in the existing Sharkmart Mobil Gas Station,
at 9490 90th Avenue, at the intersection of CR 512 & CR 510. The drive-
through lane, pick-up window, and menu board will be in the same
location as the out-of--use car wash facility. The site is currently
connected to county utilities for water and wastewater services.

8. Required Findings:
a. Be so designed, located, and proposed to be operated so that the
public health, safety and welfare will be protected. The proposed
commercial use will not adversely affect the public health, safety and
welfare of the surrounding community. Similar existing commercial uses
in the community have not adversely affected the health, safety, and
welfare of the residents.
b. Does not present an unduly adverse effect upon other properties in
the impacted area in which it is located. The proposed use is
consistent with the intent of the surrounding zoning district and does not
present an unduly adverse effect upon other properties in the impacted
area. Property values and use of private property will not be diminished.
c. The scale, intensity and operation of .the use shall not generate
unreasonable noise, traffic, congestion or other potential nuisances
or hazards to contiguous residential properties. The site is not
contiguous to residential properties. The proposed commercial use
should not generate unreasonable hazards or nuisances to surrounding
sites. CR 512 improvements have been designed to diminish levels of
service on the roadway accommodating existing and future commercial
traffic in the area and the near-by residential subdivisions.
d. Conforms to all applicable provisions of the district in which the use
is to be located. The proposed use is consistent with the provisions of
the Commercial General regulations.
e. Satisfies specific criteria stipulated for the respective conditional
use described in subsection 54-2-6.4(38):
1) Separate entrances and exits shall be provided and clearly identified and
in conformance with the sign regulations of article XVI of this code. Joint
entrance%xit curb cuts may be allowed for the ingress and egress and
traffic not utilizing the drive-through facilities

The submitted site plan indicates the proposed locations of the directional
traffic signs. The location of the access onto CR 512 will allow vehicles
using the drive-thru lane immediate exit onto the roadway instead of
having to drive through the Mobil fuel pump area to leave the site.
Alternatively, cars needing to exit onto CR 510 can use the western drive
aisle of the Publix site and make a right turn into the exit aisle drive.
2) No more than two curb cuts shall be permitted on any single street
frontage. Curb cuts shall be limited to a maximum width of 50 feet and
shall be located no closer than 35 feet removed from property lines. A 15-
foot separation shall be maintained between curb cuts.
The site has an existing curb cut on CR 510 and an existing curb cut on
CR 512 (Sebastian Boulevard). These accesses are shared with the
Shoppes of Sebastian property (Publix). Though not 35 feet removed
from the property lines, the shared accesses were designed for sufficient
traffic -flow thru both commercial sites, and for public safety, with
consideration to the proximity of the accesses to the major intersection.
3) No building, structure, or off-street loading or parking area shall be
located closer than 30 feet to any residential use or district.
The closest residential use or district is over 250 feet in distance
4) All travel lanes and driveways shall be interpreted as off-street parking
and as such shall conform to the lano'scape requirements of this chapter.
Additional landscaping is being proposed to bring the site into
conformance.
5) Screening: All side and rear yards abutting residential districts or uses
shall be screened in accordance with the standards established in section
54-3-14.16 of the ordinance.
The site does not abut any residential districts or uses.
f. Consistent with the Code of Ordinances and Comprehensive Plan.
The proposed restaurant with adrive-through lane is consistent with the
Code of Ordinances regulations and Comprehensive Plan elements.
9. Special Criteria: none
10: Additional considerations: The original Sharkmart .site plan was approved
under Indian River County jurisdiction in 1996 as a gas station & convenience store, and
a restaurant with adrive-thru facility. When the restaurant became operational it did not
utilize the drive-thru window, and the owners modified the site plan (through the county)
adding a car wash structure which made use of the drive-through lane. Because the car
wash and use of the drive-thru facility has not been operational for more than 180 days,

the use is considered abandoned, and therefore the conditional use permit for the
proposed Dunkin Donuts is required.
The site and surrounding 5 acres were annexed into the City in 2003. Staff has verified
that the original site plan had to meet more restrictive parking codes for the site through
the county, and therefore is in compliance with current city requirements. City codes
also require a minimum drive-thru aisle width of 8.5 feet. Existing drive-thru lane is 12
feet wide.
However, CR 512 Overlay District Regulations had not been adapted when the site was
developed, and there are some deficiencies in regards to these requirements, i.e.
roofing requirements for the canopies (car wash and fuel pumps), screening, signage,
etc. Though the application is for conditional use approval, the applicant has submitted a
site plan (Sheet A-0) to address and include improvements to the property (additional
landscaping, signage compliance, and screening of mechanical equipment) which will
bring the site closer to compliance with the overlay district regulations. The site plan will
be considered as approved through any approval of the conditional use permit.
11. Other Matters:
During a site visit the dumpster gates were wide open partially blocking the entrance to
the drive-thru lane. These gates should remain closed at all times.
Striping for a portion of the parking spaces should be re-painted for clearer identification
of the areas, especially the parallel parking.
12. Conclusion: A conditional use permit for a restaurant with adrive-through
facility at the Sharkmart location would be consistent with the Comprehensive Plan and
Land Development Code.
13. Recommendation:
Staff recommends approval of the Conditional Use Permit with the following conditions:
a. Dumpster gates to remain closed at all times
b. Re-striping of parking spaces

a. Narrative of proposed action: Mr. Steve Philipson has applied- for a modification
to his approved site plan, Sebastian Airport Storage, amulti-purpose industrial site
located at the Sebastian Municipal Airport Corporate Park on the corner of Roseland
Road and Airport Drive West. The existing site plan, as approved by the Planning
and Zoning Commission on June 15, 2005, included mini-storage buildings, outdoor

24 Analysis: This application addresses proposed changes to an existing site plan. The
drainage system, roadways and landscaping for the entire project, as well as Phases 1
through 5 have already been completed.
The site plan now identifies the remaining phases of the site to be constructed along
with a binding schedule of completion. The former building identified as future

watchman's quarters will now be a specialty retail building for kayak sales and rentals,
along with an area to be used for demonstrations. The area of future warehouse
buildings shown as Phases 10, 11, and 12 is proposed to be used for outside storage
until those phases are to built. An additional sheet (Page 11) has been provided to
detail the erosion control plan for the construction of the remainder of the site
improvements. The landscape plan has been corrected to better identify the species of
trees that were preserved on the site. Further, 22 additional canopy trees will be
provided along east (Airport Drive West) and north perimeters.
25 Conclusion: The proposed multi-purpose development is consistent with all
regulations as established by the Comprehensive Plan, Land Development Code and
Code of Ordinances.
26. Recommendation: Staff recommends approval of these modifications to the
Sebastian Airport Storage site plan.
