MOTION by Paul/Cardinale to approve the minutes of February 15, 2007. A voice vote

Chmn. Allocco swore in staff and anyone wishing to speak. Ms. Bosworth presented the
Maronda Homes renewal application. There have been no code enforcement violations.
There was an issue with signs but that has been corrected. Staff recommends approval.
MOTION by Paul/Morrison to approve the conditional use permit for Maronda Homes
model home renewals at 183 and 185 Stony Point Drive.

There have been no code violations or issues with these sites. Staff recommends

B. PUBLIC HEARING - RECOMMENDATION TO CITY COUNCIL -
MODIFICATION TO A SPECIAL USE PERMIT & SITE PLAN - C-512
CARWASH - 921 SEBASTIAN BOULEVARD -REMOVAL OF FRONT

Ms. King noted the memo included in the commission's packet. As staff could not
recommend approval the applicant has decided to re-evaluate their request. Staff
requests the commission open the hearing and continue it to the May 3, 2007 meeting.
Chmn Allocco recognized Ms. Shirley Harris, 861 Dale Circle, Sebastian, who asked
why did the applicant want to remove the wall. Chmn Allocco responded that the
commission did not know and that the applicant would most likely explain that at the May
3`d meeting.
MOTION by Allocco/Simmons to continue to May 3, 2007 the modification to a special
use permit and site plan for the C-512 carwash.

C. QUASI-JUDICIAL PUBLIC HEARRNG - CR-512 OVERLAY DISTRICT
WAIVER - 741 SEBASTIAN BOULEVARD -SECTION 54-4-21.6.4(b) -
COLOR STANDARD FOR BUILDINGS
Chmn Allocco opened the hearing and swore in all who were to speak. Mr. Herbert
Mulford explained that he had purchased paint to repaint the exterior of his building
unaware that he needed the city's approval of the color. When he requested that
approval he was informed that the color was not part of the overlay district color wheel.

Ms. Grohall gave a presentation on colors in the overlay district, the same one that she
gave to city council. She noted that there are nearly 400 colors to choose from in the
city's color wheel. She added that several property owners have been turned down for
the shade of yellow Mr. Mulford was requesting. Mr. Stringer added that the application
before the commission is for a waiver. The city does not have nullification where you
can just not follow a law because you don't like it. In order to grant a waiver you will
have to decide that a strict interpretation of the requirements of this article, i.e. the color
wheel, places an inordinate burden on Mr. Mulford as defined by Florida statutes. He
then read the statutes' definition of inordinate burden. Mr. Stringer wanted it noted for
the record that the photos Mr. Mulford wanted to put into the record were not accurate
depictions of building colors on CR512 and Mr. Mulford admitted it might not be
accurate. He explained he reason for wanting to use the yellow paint.
After discussion about how the colors are selected for the wheel, wall and trim colors,
and if there were any Mr. Mulford would be satisfied using, Mr. Paut asked if Mr. Mulford
had already purchased paint, he answered he had purchased four (4) gallons. It was
then discussed if the purchased paint could be tinted to comply with the color wheel
however, Mr. Mulford was not incline to do that. After further discussion Mr. Mulford said
he would not repaint his building and leave the existing color on it. As Mr. Mulford would
not withdraw his application an action must be taken.
MOTION by Paul/Simmons to deny the waiver of the C-512 Overlay District Color
Standards for Mr. Mulford's building.
During commission discussion Mr. Mahoney felt the color chosen by Mr. Mulford was
acceptable and he should be allowed the waiver. Chmn Allocco wanted commissioners
to view the photos Mr. Mulford had however, Mr. Stringer said Mr. Mulfot-d must swear
under oath that they fairly and accurately represents what he personally saw at the site
when he took the pictures; Mr. Mulford swore under oath they were photos he took with
a Kodak digital camera.
The bright yellow on the Appliance Direct building was discussed. Ms. King explained
that was painted when the department was between directors and there was some
confusion about wall and trim colors and unfortunately a trim color was selected for the
building color.
Mr. Paul suggested Mr. Mulford withdraw his waiver application as he had not invested a
large sum of money. Mr. Mulford wants to pursue the waiver on principle.

D. PUBLIC HEARING - RECOMMENDATION TO CITY COUNCIL -
PRELIMINARY PLAT -ROHM COMMERCIAL SUBDIVISION - 4.5
ACRES - 1 LOT -LOCATED WITHIN THE 512 TRIANGLE - CG
ZONING AND LAND USE
Chmn Allocco opened the hearing and swore in all those to speak. Representing the
application was Joseph Schulke, Schulke, Bittle & Stoddard, Vero Beach, FL. One of

the issues with the property is the lake that the applicant is proposing to fill and relocate.
They have obtained the SJRWMD permit and Corps of Army Engineer permit. They
have assumed 80% impervious surface development area. Ms. King added that the
subdivision doesn't identify the road because the site has frontage on three streets.
What you are basically looking at is a master storm water system for aone-lot
subdivision. Because of the environmentally sensitive nature of the site, growth
management has asked for all permits to be obtained up front, which they have done.
Staff recommends approval of the application.
There was extensive discussion regarding the de-watering process and environmental
concerns. Mr. Mahoney had reservations on the environmental issues of the site.
MOTION by Morrison/Allocco to recommend city council approve the preliminary pat for
the Rohm Commercial Subdivision located on CR-512.

E. PUBLIC HEARING -RECOMMENDATION TO CITY COUNCIL -SITE
PLAN - 729 SEBASTIAN BOULEVARD - CHESSER'S GAP
SHOPPING CENTER - 6,000 SF RETAIL ~- SHERWIN WILLIAMS
PAINT CENTER -PUD-C ZONING DISTRICT
Representing the applicant was Joseph Schulke of Schulke, Bittle and Stoddard, Vero
Beach, FL. Mr. Schulke gave a description of the site and its location. Ms. Bosworth
offered a few more site details and the history of the property. Overlay district and PUD
compliance was discussed. Ms. Bosworth also explained because the site was located
within a Planned Unit Development the site plan will need to be approved by City
Council. The commissioners had some questions about the architectural design, ingress
and egress, loading dock, landscaping, emergency vehicle access, and fire suppression.
Ms. Bosworth noted that recorded copies of the abandoned and relocated stormwater
easements should be received before building permits are issued.
MOTION by Morrison/Allocco to recommend to city council the approval of Sherwin
Williams Paint Center located at 729 Sebastian Boulevard.

MEMBERS MATTERS:
Mr. Mahoney inquired about the landscaping at Captain and the Cowboy restaurant. Mr.
Cardinale and Mr. Morrison would like staff to do another mailing on the color issue in
the overlay districts. Ms. Grohall responded that currently all applicants are requested to
bring in their color choices at the start of the review process. Mr. Stringer added that in
the past there was some lack of communication between departments, especially with
the hurricanes and growth issues; however, a good working process has currently been
taking place. Mr. Paul asked how the Hula Grill awning is now in compliance and Ms.
Grohall said it had been painted a soft yellow that was within the color wheel.
DIRECTOR MATTERS:
Ms. Grohall explained that an overlay district color palette is not about liking or disliking a
color but choosing a vision and the colors are compatible for that purpose.
ATTORNEY MATTERS:
Mr. Stringer reviewed the first special magistrate hearing and was very positive in the
future of this process. He made mention that with the building stow down this is a very
good time to review and revise the Land Development Code.

RE: 512 Carwash Wall
The new owner of the 512 Carwash, Joseph Koruo, has requested permission to remove the wall from the
front (north side) of his property. However, this wall was a condition of approval of the special use permit
for the carwash. As such, Resolution R-00-56 (approving the special use permit) as well as the revised site
plan dated October 3, 2000 must be amended if permission is to be granted for removal of the wall. As
required by code, the Planning and Zoning Commission must hear the request and make a recommendation
to City Council regarding the special use permit.
The original request was to remove the entire masonry wall. Staff recommended denial of that request for
numerous reasons, including certain buffering requirements in the CR S 12 Overlay District, as well as
landscaping and drainage maintenance issues on the existing site. See attached letter of Rebecca Grohall,
Growth Management Director, dated April 11, 2007.
The applicant has now revised his request. He is asking to remove two feet of the six-foot masonry wall
along the front (north side) of his property. Attached is a revised site plan highlighting the wall change, as
well as acknowledging other site deficiencies that were identified by staff, and must be addressed.
Following is a summary of the wall removal plan, including the site issues:
1. Removal of the top two feet of the masonry wall.
Staff originally had concerns when Mr. Koruo was asking to remove the
entire wall. Section 54-4-21.3(b)(2) of the LDC requires uses with vehicle
and service bays that are oriented perpendicular to CR 512 to provide a
Type "B" buffer with afour-foot high opaque feature along the site's CR
512 frontage. The Type "B" buffer is asemi-opaque screen intended to
partially block visual contact between uses. Large trees are to be utilized as
intermittent visual obstructions from the opaque portion to a mature height
of at least 20 feet. After the removal of the top two feet, the remaining wall
will be four feet in height. The existing vegetation along with the
replacement trees and plants will provide the necessary Type "B" buffer.
2. Replacement of dead or missing vegetation.
The owner is required to replace all dead and missing vegetation on the
site, in accordance with the original approved landscape plan. Some
modification of the species of trees and plants will be permitted, as
identified on the proposed landscape plan. However, the existing oleanders
cannot be accepted as a replacement for the wax myrtles. Although the
oleanders may remain, the wax myrtles must be added or an acceptable
substitute provided.
3. Hours of operation to be limited to 7:00 a.m. to 10:00 p.m.
A condition of Resolution R-00-56 referring to the hours of operation has
been added to the site plan and must be posted on the site.
4. Exterior lighting to be in accordance with City code.
Section 54-3-10.2(e) requires all exterior lighting to be arranged so as to
shield or deflect the light from adjoining properties and public streets. This
note has been added to the site plan.
5. Stormwater tract to be cleaned and maintained on a regular basis.
The stormwater tract is overgrown with tall weeds and debris. Owner must
clean it out and provide continual maintenance.
6. Hedge to be provided on south side of the southern eight-foot wooden privacy fence.
Resolution R-00-56 requires landscaping on the south side of the southern
eight-foot fence. A hedge has been added to the site plan in that area.
Other Considerations:
As a new owner, Mr. Koruo has concerns regarding safety and visibility for his carwash, which is why he is
requesting the modification.
Recommended Action:
Hold public hearing to consider the request for a modification of the site plan and the conditions of the
special use permit for the carwash as stated in Resolution R-00-56, and make a recommendation to City
Council.

As we discussed Friday, the following items need to be addressed on a revised site plan
before Staff will consider a favorable recommendation for Planning and Zoning. Additionally,
your plan will go before the City Council for a modification to Resolution R-00-56.
• Hours of operation limited to 7:OC am to 10:00 PM per the resolution.
• Landscaping must be completely reinstalled as per the original site plan approval, this
includes 9 additional tree; and the hedge that was required on the outside of the wood
fence to the rear of th,z property.
• Resubmittal of yc;~ur site plan showing AT LEAST a 4 ft. wall along the front. Staff will
not recomme;-~d approval for anything less than that nor will they recommend approval
for complete removal of the wall as you have requested.
• Additional landscaping of canopy and understory trees must also be shown.
Staff has several ongoing concerns about your property:
• There is lighting that has been installed that was not a part of the approved site plan.
Your proposed site needs to demonstrate that the lighting meets the overlay district
requirements AND that it was installed with the proper building permits.
• The stormwater retention area (area behind the wall facing 512) is seriously
overgrown, this area must be cleaned and maintained regularly.
• Corrections to site plan modification including correcting the owner information.
Staff had originally scheduled your site plan for review at the Planning and Zoning meeting of
April 19th. However, we will be rescheduling your site for review at the Planning and Zoning
meeting of May 3 , 2007. In order for staff to schedule you for the May 3~d meeting, we will
need to receive the revisions by April 20th, 2007.

WHEREAS, Ken Chestnut has filed an application for approval of a special use
perrrut to operate a commercial carwash in the C-512 zoning district; and
WHEREAS, stafffinds the requested permit to be in compliance with the
Comprehensive Plan and LDC of the City and said special use permit was recommended
for approval by the Planning and Zoning Commission on August 3, 2000, subject to three
special conditions; and
WHEREAS, said special use permit was rejected by a 4-1 vote of the City
Council on September 13, 2000, but a subsequent Motion for Reconsideration of this
matter passed by a 5-0 vote on September 27, 2000;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
CITY OF SEBASTIAN, as follows:
Section 1. SPECIAL USE PERMIT APPROVAL. The City Council of

This letter is in respect to the application to construct a detached garage at 1043 Genesee
Ave. The existing shed that is shown next to the proposed garage is in the 10' setback. l
fully intend to remove this shed as soon as possible after the construction of the garage.
will apply for a permit at that time to remove this shed. I would very much appreciate a
six month extension as far as removing the shed, after the C.O. is granted on the garage.
The reason I am asking you to approve a garage this large, is that the garage is going to
be a woodworking shop on the east side, and storage on the west side. I am a
woodworking hobbyist, and at the present time all my woodworking tools are stored in
my attached garage, which is full to the brim. The shed is being used for lawn equipment
used to maintain my very large yard. It is my promise that the shed will be removed
within six months of the time I am allowed to start moving into the garage.
I will have no need for a driveway at this time, but the garage doors are for ventilation,
and for future value if I sell the property and the new owner would desire to use it as a
garage. They could add the driveway at that time.
