ORDINANCE NO. 0-12-02
AN ORDINANCE AMENDING CHAPTER 58, ARTICLE III OF
THE CODE OF ORDINANCES FOR THE CITY OF SEBASTIAN,
INDIAN RIVER COUNTY, FLORIDA, ENTITLED `�POLICE
OFFICERS' RETIREMENT SYSTEM"; IMPLEMENTING
PROVISIONS OF THE 2011-2013 COLLECTIVE BARGAINING
AGREEMENT BETWEEN THE CITY OF SEBASTIAN AND THE
COASTAL FLORIDA POLICE BENEVOLENT ASSOCIATION;
PROVIDING A DECREASE IN THE BENEFIT MULTIPLER FOR
MEMBERS HIRED ON OR AFTER TI3E EFFECTIVE DATE;
PROVIDING AN EFFECTIVE DATE; AND REPEALING ALL
ORDINANCES INCONSISTENT HEREWITH.
WHEREAS, the City of Sebastian recently entered into a collective baxgaining
agreement with Coastal Florida Police Benevolent Association covering the period from October
l, 2011 through September 30, 2013; and
WHEREAS, the collective bargaining agreement provides for certain changes to the
Police Officers' Retirement System; and
WHEREAS, to implement the changes to the Police Officers' Retirement System it is
necessary to amend the Police Officers' Retirement System ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, THAT:
SECTION 1. The recitals and findings contained in the Preamble of this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
SECTION 2. Section 58-46 of the "Code of Ordinances, City of Sebastian, Florida"
pertaining to "Police Officers' Retirement System" is hereby amended to read as follows:

Sec. 5�-46. — Police officers' pension plan.
The City of Sebastian shall maintain a local law pension plan for Citv police officers s�t-�e�
' in accordance with the provisions of F.S. ch. 185. The
provisions of F.S. ch. 185 are adonted and incorporated herein by reference except as otherwise

(8) Notwithstanding the provisions of F.S. § 185.16(2) to the contrary:
The amount of the monthly retirement income payable to a police officer hired
who retires subsequent to May 31, 2002 and on or after his or her normal
retirement date shall be an amount equal to the number of the police officer's
years of credited service multiplied by 3.0 percent of his or her average final
compensation. Notwithstandin� the preceding sentence for police officers hired
on or after the effective date of this Ordinance the amount of the monthlv
retirement income pavable to a police officer who retires on or after his or her
nortnal retirement date shall be an amount equal to the number of the police
o�cer's vears of credited service multiplied bv 2 0 percent of his or her avera�e
final compensation. However, if current state contributions pursuant to this
chapter are not adequate to fund the additional benefits to meet the minimum
requirements in this chapter, only ineremental increases shall be required as state
moneys are adequate to provide. Such increments shall be provided as state
moneys become available.

SECTION 3. Ordinances in conflict herewith are hereby repealed to the extent of such
conflict.
SECTION 4. Should any section, sentence, clause, part or provision of this Ordinance
be declared invalid or unenforceable by a court of competent jurisdiction, the same shall not
affect the validity of this Ordinance as a whole, or any part thereof other than the part declared to
be invalid.

Section 5. Effective Date. This ordinance shall take effect immediately upon adoption.
