Meeting was called to order by Mr. Dalessandro at 6:00 P.M. Pledge of Allegiance was led by Mr. Dalessandro. ROLL CALL: Present: Mr. Dalassandro Mrs. Heck Mr. Fortier Mr. Berry Mr. Bulla Mrs. Heck Excused: Ch. Carbano, Mr. Hosey, Mr. Redden APPROVAL OF MINUTES: Regular meeting held March 8, 2011. I make a motion we approve the minutes of ineeting held March 8, 2011 as written. MOTION: Bulla / Fortier A voice vote was taken — passed unanimously. ANNOiJNCEMENTS: None OLD BUSINESS: Board agreed to postpone the appointing of new Vice Chairperson until all members are present due to resignation of Mr. Widup. NEW BUSINESS: The City of Sebastian Building Official, Wayne Eseltine, explained to the Construction Board the reasoning for bringing both qualifiers for Florida Solar East, Mr. West and Mr. Fuller, in front of the board while giving options the Board may take regarding the violations presented. Board may fine no more than $500 for each offense and refuse future permits until qualifiers come into compliance. Mr. Eseltine gave staff recommendation which would be to suspend permitting of the company until qualifiers come into compliance. Our findings will be sent to the DPPR once decision is made. Neither of the qualifiers for Florida Solar East, Mr. West nor Mr. Fuller, were present after having been notified via certified mail which was received and signed for. IN THE MATTER OF ARTHUR WEST, DBA FLORIDA SOLAR EAST, FLORIDA LICENSE NO. CWCO27561 VIOLATION AT: 1844 BARBER ST. SEBASTIAN, FL 26-172(1) WILLFUL DISREGARD OF THE BUILDING CODES FOR PERFORMING WORK WITHOUT A PERMIT. FLORIDA BUILDING CODE 105.1 After much discussion, a motion was made to fine Mr. West $500 for this violation and suspend his license privileges in the city until he comes into compliance. CPC 032536 VIOLATIONS AT: 1557 QUATRAIN LN SEBASTIAN, FL 26-172(1) WILLFUL DISREGARD OF THE BULDING CODES FOR PERFORMING WORK WITHOUT A PERMIT. FLORIDA BUILDING CODE 105.1 644 ERVIN ST. SEBASTIAN, FL 26-172(1) WILLFUL DISREGARD OF THE BUILDING CODES FOR EXPIRED PERMIT WITH FAILED INSPECTION. FLORIDA BUILDING CODE 105.4 1401 TRADEWINDS WAY SEBASTIAN, FL 26-172(1) WILLFUL DISREGARD OF THE BUILDING CODES FOR EXPIRED PERMIT WITH FAILED INSPECTION. FLORIDA BUILDING CODE 105.4 After lengthy discussion, motion was made to fine $500 for each violation and includes any and all other fees regarding each violation, license will be suspended until qualifier comes into compliance. MOTION: Heck / Bulla ROLL CALL: Mr. Bulla - yes Mrs. Heck — yes Mr. Fortier - yes MOTION CARRIES: 5 — 0 Mr. Dalessandro - yes Mr. Berry - yes BUILDING OFFICIAL MATTERS: Wayne Eseltine, Building Official updated Board of recent activity of the Building Department. There has been an increase of commercial permits which had previously been in the pipeline. New to the area residential builder, DR Horton, has submitted several single family home permits and this issuance of permits since last meeting in March 2011, the Building Dept. budget to date appears to be breaking even. Also, discussed were new changes to become effective 12/31/11 due to the new bill which is on the Governor's desk representing the 3 year cycle of changes of the Florida Building Code 2010. All states including Florida have adopted the ICC (International Code Council) but Florida has more stringent codes which addresses changes since the Florida Building Code of 2007. A few changes mentioned were that of the flood plain will be mandated in code as well as wind zone will have many changes. Accessibility code by the Florida Dept of Justice will also be addressed.
