HomeMy WebLinkAbout03041999i t' "`• Minutes of the Indian River County Municipal Canvassing Boards Orientation Meeting and Logic and Accuracy Test Thursday, March 4, 1999 - 3:00 p.m. 1 st Floor Conference Room B Indian River County Administrarion Building 1840 25th Street Vero Beach, FL present: Indian River County: Supervisor of Elections, Kay Clem; County Attorney, Charles Vitunac; Chief Deputy Supervisor of Elections, Diana Wright; and Absentee Ballot Coordinator, Mazge Trumble City of 5ebastian Canvassing Board Members: Chairperson and City Clerk, Kathryn O'Halloran; Vice Mayor Martha Wininger; and Deputy City Clerk, 5ally Maio City of Vero Beach Canvassing Board Members: City Manager, Rex Taylor; and City Clerk, Tammy Vock City of Fellsmere Canvassing Board: Mayor Bob Baker and City Clerk, Deborah Krages (3:15 p.m.) Town of Indian River Shores Canvassing Board: City Clerk (3:55 p.m.) Supervisor of Elections, Kay Clem gave a brief presentation, and an overview of procedures which will be followed on March 9, 1999 relative to absentee ballots. She stated that for the City of Sebastian, 25 had been requested and 15 had been received so faz. She stated that following the opening and certification of absentee ballots, the logic and accuracy test will be conducted, the machines will be certified to be beginning at zero, that all canvassing members should view all aspects of receiving and inspection, however, one member must remain in the room to view the ballot counting at all times. She did state, however, in the event of a spoiled ballot, all three members will need to be brought back together for duplication and signature. Once counting is completed, Mrs. Clem said the canvassing board members will have to return to the counting room to certify results and the zeroing out of the machines. Absentee ballot canvassing boazd guidelines were reviewed (see attached as distributed at the meeting). Mrs. Clem briefly reviewed procedures regarding recount, protest and contest of election returns, and certification. She then showed a videotape on the subject. She noted that any vote difference of less than 1/2 of a percent will require a recount; and then cited the difference between a protest and a contest. A protest is filed with the canvassing board by a candidate or elector within five days; and a contest is filed with the clerk of the circuit court by an unsuccessful candidate or taxpayer within 10 days. .� -, Minutes of the Indian River County Municipal Canvassing Boards Orientation Meeting and Logic and Accuracy Test Thursday, March 4, 1999 - 3:00 p.m. Page Two It was noted that the location for Sebastian Precinct 14 has been changed to Highlands Chapel Church of God. Mrs. Clem reviewed forms she had provided to the canvassing boards and specifically noted the County's adopted Absentee Ballot Canvassing Board Guidelines (attached). Following some discussion of an acceptable witness address, motion was made. MOTION by O'Halloran/Maio I move to accept the written guidelines. The meeting was adjoumed at 3:50 p.m. and all members were escorted to the Supervisor of Elections' office for the Logic and Accuracy Test, which began at 4:00 p.m. City of Sebastian Canvassing Board members, along with other Canvassing Board members certified the test. In accordance with Section 4.08(c) of the City Charter, "The City Council shall hold a Special Meeting on the firstMonday following the election for the purpose of receiving the certificate of the county canvassing board of the returns for Indian River Counry, Florida, or the city canvassing board, as the case may be. The City Council shall then declare the results of the election and enter them in the minutes of the special meeting. " 2) Investiture of Newly Elected Citv Council Members: Recommended Action: The City Cierk shall conduct investiture of newly elected City Council members and the new members will take their places at the dais. In accordance with Section 2.04(b) of the City Charter, "The term of each newly elected council member shall begin on the Monday following the election, at a special meeting of the ciry council to be held for the purpose oJswearing in such newly elected officials. If a regular meeting is to be held the Monday following the election, the newly elected officials shall be sworn in at the conclusion ofsuch meeting. " Section 4.08(c) con#nues, "Any oath of office reguired to be administered to the newly elected council members shall be administered at such special meeting or at the next ciry council meeting where the newly elected council members are in attendance." 3) Election of Mayor Recommended Action: The senior member of Council shall ask for nominations for mayor and then close nominations. The City Clerk will then call the roll on each nominee and each Council member shall vote in the affirmative on nominee of his/her choice. The first nominee that receives a majority of affirmative votes shall be elected mayor. In accordance with Section 2.06 of the City Charter, "...after the seating of any newly elected council members, at the�rst scheduled city council meeting subsequent to the second Tuesday in March, the new city council shald, as the first order of business, elect a mayor from among its members. The incumbent mayor or in his or her absence, the vice-mayor or in his or her absence, the senior member of ciry council, shall ask for nominations for mayor. After all nominatrons have been made, the nominations shall be closed. The ciry cderk shall then call the roll of the council members and each council member shall cast an affirmative vote for the council member of their choice. The council member that receives a majoriry of the votes cast on the first ballot, balloting with seguential roll calls shall continue untid a councid member receives a majority vote. Council members shall not nominate themsedves. Only elected council members shall be eligible for the office of mayor. (1) If there is no mayor seated on the new or existing ciry council, a temporary city council chairperson may be elected from the incumbent members of the ciry council for the purpose of electing a mayor as set forth above. (2) In the event there is only one nomination and second for mayor, the nominee shall be seated as mayor. " 4) Election of Vice Mayor Recommended Action: The newly elected mayor shall ask for nominations for vice-mayor. The City Clerk will then call the roll on each nominee and each Council member shall vote in the affirmative on nominee of his/her choice. The first nominee that receives a majority of affirmative votes shall be elected vice-mayor. In accordance with Section 2.06(c), "At the first regularly scheduled city council meeting subsequent to the second Tuesday in March, the city council shall elect a vice-mayor f'rom among its members. The term of the vice-mayor shall be for one year or until his or her successor is edected. The vice-mayor shall be elected using the same procedure as for the election of the mayor.
