Investiture of Newlv Elected Officials bv the Citv Clerk The City Clerk swore in newly elected City Council Members, Lisanne Monier and Michael Heptinstall, who then took their places at the Council dais. Special City Council Meeting March 15, 2004 Page Three 2. Election of Mavor Vice Mayor Coniglio called for nominations for Mayor. Mr. Barczyk nominated Mr. McCollum. Ms. Monier nominated Vice Mayor Coniglio. The City Clerk called the roll and the vote was as follows: Mr. Barczyk — Mr. McCollum Mr. Heptinstall — Mr. McCollum Mr. McCollum — Mr. McCollum Ms. Monier — Mr. Coniglio At this point in the vote, Mr. Coniglio asked that the vote be unanimous for Mr. McCollum and Ms. Monier agreed. The vote then became 5-0 for Mr. McCollum to be appointed Mayor for a one-year term. 3. Election of Vice Mavor Mayor McCollum called for nominations for Vice Mayor. Mr. McCollum nominated Mr. Barczyk. Ms. Monier nominated Mr. Coniglio. Mr. Coniglio declined the nomination and asked for a unanimous approval for Mr. Barczyk and all members agreed. Mr. Barczyk was appointed Vice Mayor for a one-year term. 6. CLOSING REMARKS BY COUNCILMEMBERS Ms. Monier and Mr. Heptinstall thanked all involved in their elections and vowed to work toward the betterment of the City. WHEREAS, pursuant to Section 4.05 of the City Charter, the Mayor issued a Proclamation on December 10, 2003, calling for a general election in the City of Sebastian for March 9, 2004; and WHEREAS, the City Council, pursuant to Section 4.07 of the City Charter, adopted Resolution No. R-03-56 on December 10, 2003, specifying Precincts 103, 104, 105, 106, 107, 109, 201, 203, and 204 as the official polling places for the City of Sebastian for the general election, and naming the offices to be filled; and WHEREAS, the City Clerk of the City of Sebastian, pursuant to Section 100.021 of the Florida Statutes, published notice of the general election on December 26, 2003, and January 2, 2004 in the Vero Beach Press Journal, a newspaper of general circulation. Recommended Action: Move to adopt Resolution No. R-04-10. 2) Presentation of Plaque to Mayor Barnes NEW CITY COUNCIL 1) Investiture of Newly Elected City Council Members and Seating at the Dais: Recommended Action: The City Clerk will call each newly elected official to the podium individually to be sworn in and then the newly elected City Council member shall take his/her place at the dais. In accordance with Section 2.04(bj of the City Charter, `The ferm of each newly e/ecfed council member shall begin on the Monday following fhe election, af a special meefing of the city council to be held for the purpose of swearing in such newly elecfed officials. If a regu/ar city council meeting is to be held fhe Monday following the e/ection, the new/y elected officials shall be sworn in at the conclusion of such regular meefing." Section 4.08(c) confinues, "Any oafh of office required to be administered fo the newly elected council members shall be administered af such special ciiy council meeting or at the nexf cify council meeting where the newly elected council mem6ers are in attendance." 2) Election of Mayor Recommended Action: The incumbent Mayor, or in his absence, the Vice Mayor, shall ask for and receive nominations for mayor and then close nominations. The City Clerk will then call the roll and each Council member shall vote in the affirmative on nominee of his/her choice. The first nominee that receives a majority of affirmative votes shall be elected mayor. Vice Mayor Coniglio will call for nominations. In accordance with Section 2.06 of the City Charter, `:..after fhe seating of any newly e/ected council members, ai fhe firsf scheduled city council meeting subsequenf to the second Tuesday in March, the new cify council shall, as the firsf order of business, elect a mayor from among its members. We have five candidates who filed by the end of qualifying this past Friday, January 23, 2004. They are Walter W. Barnes, Michael Heptinstall, Ed Majcher, Lisanne Monier and Lonnie R. Powell. The LDC provides very specific requirements for size, location of signs (none in public right-of-way - private property only), posting no more than thirty days before the election and removal within five days after the election, and provisions for violation of these regulations by the Code Enforcement Division. The City election is March 9, 2004. Signs may be posted no earlier than February 8, 2004 and must be removed by Sunday, March 14, 2004. I believe that this section regulates all political signs on posts for all elections, not just the City election. I have an opinion from the City Attorney in answer to a question by a candidate that these regulations do no apply to signs on vehicles which can be placed at any time. Thanks for your help. Mavor Barnes � C ��: � ��'�. -Thanked all who sent cards and wishes and prayers. -Inquired why Planning and Zoning is not complying with Council's wishes on density and setbacks for PUDs. The City Attorney said there was no clear direction from City Council and Planning and Zoning thought it wanted a ten foot separation. Ed Seeley, Planning and Zoning, suggested that guidelines be put in writing. Mayor Barnes recommended that fifteen-foot clearance between houses should be added to Council's unwritten policy. Mr. Hill -Received calls regarding the parking lot at George Street Park. The City Manager said six spaces were installed which alleviated illegal parking that was occurring at the site. He said he did not believe buffering was necessary. Mr. Hill said the parking area was right across from a residence and it should be buffered. He asked that the City Manager look at this and get back to him. Mr. Coniglio -Reported that Indian River County is allowing grove owners to put in stands and shops to keep some groveland from turning into residential. -Reported that the MPO has looked at turn lanes for intersections on CR512 since cars are cutting over closely to pedestrians however there is nothing that can be done at this time. Mr. Coniglio asked drivers to be patient with the pedestrians. 11 / RESOLUTION NO.
