Jason Mills asked about the possibility of PBA employees leaving City plan. • Reviewed current health insurance renewal options to include City traditional plan versus flexible spending accounts. And the possibility of placing have the City savings resulting from this type of plan into each employee's flexible spending account. Amount to be approximately $750.00 annually. ✓ Confirmed a City workshop to review flexible spending accounts if this is the direction the City chooses. Retirement ✓ Much discussion on whether the CBA meetings were an appropriate venue to discuss this item, as it is not presently included in CBA. ✓ All parties agreed to clarify the legality of when and where to discuss this benefit. ✓ All parties agreed to have an educational meeting with the bargaining members to educate on the changes proposed by the City. All other items to be discussed were tabled until it was determined how to discuss and negotiate the Chapter 185 pension plan. Next Meeting: To be determined. Pam Stern to get back with me in regards to next CBA meeting and educational meeting to be held some time next week to educate PBA bargaining members on the changes proposed to the retirement plan. Respectfully Submitted, Debra Krueger Administrative Services Director P:\PBA\PBA 2012 \Minutes Labor Contract Negotiations July 6, 201 Ldoc 7/7/2011 PBA Labor Contract Negotiations Meeting Minutes August 4, 2011 @ 1:50pm Present: Vincent Champion, PBA Representative Pam Stern, PBA Representative Jason Mills, PBA Representative Dan Acosta, PBA Representative Steve Marcinik, Police Officer Al Minner, City Representative Greg Witt, City Representative Ken Killgore, City Representative Debra Krueger, City Representative CFPBA offered the following verbal counteroffer to the proposal offered from the City in the memo dated 06/22/11, and in negotiation meetings held on 06/22/11 and 07/06/11. 1. Increase member Chapter 185 contribution by 2 %, from 5% current to 7 %. 2. Eliminate Furlough Program 3. Agree to city request of only (1) temporary assignment per hour. City Manager gave out official initial proposal to memorialize his memo dated 06/22/11, and then subsequently reviewed the document. The financial impact of CFPBA counteroffer was then estimated. 1. Increase member Chapter 185 contribution by 2 %, from 5% current to 7 %. — savings of $50,000 2. Eliminate Furlough for Fiscal Year 2012 — increase of $125,000 3. Agree to city request of only (1) temporary assignment per hour — savings of $11,000. This counteroffer would increase current costs by 64,000. City Manager stated we need to find center ground with savings in the range of $250,000 - $400,000. City Manager than counter- offered a 2 -year agreement with the following parameters: FY 2012 — contract in status quo FY 2013 ✓ decrease the pension retirement factor from 3% to 2% ✓ increase employee dependent care contribution from 50% to 75 %. The FY 2013 agreement would be contingent upon assessed values. If assessed values do not decrease, we will negotiate a new contract. P:\PBA \PBA 2012 \Minutes Labor Contract Negotiations August 4, 201 Ldoc 8/4/2011 1 Jason Mills proposed a 3 -year agreement, with the following parameters: FY 2012 — contract in status quo FY 2013 ✓ increase in employee pension contribution by 2% ✓ remove the holiday pay for members not scheduled to work the holiday ✓ continue the furlough program FY 2014 ✓ increase in employee pension contribution by 3% Again, as in the City Managers counter proposal, FY 2013 and FY 2014 would be contingent upon assessed values being less than the previous years. If assessed values do not decrease, we will negotiate a new contract. Al Minner then asked if in lieu of the respective 2% and 3% increase proposed, we could just agree to 2.5% each year. The parties then separated to caucus. Vince Champion then calculated that the police department is roughly 44% of the budget, and mentioned that the police department should only be responsible for 44% of the $250,000 short fall which would equate to approximately $110,000. He then proposed a 2 -year agreement with the following parameters: FY 2012 — contract in status quo FY 2013 ✓ increase in employee pension contribution by 2.5 %, savings — saving approximately $55,000 ✓ remove the holiday pay for members not scheduled to work the holiday — saving approximately $50,000 ✓ Agree to city request of only (1) temporary assignment per hour — savings of $11,000. This counteroffer would decrease FY 2013 costs by $116,000, which would be right inline with the police department's share of the budget. Then the following items were briefly discussed by both parties: ✓ Assessed Valuation Date would be July 1, 2011. ✓ If assessed values are over $89013 — renegotiate, between 870B - $88013 — status quo, below 870B — year 2 of contract is implemented. ✓ Change in retirement plan for new officers. The next CFPBA Negotiation meeting is scheduled for Tuesday, August 9, 2011 from 2pm — 4pm. Revenue chart showing how revenues are forecasted. 2. Graph of historical trend and estimations of revenues. 3. Long range financial forecast including the PBA proposal, which the City slightly modified by moving Article 16 & 17 and Holiday Pay proposals from FY 2013 to FY 2012. Additionally the forecast included the CFPBA's proposal of increasing the employee pension contribution by 2.5 %. 4. Long range financial forecast including the City proposal. The City proposal is included as part of these minutes. 5. City proposal. ✓ Pam Stern, then reiterated from the last meeting that the PD is roughly 44% of the budget, and therefore, the PD should only be responsible for 44% of the budget shortfalls, and since the City is requesting more than $116,000 from the PD, that we are balancing the budget on the back of the PD. ✓ Dan Acosta followed up by say the PEA was not helping to mitigate costs. However, Al Minner confirmed that his FY 2013 forecast does in fact include increased health care costs for the PEA. ✓ Discussion then ensued in reference to raising taxes, and citizen's responsibility to help share the burden. ✓ Vince Champion stated that the PD is not requesting the return of Furlough days at this time. The PBA would rather have the City use that savings to help mitigate other costs. He also spoke about the increased costs to employees' dependent health care in FY 2013, specifically the increase to 75% employee responsibility, as well as paying any premium increases over 5 %. It is too much. ✓ Al Minner than said the City pays the 2 °d highest dependent care premium in the region, and the highest is Fort Pierce. 3:10 pm caucused 3:55 pm returned P: \PBA \PBA 2012 \Minutes Labor Contract Negotiations August 9, 2011.doc 8/23/2011 ✓ Vince Champion then counter offered to the City's proposal the following: 1. Move items 1, 2 and 3 to FY 2013 2. Remove 4 & 5 3. Keep #6 for FY 2012 4. Decrease PD contribution in FY 2013 to 8% 5. Remove #2 ✓ The City then incorporated the CFPBA counter offer into a chart. ✓ The City then counter offered to the CFPBA's offer the following: 1. Agreed to move items 1 & 2 to FY 2013 2. Remove 3 & 4 3. Move 5 to FY 2013 4. Confirmed #6 OK for FY 2012 5. 8% employee pension contribution for FY 2013 was OK for now. 6. Increase City's proposed contribution for dependent health care from 25% to 33.5 %. ✓ The PBA then countered with some suggestions: _ 1. Confirmed items 1 & 2 to FY 2013. Move language change to Article 16 and 17, temporary assignment and assignment pay, to FY 2013. Move language change to Holiday Pay to Fiscal Year 2013. 2. Confirmed removal of item 3.Return 6 furlough days to the PD. 3. Remove item 4. Language change to Article 33 and 34, vacation and sick leave. 4. Move item 5 to FY 2013 and change to 10 %. City does not cover medical benefit increases greater than 5 %. 5. Keep item 6 for all new officers hired after October 1, 2011. Accrual factor of 2 %, retirement contribution of 5 %, health care contribution of $25 per month, 25% city contribution for dependent health care, and no vacation /sick leave buy back. 6. Confirmed 8% employee pension contribution for any officers hired prior to October 1, 2011. 7. Increase City Proposed Dependent Care contribution from 33.5% to 40 %. 8. Additionally, keep the FY 2013 override. If total taxable assessed value of the City as projected by the Indian River County Appraisers Office on July 1, 2012 is greater than $878,441,378, Year 2 of the contract will be null and void. 9. Possible re- opener for FY 2013 contract could be health insurance. ✓ The above proposal was the last proposal on the table before we ended. ✓ It was then agree by both parties we would end the meeting and speak with our respective associates to see if what we were negotiating was something that could possibly be agreed upon by the members and council. The next CFPBA Negotiation meeting is scheduled for Tuesday, August 23, 2011 from l Oam — 3pm. Updated minutes to reflect correction will be sent out. ✓ Al Minner began the meeting, picking up where negotiations left off at the August 9 meeting by providing an official City Counter proposal based upon discussions at the end of the previous meeting. ✓ See attached counter for specific detailed references to the following items: IA, 113, 1C, 1D, 1E, 2.1, 2.2, 2.3, 2.4 and 2.5. ✓ Pam Stern then asked for clarification on the Year 2 — FY 2013 override. It was explained that the City receives and email on June 1 with the initial estimated, and on July 1, the City receives official notification of the taxable value on the DR420 form, which the City is required by statute to base our annual budgets upon. ✓ Jason Mills then explained the following membership concerns with the counterproposal: 1.D — It is important to keep all coverage the same whether a new officer or not and 2.3 — greater than 10% cost. ✓ Discussion then ensued on the provisions of Flexible Spending Accounts Caucused: ✓ PBA then proposed remove l.D and 2.3 and 2.5. ✓ City proposed modification of 2.5 to 40% and remove 2.2. ✓ Additionally City proposed removing everything from negotiation if the membership could agree to uniform pay reductions. Lunch Break ✓ Jason Mills then explained how the police officers had been taking furloughs for 4 years, and with the following items tentatively agreed upon: which are IA-E, 2.1, 2.2 and 2.4, with no budging from the City, there is no more to give. P: \PBA \PBA 2012 \Minutes Labor Contract Negotiations August 23, 201 Ldoc 8/24/2011 ✓ Different scenarios of the CBA proposals were then discussed with the final offer coming from the PBA which was as follows: Move 2.1 and 2.1 to Year 1 and remove 2.3 and 2.4 period, or Keep 2.1 and 2.1 in year with a combination of 2.3 and 2.5 — if medical benefit increases greater than 10% dependent care coverage will increase from 50% to 60 %. If there are still issues with health insurance in 2014 we will address the dependent care issue again. Additionally, for 2.2, the PBA requested the ability to bank the floating holiday and have the ability to roll over to next FY, The next CFPBA Negotiation meeting is scheduled for Tuesday, August 3 1) 2011 from loam — 2pm. Year One — FY 2012 - Article 16, Article 17 — Only one temporary assignment at a time. 2. Year One — FY 2012 — Floating Holidays in -lieu of paid holidays. 3. Year One — FY 2012 — For all new police officers hired after October 1, 2011: A. Retirement Accrual Factor — 20 %, B. New SPD Officers retirement contribution 5 %, C. Employee Only Health Care Coverage - $25, D. Dependent care health program — 25% city contribution, E. No vacation / sick time buy back 4. Year Two — FY 2013 — All employees hired prior to October 1, 2011, increase retirement contribution to 8 %. 5. Year Two — FY 2013 Override — If total taxable assessed value of the City of Sebastian, as projected by the Indian River County Appraisers Office on July 1, 2012, is greater than $878,441,373, Year 2 of Contract shall be null and void. ✓ The PBA concurred this offer was still on the table, and the proposal was tentatively agreed by both parties. ✓ Reviewed upcoming schedule for approval: 1. Tentative Agreement 2. Send information to Division of Retirement for their tentative approval, before proceeding with final approval of bargaining agreement and Ordinance preparation and readings. 3. PBA have their membership vote. 4. If PBA ratifies, and Division of Retirement preliminarily approves, send to City Council for approval. 5. Prepare ordinance.
