We do not have any elections scheduled for the reminder of this year and the election schedule for 2002 is as follows: Tuesday, March 12, 2002 Municipal Elections Tuesday, September 10, 2002 First Primary Tuesday, November 5, 2002 General With the passing of the Election Reform Act of 2001, the Legislature has removed the Second Primary for the year 2002; therefore, we will have no election in October, 2002. ORIGIN: City Clerk G DATE SUBMITTED: 3/14/01 MEETING DATE: 3/19/01 EXHIBITS: R -01 -20 Expenditure Required: Amount Budgeted: Appropriation Required: Not At This Time 1) Resolution No. R -01 -20 Recommended Action: Move to adopt Resolution No. R- 01 -20, certificate of canvassing board (by current City Council members). In accordance with Section 4.08(c) of the City Charter, "The City Council shall hold a Special Meeting on the first Monday following the election for the purpose of receiving the certificate of the county canvassing board of the returns for Indian River County, Florida, or the city canvassing board, as the case may be. The City Council shall then declare the results of the election and enter them in the minutes of the special meeting. " 2) Investiture of Newly Elected City Council Members: Recommended Action: The City Clerk will call each newly elected official to the podium individually to be sworn in and then the newly elected City Council member shall again take his place at the dais. In accordance with Section 2.04(b) of the City Charter, "The term of each newly elected council membershall begin on the Monday following the election, at a special meeting of the city council to be held for the purpose of swearing in such newly elected officials. If a regular city council meeting is to be held the Monday following the election, the newly elected officials shall be sworn in at the conclusion of such regular meeting." Section 4.08(c) continues, `Any oath of office required to be administered to the newly elected council members shall be administered at such special city council meeting or at the next city council meeting where the newly elected council members are in attendance." 3) Election of Mayor Recommended Action: Mayor Barnes, as the incumbent Mayor, shall ask for and receive nominations for mayor and then close nominations. The City Clerk will then call the roll and each Council member shall vote in the affirmative on nominee of his /her choice. The first nominee that receives a majority of affirmative votes shall be elected mayor. In accordance with Section 2.06 of the City Charter, "...after the seating of any newly elected council members, at the first scheduled city council meeting subsequent to the second Tuesday in March, the new city council shall, as the first order of business, elect a mayor from among its members. The incumbent mayor or in his or her absence, the vice -mayor or in his or her absence, the senior member of city council, shall ask for nominations for mayor. After all nominations have been made, the nominations shall be closed. The city clerk shall then call the roll of the council members and each council member shall cast an affirmative vote for the council member of their choice. The council member that receives a majority vote shall be elected mayor. In the event no council member receives a majority of the votes cast on the first ballot, balloting with sequential roll calls shall continue until a council member receives a majority vote. Council members shall not nominate themselves. Only elected council members shall be eligible for the office of mayor. (1) If there is no mayor seated on the new or existing city council, a temporary city council chairperson may be elected from the incumbent members of the city council for the purpose of electing a mayor as set forth above. (2) In the event there is only one nomination and second for mayor, the nominee shall be seated as mayor. 4) Election of Vice Mayor Recommended Action: The newly elected mayor shall ask for nominations for vice - mayor. The City Clerk will then call the roll on each nominee and each Council member shall vote in the affirmative on nominee of his /her choice. The first nominee that receives a majority of affirmative votes shall be elected vice - mayor. In accordance with Section 2.06(c), "At the first regularly scheduled city council meeting subsequent to the second Tuesday in March, the city council shall elect a vice -mayor from among its members. The term of the vice -mayor shall be for one year or until his or her successor is elected. The vice -mayor shall be elected using the same procedure as for the election of the mayor. R -01 -20 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, PERTAINING TO THE MUNICIPAL ELECTION; PROVIDING FOR CANVASSING OF ELECTION RETURNS; PROVIDING FOR DECLARATION OF RESULTS; DIRECTING THE CLERK TO ENTER THE RESULTS OF THE ELECTION IN THE OFFICIAL MINUTES OF THE MEETING OF THE CITY COUNCIL; PROVIDING FOR REPEAL OF RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Mayor of the City of Sebastian, pursuant to Section 4.05 of the City Charter, issued a Proclamation on December 20, 2000, calling a general election on March 13, 2001, for the purpose of selecting three (3) City Council members; and WHEREAS, the City Council of the City of Sebastian, pursuant to Section 4.07 of the City Charter, adopted Resolution No. R -01 -01 on December 20, 2000, specifying Precincts 12, 14, 15 and 16 as the official polling places for the City of Sebastian for the general election, naming the offices to be filled; and WHEREAS, the City Clerk of the City of Sebastian, pursuant to Section 100.021 and 100.342 of the Florida Statutes, has caused to be published notice of the general election on December 29, 2000, and January 5, 2001 in the Vero Beach Press Journal, a newspaper of general circulation; and WHEREAS, the City Clerk has posted notice of the general election on the official announcement board located at City Hall; and WHEREAS, Precincts 12, 14, 15 and 16 of the City of Sebastian, Indian River County, Florida, held a general election on March 13, 2001; and WHEREAS, the City Canvassing Board has verified said returns and has found the same in proper form. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, that: SECTION 1. DECLARATION. Since this is my first election I asked him to allow me to check it out and get back to him. I contacted the State of Florida Division of Elections and spoke to Connie Evans. She was quite helpful and advised me of the following: A candidate may use campaign funds for food for a party or function related to a campaign as long as the funds are obligated prior to the candidate becoming elected, unopposed or eliminated. This means that a candidate could hold a function now or even after the election as long as the funds are obligated prior to the candidate becoming elected, unopposed or eliminated, in this case the order was placed for the food prior to the outcome of the election. For many years this office has advised candidates that they must expend campaign funds by the time they submit their 41h day campaign report (in this case March 91h). Connie advised me that this is not the case. Again, funds may be expended up until the candidate becomes elected, unopposed or eliminated and any funds obligated prior to that day may also be paid out of campaign funds. After the candidate becomes elected, unopposed or eliminated, all funds not obligated for some campaign expense are considered surplus and there are very specific provisions for disposition of surplus funds. (See 106.041) So, our schedule is: No contributions can be received after midnight Thursday night, March 8, 2001. (a) If the city is not holding its election as a part of the election for Indian River County, Florida, the city clerk shall appoint a city canvassing board to be composed of three (3) individuals; one (1) member shall be the city clerk, one (1) membershall be the city attorney, and the remaining member shall be appointed by the city clerk. The city clerk shall act as chairperson of the city canvassing board. (b) When a city canvassing board has been constituted, the city canvassing board shall meet at a place and time designated by the chairperson, as soon as practicable after the close of the polls of any municipal election involving the city, at which time, the city canvassing board shall proceed to publicly canvass the absentee electors' ballots and then publicly canvass the vote as shown by the returns then on file in the office of the supervisor of elections for Indian River County, Florida. The city canvassing board shall prepare and sign a certificate containing the total number of votes cast for each person or other measure voted on. The certificate shall be placed on file with the city clerk. (c) The city council shall hold a special meeting on the first Monday following the election for the purpose of receiving the certificate of the county canvassing board of the returns for Indian River County, Florida, or the city canvassing board, as the case may be. The city council shall then declare the results of the election and enter them into the minutes of the special meeting. Any oath of office required to be administered to the newly elected council members shall be administered at such special city council meeting where the newly elected council members are in attendance. The above Charter language was approved last year to include the City Attorney as a permanent member of the canvassing board. For the past several years, when the county was not conducting an election, the City canvassing board was made up of the City Clerk, Deputy City Clerk, and one seated City Council member whose term was not expiring. I have spoken to the Supervisor of Elections' office and have been advised that the deadline has passed for referendum by petition, therefore it looks like only the municipalities will be having elections on March 13, 2001. Since there are no specific provisions for the third member in the Charter, and to avoid having to choose one elected official over another, I have requested the other Charter Officer, the City Manager, to be the third member of the City Canvassing Board. FINANCIAL DISCLOSURE CHANGES:I Effective on June 7, 2000, all persons who have been required to file either the full financial disclosure (Form 6) or the limited financial disclosure (Form 1) must file a final disclosure statement within 60 days of leaving their public office or employment position, with the statement covering the period between January 1 st and their last day of office or employment. The agency head of each person who must file a final disclosure statement is required to notify such persons and may designate someone to be responsible for the notification requirements. The Commission is promulgating forms for the final disclosure filing; copies should be available at the Commission's website beginning in November, 2000. Beginning in 2001, persons who do not file their annual disclosure form (either Form 6 or Form 1) by September 1st will be subject to automatic fines of $25 for each late day, up to a cap of $1,500. Modeled after the automatic fine system in place for campaign finance reports, the Ethics Commission will hear appeals and have the power to waive fines under limited circumstances. Of major significance to cities and counties, the Legislature revamped the list of which local appointed board members must file. Beginning January 1 st, only certain types of local boards are covered by the State law, but local governments will have the authority to require other boards to file, as a "local option." The Legislature also changed the way some assets and liabilities are reported on full financial disclosure (Form 6), as well as the thresholds for reporting interests on the limited disclosure (Form 1). Finally, full financial disclosure forms (Form 6) and the limited disclosure forms (Form 1) of state officers and specified state employees will be filed with the Ethics Commission rather than with the Secretary of State. The Commission also will adopt rules and forms to allow officials to amend their disclosure forms. The deadline for filing the quarterly client disclosures of clients represented before agencies at one's level of government will change to match the quarterly gift reporting dates. GIFT LAW CHANGES:u The State's gift law applicable to persons who must file financial disclosure (either the Form 6 or Form 1) and to State employees who are involved in procurement was amended to specifically apply to candidates for elective office (since they are required to file disclosure statements when they qualify) and persons who are elected to office, but haven't yet assumed their office. Judges of Compensation Claims will file their gift disclosures, made pursuant to the judicial cannons, with the Ethics Commission. Another change is that payment for a gift must be made within 90 days of receiving the gift in order to avoid the law's prohibitions and disclosure requirements. A promise to pay for a gift will not be http: / /www. ethics. state.fLus /new%20law%2O2000.htm 12/1/00 Page 2 of 2 sufficient to avoid gift law consequences unless the promise is in writing and enforceable. The Technological Research and Development Authority was added to the list of agencies that can give gifts worth over $100, so long as a public purpose is shown, with disclosure being required by the donee on Form 10. Finally, gift law related disclosure forms (Form 30, Form 10, Form 9) that previously were filed with the Secretary of State should be filed with the Ethics Commission, beginning on January 1, 2001. EXECUTIVE BRANCH LOBBYIST REGISTRATION LAW CHANGES:W Persons who represent local government agencies (as well as private entities) may have to register prior to representing that agency before entities of the Executive Branch of State government. Previously, each lobbyist had to file an expenditure report after each calendar quarter; now, expenditure reports cover six -month periods and are filed semi - annually, rather than quarterly. The fine for late reports continues to accrue at $50 per day, but now is capped at $5,000 per late report. Florida Statutes 97.021 (3), defines a candidate as a person to whom any one or more of the following applies: 1. Seeks to qualify for nomination or election by means of the petitioning process. 2. Seeks to qualify for election as a write -in candidate. 3. Receives contributions or makes expenditure, or gives consent for any other person to receive contributions or make expenditures, with a view to bringing about his or her nomination or election to, or retention in, public office. 4. Appoints a campaign treasurer and designates a primary depository. 5. Files qualifying papers and subscribes to a candidate's oath as required by law. Who Can be a Candidate? City Charter 2.02 Eligibility states, "No person shall be eligible to hold the office of council member unless he or she is a qualified elector in the city and actually continually resided in the city for a period of one (1) year immediately preceding the final date for qualification as a candidate for said office." Person must not be holding another elective or appointive office, whether state, county, or municipal, the term of which, or any part thereof, runs concurrently with each other, without resigning from the office he or she presently hold. (See FS 99.012 for further provision) 3. Code of Ordinances Sec. 2 -167 states, "No member of any city board or committee shall become a candidate for elective political office during his or her term. A letter of resignation shall be tendered to the office of city clerk at least ten days prior to the first day of qualifying for the office he or she intends to seek. Should any member of a city board or committee qualify as a candidate for political office, such qualification shall be deemed a tender of immediate resignation from such board or committee. No person shall serve on more than one city board or permanent committee simultaneously." When May I Announce My Candidacy? You may discuss your candidacy at any time; however, you are considered an "announced" candidate when your qualifying officer (City Clerk) receives your Appointment of Campaign Treasurer and Designation of Campaign Depository - Form DS -DE9. You need to file this form before you accept any campaign contributions or make any campaign expenditures (including your qualifying fee). This form shows: a. Your name, address and phone number b. Office sought C. Name, address and telephone number of your campaign treasurer d. Name and address of your campaign depository (bank, savings and loan association, or credit union) e. Signature of candidate and date. f. Signature of campaign treasurer, indicating acceptance of appointment and date. 2. The report must include any activity from the date the account was opened through December 31, 2000. FLORIDA LAW PROVIDES FOR FINES AND PENALTIES FOR VIOLATIONS OF CAMPAIGN FINANCING RESTRICTIONS. 5 POLITICAL ADVERTISING (Political signs do not require a permit but must comply with the following provisions) City of Sebastian Land Development Code Section 54- 3- 16.5.E.4. provides regulations for Political Signs as follows: 4. Political Signs. a. General. Political signs shall not be posted on or over any public property or right -of- way. b. Political signs in residential districts. Political signs in residential districts are allowed subject to the following provisions: (1) No sign shall exceed sixteen (16) square feet; (2) No sign shall be illuminated; (3) Each sign shall be freestanding; (4) Each sign shall be located wholly on private property; (5) Each sign shall be placed at least (5) feet from all rights -of -way and sidewalks; (6) No sign shall exceed five (5) feet in height; (7) No sign shall be placed on or attached to any tree or utility post. C. Political signs in nonresidential districts. Political signs in nonresidential districts are allowed subject to the following provisions: (1) No sign shall exceed twenty (20) square feet; (2) No sign shall be illuminated; (3) Each sign shall be freestanding; (4) Each sign shall be located wholly on private property; (5) Each sign shall be placed at least (5) feet from all rights -of -way and sidewalks; (6) No sign shall exceed ten (10) feet in height; (7) No sign shall be placed on or attached to any tree or utility post. d. Posting time limits. Its shall be unlawful for any person to post a political sign more than thirty (30) days prior to the election in which the candidate's name or the issue will appear, and it shall be unlawful to fail to remove a political sign within five (5) days after the election in which the candidate is eliminated or elected or the issue is approved or disapproved. C'! e. Removal of illegal signs. The Code Enforcement Division shall order the immediate removal of any political signs found posted within the City in violation of this section. If the sign is not removed within two (2) days, the Code Enforcement Division shall remove the political sign. Fine. A fine of twenty-five dollars ($25.00) per sign may be imposed upon the person posting said sign or upon the candidate promoted on said sign for any of the following: (1) Failure to remove all signs within the applicable five -day period for removal; (2) Placement of signs upon public property or upon any tree, utility pole, or similar object. Prima fascia evidence. Political signs placed in violation of this section which advertise a particular candidate shall be prima facie evidence of the placement or authorization of the placement of the sign by the candidate. Reimbursement for removal expense. The candidate or the president of the committee supporting or opposing the ballot measure, as applicable, shall reimburse the City for any and all expenses of removal incurred by the City.
