This Deed is executed subject to taxes assessed for the year 1977
a and all subsequent years, conditions, limitations and Restrictions of
Record, and to the following express restriction to wit: That the
subject land shall be used only for recreational purposes.
This Deed is also executed subject to riparian and littoral rights
and the premises herein described being artificially filled land
in what was formerly navigable waters, it is subject to any and
all rights of the United States Government and of the State of Florida
arising by reason of the United States Government control over
navigable waters in the interests of navigation and commerce and the
inalienable rights of the State of Florida in lands and /or waters or
such character.

located in Edgewater Park SID, City of Sebastian,
Block 2, containing 0.65 acres, has been recorded
by the County. This land was given to the City of
Sebastian by General Development Corporation in May 1977.
we request this property be exempt from all tax for
the City of Sebastian.

Gentlemen:
We, at General Development Corporation, take great pleasure in tender-
ing to you the deeds to the Sebastian Highlands Yacht Club, and a check
in the amount of $4,431.00. While there were several proposals made
with reference to the long -range plans for the yacht club facility, we
believe that the most practical and beneficial plan with regard to the
facility is that which we have resolved with you, the Sebastian High -.
lands' Homeowners Association, and the Division of Florida Land Sales.
We feel certain that the people of the City of Sebastian and Sebastian
Highlands will benefit for many years to come as a result of the solution
we have reached.
You will note that we have provided you with a Warranty Deed and Quit -
Claim Deed. The Quit -Claim Deed is being provided since it relates to
property which General Development obtained by Quit -Claim Deed from the
Florida Trustees of the Internal Improvement Fund. General Development
affirmatively represents that it has good and marketable title to the
yacht club to convey to the City and will indemnify and hold the City
harmless from any defects in title which may exist up to the date of the
conveyance.
General Development is tendering the check in the amount of $4,431.00
with the understanding that these monies will be placed in an interest
bearing trust account and will be utilized in the future for the purpose
of reconstructing a pier at the Sebastian Highlands Yacht Club. These
monies represent one -third of a cost estimate, submitted by Dock Masters
Marine Construction of Fort Pierce, Florida, which was submitted on
April 11, 1977 to General Development Corporation for the reconstruction
of a pier at the Sebastian Highlands Yacht Club. If in the future the
City of Sebastian is able to obtain funds from state or federal sources
to reconstruct the pier, then General Development would be refunded the
unused portion of its one -third contribution. Yet, General Development
shall not be responsible for any monies greater than the $4,431.00 which
it now tenders to the City of Sebastian for the purpose of reconstructing
the pier.
