AN ORDINANCE AMENDING ORDINANCE 0-81-8A, THE WATER
DISTRIBUTION SYSTEM FRANCHISE ORDINANCE HELD BY
GENERAL DEVELOPMENT UTILITIES BY INCREASING RATES
FOR WATER SERVICE; PROVIDING A SERVABILITY CLAUSE;
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City of Sebastian authorized General Development
Utilities to provide water service to a portion of the City on
May 11, 1981; and
WHEREAS, tile rate schedule for residential and general
water service was adopted without change from the previous fran-
chise ordinance which was originally adopted in 1959 and last
amended by Ordinance.No. 0-81-8A on July 7, 1982, and;
WHEREAS, General Development Utilities, Inc., has sub-
mitted to the City a request for a rate increase, and provided
to the City substantial documentation to support said request;
and
WHEREAS, the Council of the City of Sebastian after care-
ful review and analysis of said request, and public hearings,
has determined that a rate increase is justifiable; and
WHEREAS, tile Council has found and determined what a
just, reasonable, compensatory and not unfairly discriminatory
rate for water service is to be.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF SEBASTIAN, FLORIDA:
SECTION I
That the rates set out the,Tariff-Water, adopted by ordinance
0-81-8A on July 7,1982, is hereby amended and the following new
rates are adopted as follows:

SECTION III
That the "Service Availability and Main Extension Policy" attached hereto as
Exhibit "B" and consisting of pages Original Sheet No. ] through Origi~al Sheet
No. 12, is hereby adopted as part of this ordinance. This new policy supersedes
the prior policy adopted by Ordinance No. 0-83-17.
SECTION IV
That the "Tariff-Water" attached hereto as Exhibit "C" is hereby adopted.
SECTION V
This ordinance shall take effect on midnight of November 30, 1986. This
ordinance does not amend Chapter 27 of the Code of Ordinances.
I HEREBY CERTIFY that the foregoing Ordinance was finally passed by the
City Council of the City of Sebastian, Florida, on the /~/~ day of November, 1986.

1.0 GENERAL POLICY
General Development Utilities, Inc., a Florida Corporation, here-
inafter referred to as Utility, adopts the following Service
Availability and Main Extension Policy. Utility will make
service and extensions of service available under this Policy
subject to matters of economic feasibility. This Policy shall
not apply to developer agreements entered into between Utility
and contributors which reflect policies implemented and contracts
entered into prior to the adoption of this Policy.
2.0 AVAILABILITY
The provisions of the Policy are available to contributors through-
out the territory subject only to matters of economic feasibility.
For Rules governing service outside the territory, see Paragraph
15.0 of this Policy.
3.0 MAIN EXTENSION AND CONNECTION (PI~NT CAPACITY) CHARGES
The following is t'he charge being made by Utility to coptributors
(including the Parent Company) upon approval of the Ci~ Council
where water or sewer service is available, or agreed ~be made
available, in the territory. "On-Site" or "Off-Site" water
distribution and sewage collection lines and facilities are
included in these charges and provisions.
Charges to contributors pursuant to this Policy are calculated On a
cost based upon the estimated demand of the contributor's proposed
installation upon the transmission and treatment facilities of the
Utility, and is computed by multiplying the following rates by the
daily rated gallons of demand set forth in Exhibit A, as modified by
Paragraph 6.0 of this Policy.
Connection (plant capacity) charges are stated per gallon demand for
water and sewer service.

front of the property to be served.

Main extension charges for service to customers outside Utility's
certificated service area will be negotiated.
(a) Such customers may be required to advance the full cost of
on-site and off-site mains, subject to refund of portions thereof in
excess of the contributor's hydraulic share.
(b) In addition to payment of the above, connection (plant
capacity) charges will be required to support excess plant capacity
dedicated to the contributor.
4.0 GALLONS PER DAY, WATER & SEWER DEMAND CHARACTERISTICS
Listed in Exhibit A (attached hereto) are daily rated gallons of
demand for various occupancies which will be used in computing
Connection (plant capacity) and Main Extension Charge~ In the
instance of common facilities for multiple dwelling u~ts such as
irrigation, laundering, recreation facilities, and commercial and
commercial/residential facilities, determination of connection
(plant capacity) and main extension charges will be based upon the
use characteristic defined by engineering data supplied by the
prospective contributor, as accepted by Utility.
5.0 PREPARATION OF DEVELOPER AGREEMENTS
Utility may require that the contributor, in addition to the fees
and charges set forth herein, bear the cost of preparation of devel-
oper agreement by independent counsel or persons qualified to draft
and prepare such agreements. Said charges shall not exceed that
amount normally to be contemplated for such service.
6.0 WATER AND SEWER CAPACITY ALLOCATIONS
Upon payment by the contributor and its proper execution of an
agreement for service availability pursuant to these rules, Utility
will reserve and will allocated to the contributor the portion of
water and sewer plant and off-site line capacity as set forth in the
agreement. If, for example, the contributor shall calculate demand
of 350 gallons of water per day per single-family residence, that
capacity will be built or reserved for the contributor. Utility
will not be obligated to provide capacity or service in excess of

that allocation and may require consumers to curtail use which
exceeds such allocated capacity.
In those areas where the experience of Utility has demonstrated that
the demand characteristics of customers of the community exceed
those daily rated gallons of demand set forth in Exhibit A, Utility
shall require that the contributor pay those fees and make the
necessary commitments based on the actual and experienced demand,
and not the average demand. Thus, when Utility shall demonstrate to
the developer that its records and experience show, for example,
that a single-family residence of the type which the contributor
proposed to build in the specific community places demand during
certain times of the year equal to 600 gallons of water per day,
then the charges per gallon demand set forth in Paragraph 3.0 of
this Policy shall be multiplied by 600 gallons. In no event shall
Utility be required to build or accept plans, specifications, fees,
charges or agreements predicated upon demand for water service of
less than 350 gallons per single~family residential equivalent or
sewer service or less than 250 gallons per residential equivalent
per day.
7.0 WATER SERVICE ONLY-SEWER SERVICE ONLY

in any instance where either water or sewer service only is
furnished without the companion service, then the connection (plant
capacity) charge shall be computed for that service o~y.

Utility will not be obligated to furnish water in excess of "Maximum
Water Use Demand." Recommended Maximum Rate for continuous opera-
tion will be 1/3 of the Maximum Rate listed.
Meters of two inches in size are charged upon the estimated actual
cost of installation. Where actual charges differ from estimates,
the difference will be refunded by Utility if the total cost was
less than the estimate, or paid by the contributor prior to
initiation of water service if the actual cost exceeds the estimated
cost. The contributor will be furnished a copy of the invoice at
the time of installation.
9.0 ACTION BY GOVERNMENTAL AUTItORiTY
Requirements by appropriate governmental authorities to limit or
curtail utility services, such as irrigation moratoriums, may re-

strict the use of utility service in addition to the maximum water
use demand set forth in Paragraph 8.0 of this Policy. Contributors
and customers obtain reservation for service or the service :itself
subject to notice of this limitation.
10.0 TRANSFER OF CONTRIBUTED PROPERTY-BILLS OF SALE
Utility reserves the right to construct all facilities for providing
water and sewer service to the point of connection. If Utility
determines that it will accept such facilities constructed by
others, the following rules will apply.
Each contributor (developer) who has constructed portions of a water
distribution and sewage collection system shall convey such compon-
ent parts of the water distribution and sewage collection system to
Utility by bill of sale, in form satisfactory to Utiiity's attorney,
together with such evidence as may be required by Utility that the
water and/or sewer systems proposed to be transferred to Utility are
free of all liens and encumbrances.
Any facilities in the category of consumer's connections of the cus-
tomer's side of the connection point shall not be transferred to
Utility and shall remain the property of individual customers, their
successors or assigns.
Utility shall not be required to accept title to any component part
of the water distribution or sewage collection system until
Utiiity's engineer has approved the construction of sa~d lines,
accepted the tests to determine that such constructio~ is in accor-
dance with the criteria established by Utility, and t~reafter evi-
denced its acceptance of such lines for Utility's ownership, opera-
tion, and maintenance.
Contributor shall maintain accurate cost records establishing the
construction costs of all utility facilities constructed by con-
tributor. Such cost infor~ation shall be furnished to Utility
concurrently with the bill of sale, and such cost information shall
be a prerequisite for the acceptance by Utility of the portion of
the water distribution and sewage collection system constructed by
the contributor.
Utility reserves the right to refuse connection and to deny the
commencement of service to any contributor seeking to be connected
to portions of the water distribution and sewage collection system
until such time as the provisions of this section have been fully
met.
With respect to a development which constitutes a "single unit" such
as a mobile home park, a shopping center, or apartment complex,
Utility's obligation for service and maintenance of lines and faci-
lities located wholly within such developments, and not in public

rights of way, shall extend solely to repair and/or replace the
lines or facilities, and the Utility will not be liable in any
manner for damages, replacement or repairs to surface areas.
li.O INSPECTION FEES
Any engineering plans or designs for, or construction of facilities
by a contributor (developer) which are to become a part of Utiltty's
system, will be subject to review and inspection by the Utility. For
this service, Utility may charge an inspection fee based upon the
actual cost to Utility of inspection of facilities constructed by
contributors or independent contractors for connection with the fac-
ilities of Utility. Such inspection fee shall be paid by the con-
tributor in addition to all other charges above stated, as a condi-
tion precedent to service.
12.0 INSPECTION OF PLUMBER'S HOOK-UP
It shall be the responsibility of the contributor or its plumbing
contractor to connect contributor's plumbing installation with the
water or sewer system. Utility reserves the right to inspect ail
such connections to be assured that the same are properly made in
accordance with Utility's rules governing such connections, and that
the connection, as made, is free from infiltration.
The contributor shall notify Utility of any proposed lnterconnection
with the facilities of Utility, and connection may be made without
the presence of Uttlity's inspector. However, such connection shall
remain open until inspection by Utility and until notice of the
approval of such connection is furnished to the developer in
accordance with the practices and procedures of Utility. Any
connection covered without the benefit of inspection will result in
the contributor being required to reopen the connection for
subsequent inspection. If Utility fails to inspect the connection
w~thin 48 hours after notice that the same is ready to inspect, the
connection shall be deemed approved by Utility.
13.0 ADJUSTMENT PROVISIONS
Governmental Authority: The charges set forth in this Policy are
subject to adjustment by appropriate action of the governmental
agency having jurisdiction of this Policy, either upon the
initiative of the governmental agency or by request of Utility.
14.0 PRIOR POLICY
Prior to the adoption of this Policy, Utility had, by virtue of its
obligations, established other policies which will remain in effect
until the obligations pursuant to those policies have been
fulfilled. Under a previous program, Utility constructs water

facilities at its own cost covering approximately 1229 lots to which
water service would be extended by Utility within sixty days after
the building permit has been obtained and notification of commence-
ment of construction has been given to Utility. The cost of such
water facilities is to be borne solely by Utility as an investment.
The only charge to the customer would be a meter installation fee.
Utility made a commitment to provide sewer service to approximately
1229 lots, and facilities will be installed as an investment of
Utility to those lots. These commitments by Utility were based
upon contracts made in the past and are nQt available to prospect-
rive customers or contributors. A list showing the lots to which
service will be made available, as an investment by Utility, is
available in Utility's office, and may be examined by any customer
or prospective customer during the regular business hours of
Utility's office.
15.0 EXTENSION OUTSIDE TERRITORY
Providing service outside Utility's territory may involve formal
notice and formal proceedings before the Board of City
Commissioners and, therefore, entail engineering, administrative and
legal expenses in addition to costs incurred by Utility in providing
service within its territory. Utility will, therefore, not be
obligated to provide its services outside the territory unless the
contributor agrees, in advance, to defray those additional expenses
and pay to Utility the estimated costs thereof. The advance payment
will be adjusted to conform with actual expenses after the
proceedings have been concluded. Utility will further make such
extensions outside the territory only if the net income to be
derived from prospective consumers within the area to be served by
the proposed extension will provide a fair return on Utility's
investment in the proposed extension, transmission, and treatment
facilities involved. Utility will not extend its facilities under
circumstances where the extensions will cause service to existing
customers to suffer either as a result of reduction of capacity to
provide its service to customers, or the diminishment of the
economic capability of Utility to meet its financial commitments.
16.0 DISTRIBUTION AND .COLLECTION SYSTEMS CONSTRUCTION
If any on-site distribution and collection systems are constructed
by the contributor as set forth in Paragraph 10.0 herein, Utility
shall establish specifications based upon good engineering and
public utility practices, and the contributor shall, not less than
sixty (60) days prior to commencing construction, furnish Utility
with a complete copy of the plans and specifications of the proposed
on-site collection and distribution system. Utility shall have
thirty (30) days in which to determine the acceptability of the
plans and specifications furnished to it by the contributor. If the

Utility shall object to the plans and specifications or any part
thereof, the contributor shall defer the commencement of construction
pending the resolution of Utility's objections.
17.0 INSPECTIONS
Utility shall have, at all times during the construction, the right
to inspect the construction of the on-site distribution and/or coll-
ection systems being built by the contributor, or his agents or em-
ployees, as set forth in Paragraph 11.0 of this Policy and receive
payment of fees referred to herein.
18.0 REFUNDABLE ADVANCES
In addition to the charges set forth herein, Utility will require a
refundable advance by a contributor to temporarily defray the cost
of any off-site extension of water and/or sewer mains, pumping
stations, and other facilities necessary to provide service to the
contributor's property unless, at the time of the request for
service, Utility determines that extension to provide such service
is economically justified or is appropriate to improve symtem
reliability or enhance the quality of service to existing
customers. The amount of the refundable advance will be bamed on
the cost of the off-site mains and other facilities. Such
facilities shall be designed and constructed in accordance with
Utility'$ master plan for service to the immediate surrounding
area. Charges paid by the contributor over and above the
contributor'8 hydraulic share of the facilities shall be refunded
to the contributor in accordance with the terms and conditions of a
refunding agreement which Utility will execute with the
contributor. The refund agreement will provide for a plan of
refund bamed upon connection of other properties that will be
served by the facilities to the extent of their hydraulic share.
The contributor shall bear the reasonable expense of preparing the
refund agreement. Notwithstanding the provisions of this Section,
the life of the refund agreement shall be seven years, after which
time the balance of the refund not made to the contributor by the
terms and conditions of the refund agreement will be retained by
Utility, and such refund agreement will be cancelled. In no event
shall a contributor recover an amount greater than the difference
between the capitalized cost of such improvements and the
contributor's own hydraulic share of such improvements. Utility
will not include any interest upon the refund of the contributor's
advance.
19.0 GUARANTEED REVENUE AGREEMENT
Utility may establish a policy of requiring, as a condition prece-
dent to service, that the contributor (developer) enter into a guar-
anteed revenue agreement.

20.0 RESERVE CAPACITY CHARGE
Utility may enter ~nto an agreement with a contributor requiring
contributor to pay a minimum guaranteed connection charge. If
contributor wishes to insure that there will be available sufficient
plant capacity at various planned stages of development and, if
Utility agrees to reserve such capacity for contributor, the con-
tributor will be required to pay applicable fixed costs including
depreciation, property tax, insurance and interest costs on plant
capacity reserved for the period of the reservation.

21.0 Carrying co~t Recovery Charge
Until the Company is providing service to 1,031 equivalent
residential water connections and 1,119 equivalent residential
sewer connections, all applications for service at a new location
shall pay, in addition to other charges as outlined in this policy,
a CCRC charge based on the number of equivalent residential
connections (1ERC = 5/8" X 3/4" Residential Meter) as set forth in
the table below:

"Consumer": Any person, firm, association, corporation,
govsrnmental assncy or similar organization supplied wt~h waist
service by =he Company.
3.0
"Service": Service, as mentioned in this Tariff and in asrssment
with Consumers, shall be construed to include, in addition to all
water service required by the Consumer, the readiness and ability on
the part of the Company to furnish water service to the Consumer.
Thus, the maintenance by the Company of pressure at the point of
delivery upon request shall constitute-the rendering of water ser-
vice, irrespective of whether Consumer makes any usa thereof.
4.0
"Consumer's Installation": All pipes, shutoffs, valves,~lXtures
and appliances or apparatus of every kind and naturs used in con-
nection with or forming a part of an installation for u~ill~lng
water for any purpose, ordinarily located on the Consumsrts aids of
point of delivery, whether such installation is owned outri~h~ by
Consumer, or used by Consumer under lease or otherwise.
5.0 "Point of Delivery',: The point where the Company's pipes or meters
are connected with pipes of the Consumer.
6.0
"Main": Shall refer to a pipe, conduit, or other facility installed
to convey water service to individual service lines or to other
Ma/ns.
"Service Lines": The pipes of the Company which are connected from
the ma/ns to point of delivery.
8.0 "Rate Schedule": Refers to rate or charge'for the particular
classification of service.
9.0 "Commission": Refers to the City Commission, City of Sebastian.

RULES AND P~GULATiONS
1.0
General Information: The Companyts Rules and Regulations, insofar
as they are Inconsistent with any statute, ordinance, law, or legis-
lation now in effect, shall be null and void. These Rules and Rag-
ulations are a part of the rate schedules, applications and
contracts of the Company, and in the absenc~ of specific wrl:ten
agreement to the contrary, they apply without modifications or
change to each aud every Consumer to whom the Company renders water
service.
In the event that a portion of these Rules and Regulations is de-
clared unconstitutional or void for any reason by any court of
competent jurisdiction, such decision shall in no way affect the
validity of the remaining portions of the Rules and R~gulatione for
water service unless such court order or dec/sion shall so direct.
2.0
Water Service: To obtain water service, application should be made
at the of£ice of the Company. Applications are accepted by the
Company with the understanding that there is no obligation on the
part of the Company to render water service other than that which is
then available from its existing water production and distribution
equipment and service lines. *
The applicant shall furnish co the Company the correct name, street
address, and lot and block number at which water service is to be
rendered.
3.0
Signed Application Necessary: Water service is furnished only upon
signed application or agreement accepted by the Company and the
conditions of such application or agreement are binding upon the
Consumer as well as upon the Company. A copy of each application or
agreement for water service accepted by the Company will be
furnished to the applicant on request.
4.0 Application by:Age~ts: Applications for water service requested
by firms, partnerships, associations, corporations, and others,
shall be tendered only by duly authorized parties. When water
service is rendered under agreement or agreements entered into be-
tween the Company and an agent of the principal, the use of such
water service by the principal shall constitute full and complete
ratification by the principal of the agreement or agreements entered
into between agents and the Company and under which such water
service is rendered.
5.0 Withholding Service: The Company may withhold or diacon£inue water
service rendered under application made by any member or agent

of a family, household, organization, or business unless all prior
indebtedness to the Company of such family, household, organization,
or business for water service has been settled in full.
Extensions: The Company will make such extensions to its ex/sting
facilities as may be required by one or more Consumers provided the
revenues to be derived therefrom shall be sufficient to afford fair
and reasonable return on the cost of providing and rendering the
water service. Otherwise, the Company will require from the
Consumer prepayments, cash advances, minimum ~uaranteess service
guarantees, contributions in aid of construction, or other arranie-
meets with the Consumer, whereby the Company will bi enabled to earn
a fair'and reasonable return on the cost of providing and rlndtring
the required service.

Limitation of Use: Water service purchased from the Company shall
be used by the Consumer only for the purposes spec/f/ad in the
application for water service and the Consumer shall not sell or
otherwise dispose of such water service supplied by the Company.
Water service furnished to the Consumer shall be rendered directly
to the Consumer through Company*s individual meter and shall be for
Consumer's own use and may not be remetered by the Consumer for the
purpose of selling or otherwise disposing of water service Co
lessees, tenants, or others; and under no circumstances shall the
Consumer or Consumer's agent or any other individual, association,
or corporation install meters for the purpose of so remetering said
water service. In no case shall a Consumer, excepc with the written
consent of the Company, extend his lines across a street, alley,
lane, court, property line, avenue, or other way in order to furnish
water service for adjacent propercy through one meter, even though
such adjacent property be owned by him. In case of such una~thor-
lzed extension, remeterlng, sale, or disposition of service, Con-
sumer's water service is subject to discontinuance until such un-
author/zed extension, remetering, sale or disposition is
discontinued and full payment is made of bills for wat&r service,
calculated ou proper classification and rata schedules and
reimbursement in full made to the Company for all extra expanses
incurred for clerical work, testing and inspections.
Continuity of Service: The Company will aC all c/ames usa reasonable

able diligence, shall nec be liable to the Consumer for failure or
interruption of continuous water service. The Company shall not be
liable for any act or omission caused directly or indirectly by
strikes, labor troubles, accident, litigations, breakdowns,
shutdowns for repairs or adjustments, acts of sabotage, enemies of
the United States, wars, United States, state, municipal or other

governmentel interference, acts of God or other ceueee ~yond its
control.
9.0 ~Xpe and Maintenance: The Consumer's pipes, apparatus~ and equip-
ment shall be selected, installed, used and malntalned~ln accordance
with the standard practice, conforming with the Rules end
Regulations of the Company, and in full compliance with all laws'and
governmental regulations applicable to same. The Consumer agrees
further to keep all pipes, valves, plumbing and f/xtures in repair
and to promptly stop all leaks on his premises, and the Company
shall not be responsible for their maintenance and operation. The
Consumer expressly agrees not to utilize any appliance or device
which is not properly constructed, controlled and protected, or
which may adversely a£fect the water service; end the Company
reserves the rlihc to discontinue or withhold waist eerwice Co such
apparatus or device.
10.0 Change of Consumer's Installation: No changes or increases in
c°nsu~er'~'l~st~llatton, which will materially affect the proper
operation of the pipes, mains, or stations of the Company shall be
made without written consent of the Company. The Consumer will be
liable for any change resulting from a violation of this rule.
11.0 inspection of Consumer's inst-llatlon: All Consumers' water service
installations or changes shall be inspected upon completion by
competent authority to insure that Consumer's p/ping, equipment, and
devices have been installed in accordance with accepted standard
practice and such local governmental or other rules as may be in
effect. Where municipal or other governmental inspection is
required by local rules or ordinances, the Company cannot render
water service until such inspection has been made and formal notice
of approval from the inspecting authority has been received by the
Company.
The Company reserves the right to inspect Consumer's installation
prior co rendering water service and from time to time thereafter,
but assumes no responsibility whatsoever for any portion thereof.
12.0 Protection of Company's Property: The Consumer shall properly pro-
tect the Company's property on the Consumer's premises, and shall
permit no one but the Company's agents, or persons authorized by
law, to have access co the Company's pipes and apparatus.
In the event of any loss or damage to property of the Company caused
by or arising out of carelessness, neglect or misuse by the
Consumer, the cost of making good such loss or repair/ag such d~$e
shall be paid by the Consumer.

13.0 Access to Premises: The duly authorized agents of the Company shall
have access at all reasonable hours to the premises of the Consumer
for the purpose of installing, maintaining and inspecting or remov-
ing Company's property, reading meters, and other purposes incident
to performance under or termination of the Company's agreement with
the Consumer, and in such performance shall not be liable for tree-
pass.
14.0 Right 9f ~ay or Easements: The Consumer shall grant or cause Co be
granted to the.Company and without coat Co the Company ail.rights,
easements, permits, and privileges which in its opinion are
necessary for the rendering of water service.
15.0 Billing Periods: Bills for water service will be rendered monthly.
Bills are due when rendered and shall be considered aa received by
Consumer when delivered or malled to water service address or some
~r_her place mutually agreed upon.
Nonreceipt of bills by Consumers shall not release or diminish
obligation of Consumer with respect to payment thereof.
16.0 Delinquent Bills: Bills are due when rendered, and if not paid
within twenty days thereafter become delinquent, and water service
may then, after five days WRITTEN NOTICE, be discontinued. Service
will be resumed only upon payment of ell past due bills and
penalties, together with a reconnect charge of ~20.00 when performed
during regular working hours. After regular working hours, the
reconnection charge will be $24.00. There shall be no liability of
any kind against the Company by reason of discontinuance of water
service to the Consumer for failure of the Consumer Co pay the bills
on time.
No partial payment of any bill rendered will be accepted by the
Company, except by agreement with the Company, or by order of the
governing body.
17.0 Reimbursement for Extra Expe.gses: The Consumer shall reimburse the
Company for all extra expenses (such as for special trips, inspec-
tions, additional clerical expenses, etc.) incurred by ~e Company
on account of the Consumer's violation of the contract for service
or of the Company's rules and regulations.
18.0 Payment of Water and Sawer Service Bills Concurrently: When both
water and sewer service are provided by the Company, payment of any
water service bill rendered by the Company to a water service Con-
sumer shall not be accepted by the Company without the simultaneous
or concurrent payment of any sewer service bill rendered by the
Company. If the charges for water service are not so paid, the

Company may discontinue both sewer service and water service to the
Consumer's premises for nonpayment of the water service charges or,
if the charges for sewer service are noc so paid, the Company may
diBconCinue both water service and sewer service to the Consumer's
premises for nonpayment of the sewer service or water service or
either of such services until such time as all sawer esL-vice charses
and water service charges and all other expenses or char&es
established or provided for by these Rules and Regulations are paid.
19.0 Temporary Discontinuance of Service: At any time that water service
is not being furnished to the premises, as confirmed by the Company
furnishing said water service, upon application to the Company by
the Consumer for a temporary shutoff, billing for water service to
the premises will be continued at the Base Facility Charge.
20.0 Tax Clause: Rates and/or charges may be increased or a surchar&e
added In the amount of the applicable proportionate part of any
taxes and assessments imposed by any governmental authority In
excess of those in effect which are assessed on the basis of meters
or customers or the price of, or revenues from, water sold.
21.0 Change o£ Occupancy: When change of occupancy takes place on any
premises supplied by the Company with water service, WRITTEN NOTICE
thereo£ shall be given at the o££1ce o£ the Company not less than
three days prior to the date o£ change by the outgoing Consumer, who
will be held responsible for all water service used on such premises
until such written notice is so received and the Company has had
reasonable time to discontinue water service. However, if such
written notice has not been received, the application of a
succeeding occupant for water service will automatically terminate
the prior account. Consumer's deposit may be transferred from one
service location to another, if both locations are supplied by the
Company. Consumer's deposit may NOT be transferred fromm one name to
another.
For the convenience of its Consumers, the Company will accept
telephone orders to discontinue or transfer water service and w~ll
use all reasonable diligence in the execution thereof. However,
oral orders or advice cannot be deemed binding or be considered
formal notification to the Company.
22.0 Unauthorized Connections-Water: Connections to the Company's water
system for any purpose whatsoever are to be made only by employees
of the Company. Unauthorized connections render the service subject
to immediate discontinuance without notice and water service will
not be restored until such unauthorized connections have been
removed, and unless settlement ia made in full for all water service

estimated by the Company to have been used by reason of such
unauthorized connection.
23.0 Meters; All water meters shall be furnished by and remain the
property of the Company and shall be accessible to and subject to
its control. The Consumer shall Provide meter space ~o the Company
at a suitable and readily accessible location and when the Company
considers it ~advisable, within the premises to be served, amd should
be of adequate and proper space for the installation of meters and
other similar.devices.
24.0 All Water Through Meter: That portion of the Consumer's installa-
tion for water service shall be so arranged that all water service
shall pass through the meter. No temporary pipes, nipples, or
spacers are permitted and under no circumstances are connectione
allowed which may permit water to bypass the meter of ~etertng
equipment.
25.0 Adjustment i
of Bills: When a customer has been overcharged or under-
charged aa a res~t of incorrect application of the rata schedules,
incorrect reading of the meter, incorrect connection of the meter,
or other similar reasons, the amount may be credited or billed to
the Consumer, as the case may be.
26.0 Customer Deposit: Before rendering service, the Company will re-
quire a deposit or guarantee satisfactory to the Company to secure
the payment of bills, and the Company shall give the customer a
mom-negotiable and nontransferable deposit receipt. The amount of
such deposit shall be an amount necessary to cover charges for
service for three billing periods.

The Company will pay interest on customer's deposit at the rate of 8% per
anmum. The payment of interest will be made once a year as a credit on
regular bills, and on final bills when service is discontinued. No
Customer depositor will receive interest on his deposi~ until a~ least

six months continuous service, then interest will be paid from date of
the commencement of service.
Upon flnal settlement of customer's account or when customer's credit has
been established to the satisfaction of the Company, any unused balance
of the deposit will be refunded. Refunds are contingent upon surrender to
the Company of the applicable deposit receipt or, when the receipt cannot
· be produced, upon adequate identification.
27.0 Request for Hater Test by Cons,,mer: Should any customer request a
bench test of hie water meter, the Company will require a deposit
to defray cost of testing, such deposit not to exceed the followinS

If meter is found to register in excess of the accuracy i/mits pre-
scribed by the Commission, the deposit will be refunded; but, if
below such accuracy limit, the deposit will be rets/ned by the
Company as a service charse for conductlns thi test.
Further, upon written request of any customer, the Company shall,
without charge, make a field test of the accuracy of the water meter
in use at customer's premises, provided that the meter has not been
tested within the past twelve months. This rule in no way conflicts
with Commission Rule 310-10.80.
28.0 Adjustment of Bills for Meter Error: In meter tests made at the re-
quest of £he customer, the accuracy of registration of the meter and
its performance in service shall be Judged by ica average error. The
average meter error shall be considered to be the average of the
errors at the test rate flows.
F~ast ~eters - Whenever a meter tested is found to register fast, in
excess of the tolerance provided in the Meter Accuracy Requirements
provision herein, the utility shall refund to the customer the
amount billed in error for one-half the period not to exceed
months except that if it can be shown that the error was due to some
cause, the date of which can be fixed, the overcharge shall be
computed back £o but not beyond such date. The refund shall not
include any part of any minimum charge.
Slow Meters - Whenever a meter tested ia found to resister slow~ in

provision herein, the utility may bill the customer an amount equal
to the unbllled error for one-half the period since the last test;
said one-half period not to exceed six months, except that if it can
be shown Chat the error was due to some cause, the date of' which can
be fixed, the charge may be computed back to but Dot beyond such
date and provided further that if the utility has required a
deposit, the customer may be billed only for that portion of the
unbilled error which is in excess of the deposit retaimed by the
utility.
In the event of a nonregister meter, customer may be billed on an
est/mate based on previous bills for similar usage, such estimate co
apply only to the current billing.
In the event of unauchorizsd use, the customer may be billed on a
reasonable eat/mace of the service taken. ~
Meter Accuracy Requirement~ - All meters used for measuring quantity
of water delivered to a customer shall be in good mechanical
condition and shall be adequate in size and design for the type of
service which they measure. Before being installed for the use of
any customer, every water meter, whether new, repaired, or removed
from service for any cause, shall be adjusted to register withi~ the
accuracy limits set forth in the following table:

delinquent if not paid within twenty days, and service may, after five
days written notice, be discontinued. ~
BillinK - Bills shall be rendered monthly and the meter reading dates
shall coincide as near as practically possible, and bills rendered as
soon as possible thereafter. Bills rendered for less than 50% of the
normal billing period will be billed in accordance with Rule 25-10.97(2),
Florida Administrative Code: "Whenever, for any reason, the period of'
service for which a bill.is rendered is less than fi~cy~ercent (50%) of
the normal billing period, the charges applicable to such service,
including minimum charges, shall be prorated in the proportion that the
actual number of service days bears to a thirty (30) day month; except
that:
(a) Opening bills need not be rendered but may be carried over to
and included in the next regular monthly billing.
(b) For service taken under flat rate schedules, fifty percent
(50%) of the normal charges may be applied.
(c) The practices employed by the utility in this regard shall have
uniform application to all customers."
Franchise Fee - Consumers residing within the L/mits of Sebastian
Highlands will be charged the franchise fee imposed by the City of
Sebastian Co the Company, with such fee being itemized on consumer's
monthly bill.
Reconnection Charges - On the initial turn-on of a new service or
account, th~re will be no charge. On reconnections due to other reasons,
there will be a reconnect/on charge of $20.00 for each request during
regular working hours. After regular working hours, the charge will be
$24.00. ~

"Consumer": Any person, firm, association, corporation,
governmental agency or similar organization supplied with water
service by the Company.

"Service": Service, as mentioned in this Tariff and in agreement
with Consumers, shall be construed to include, in addition to all
water service required by the Consumer, the readiness and ability on
the part of the Company to furnish water service to the Consumer.
Thus, the maintenance by the Company of pressure at The point of
delivery upon request shall constitute.the rendering of water ser-
vice, irrespective of whether Consumer makes any use thereof.
"Conmumer's Installation": All pipes, shutoffs, valves, fixtures
and appliances or apparatus of every kind and nature used in con-
nection with or forming a part of an installation for utilizing
water for any purpose, ordinarily located on the Consumer's side of
point of delivery, whether such installation is owned outright by
Consumer, or used by Consumer under lease or otherwise.
5.0 "Point of Deliver¥~l: The point where the Company's pipes or meters
are connected with pipes of the Consumer.
Shall refer to a pipe, conduit, or other facility installed

RULES AND REGULATIONS
General Information: The Company's Rules and Regulations, insofar
as they are inconsistent with any statute, ordinance, law, or legis-
lation now in effect, shall be null and void. These Rules and Reg-
ulations are a part of the rate schedules, applications and
contracts of the Company, and in the absence of specific written
agreement to the contrary, they apply without modifications or
change to each and every Consumer to whom the Company renders water
service.
In the event that a portion of these Rules and Regulations is de-
clared unconstitutional or void for any reason by any court of
competent jurisdiction, such decision shall in no way affect the
validity of the remaining portions of ~he Rules and Regulations for
water service unless such court order or decision shall so direct.
Water Service: To obtain water service, application should be made
at the office of the Company. Applications are accepted by the
Company with the understanding that there is no obligation on the
part of the Company to render water service other than that which is
then available from its existing water production and distribution
equipment and service lines.
The applicant shall furnish to the Company the correct name, street
address, and lot and block number at which water service is to be
rendered.
Signed Application Necessary: Water service is furnished only upon
signed application or agreement accepted by the Company and the
conditions of such application or agreement are binding upon the
Consumer as well as upon the Company. A copy of each application or
agreement for water service accepted by the Company will be
furnished to the applicant on request.
Application by Agents: Applications for water service requested
by firms, partnerships, associations, corporations, and others,
shall be tendered only by duly authorized parties. When water
service is rendered under agreement or agreements entered into be-
tween the Company and an agent of the principal, the use of such
water service by the principal shall constitute full and complete
ratification by the principal of the agreement or agreements entered
into between agents and the Company and under which such water
service is rendered.
Withholding Service: The Company may withhold or discontinue water
service rendered under application made by any member ~ agent

of a family, household, organization, or business unless all prior
indebtedness to the Company of such family, household, organization,
or business for water service has been settled in full.
6.0
Extensions: The Company will make such extensions to its existing
facilities as may be required by one or more Consumers provided the
revenues to be derived therefrom shall be sufficient to afford fair
and reasonable return on the cost of providing and rendering the
water service. Otherwise, the Company will require from the
Consumer prepayments, cash advances, minimum guarantees, service
guarantees, contributions in aid of construction, or other arrange-
ments with the Consumer, whereby the Company will be enabled to earn
a fair and %easonabie return on the cost of providing and rendering
the required service.
7.0
Limitation of Use: Water service purchased from the Company shall
be used by the Consumer only for the purposes specified in the
application for water service and the Consumer shall not sail or
otherwise dispose of such water service supplied by the Company.
Water service furnished to the Consumer shall be rendered directly
to the Consumer through Company's individual meter and shall be for
Consumer's own use and may not be remeterad by the Consumer for the
purpose of selling or otherwise disposing of water service to
lessees, tenants, or others; and under no circumstances shall the
Consumer or Consumer's agent or any other individual, association,
or corporation install meters for the purpose of so remetering said
water service. In no case shall a Consumer, except with the written
consent of the Company, extend his lines across a street, allay,
lane, court, property line, avenue, or other way in order to furnish
water service for adjacent property through one meter, even though
such adjacent property be owned by him. In case of such unahthor-
ized extension, remetering, sale, or disposition of service, Con-
sumer's water service is subject to discontinuance until such un-
authorized extension, remetering, sale or disposition is
discontinued and full payment is made of bills for water service,
calculated on proper classification and rate schedules and
reimbursement in full made to the Company for all extra expenses
incurred for clerical work, testing and inspections.
8.0
Continuity of Service: The Company will at all times use reasonable
diligence to provide continuous water service, and have used reason-
able diligence, shall not be liable to the Consumer for failure or
interruption of continuous water service. The Company shall not be
liable for any act or omission caused directly or indirectly by
strikes, labor troubles, accident, litigations, breakdowns,
shutdowns for repairs or adjustments, acts of sabotage, enemies of
the United States, wars, United States, state, municipal or other

governmental interference, acts of God or other causes beyond its
control.
9.0 ~pe and Maintenance: The Consumer's pipes, apparatus, and equip-
ment shall be selected, installed, used and maintained in accordance
with the standard practice, conforming with the Rules and
Regulations of the Company, and in full compliance with all laws and
governmental regulations applicable to same. The Consumer agrees
further to keep all pipes, valves, plumbing and fixtures in repair
and to promptly stop ail leaks on his premises, and the Company
shall not be responsible for their maintenance and operation. The
Consumer expressly agrees not to utilize any appliance or device
which is not properly constructed, controlled and protected, or
which may adversely affect the water service; and the Company
reserves the right to discontinue or withhold water service to such
apparatus or device.
10.0 Change of Consumer's Installation: No Changes or increases in
Consumer's installation, which will materially affect the proper
operation of the pipes, mains, or stations of the Company shall be
made without written consent of the Company. The Consumer will be
liable for any change resulting from a violation of this rule.
11.0 Inspection of Consumer's Installation: Ail Consumers' water service
installations or changes shall be inspected upon completion by
competent authority to insure that Consumer's piping, equipment, and
devices have been installed in accordance with accepted standard
practice and such local governmental or other rules as may be in
effect. Where municipal or other governmental inspection is
required by local rules or ordinances, the Company cannot render
water service until such inspection has been made and formal notice
of approval from the inspecting authority has been received by the
Company.
The Company reserves the right to inspect Consumer's installation
prior to rendering water service and from time to time thereafter,
but assumes no responsibility whatsoever for any portion thereof.
12.0 Protection of Company's Property: The Consumer shall properly pro-
tect the Company's property on the Consumer's premises, and shall
permit no one but the Company's agents, or persons authorized by
law, to have access to the Company's pipes and apparatus.
In the event of any loss or damage to property of the Company caused
by or arising out of carelessness, neglect or misuse by the
Consumer, the cost of making good such loss or repairing such damage
shall be paid by the Consumer.

13.0 Access to Premises: The duly authorized agents of the Company shall
have access at all reasonable hours to the premises of the Consumer
for the purpose of installing, maintaining and inspecting or remov-
ing Company's property, reading meters, and other purposes incident
to performance under or termination of the Company's agreement with
the Consumer, and in such performance shall not be liable for tres-
pass.
14.0 Right of Way or Easements: The Consumer shall grant or cause to be
granted to the Company and without cost to the Company all rights,
easements, permits, and privileges which in its opinion are
necessary for the rendering of water service.
15.0 Billing Periods: Bills for water service will be rendered monthly.
Bills are due when rendered and shall he considered as received by
Consumer when delivered or mailed to water service address or some
other place mutually agreed upon.
Nonreceipt of bills by Consumers shall not release or diminish
obligation of Consumer with respect to payment thereof.
16.0 Delinquent Bills: Bills are due when rendered, and if not paid
within twenty days thereafter become delinquent, and water service
may then, after five days WRITTEN NOTICE, be discontinued. Service
will be resumed only upon payment of all past due bills and
penalties, together with a reconnect charge of $20.00 when performed
during regular working hours. After regular working hours, the
reconnection charge will be $24.00. There shall be no liability of
any kind against the Company by reason of discontinuance of water
service to the Consumer for failure of the Consumer to pay the bills
on time.
No partial payment of any bill rendered will be accepted by the
Company, except by agreement with the Company, or by order of the
governing body.
17.0 Reimbursement for Extra Expenses: The Consumer shall reimburse the
Company for ail extra expenses (such as for special trips, inspec-
tions, additional clerical expenses, etc.) incurred by the Company
on account of the Consumer's violation of the contract for service'
or of the Company's rules and regulations.
18.0 Payment of Water and Sewer Service Bills Concurrently: When both
water and sewer service are provided by the Company, payment of any
water service bill rendered by the Company to a water service Con-
sumer shall not be accepted by the Company without the simultaneous
or concurrent payment of any sewer service bill rendered by the

Company may discontinue both sewer service and water service to the
Consumer's premises for nonpayment of the water service charges or,
if the charges for sewer service are not so paid, the Company may
discontinue both water service and sewer service to the Consumer's
premises for nonpayment of the sewer service or water service or
either of such services until such time as ail sewer service charges
and water service charges and all other expenses or charges
established or provided for by these Rules and Regulations are paid.
19.0 _Temporary. Discontinuance of Service: At any time that water service
is not being furnished to the premises, as confirmed by the Company
furnishing said water service, upon application to the Company by
the Consumer for a temporary shutoff, billing for water service to
the premises will be continued at the Base Facility Charge.
20.0 Tax Clause: Rates and/or charges may be increased or a surcharge
added in the amount of the applicable proportionate part of any
taxes and assessments imposed by any governmental authority in
excess of those in effect which are assessed on the basis of meters
or customers or the price of, or revenues from, water sold.
21.0 Change of Oc~Fpancy: When change of occupancy takes place on any
premises supplied by the Company with water service, WRITTEN NOTICE
thereof shall be given at the office of the Company not less than
three days prior to the date of change by the outgoing Consumer, who
will be held responsible for all water service used on such premises
until such written notice is so received and the Company has had
reasonable time to discontinue water service. However, if such
written notice has not been received, the application of a
succeeding occupant for water service will automatically terminate
the prior account. Consumer's deposit may be transferred from one
service location to another, if both locations are supplied by the
Company. Consumer's deposit may NOT be transferred from one name to
another.
For the convenience of its Consumers, the Company will accept
telephone orders to discontinue or transfer water service and will
use ail reasonable diligence in the execution thereof. However,
oral orders or advice cannot be deemed binding or be considered
formal notification to the Company.
22.0 Unauthorized Connections-Water: Connections to the Company's water
system for any purpose whatsoever are to be made only by employees
of the Company. Unauthorized connections render the service subject
to immediate discontinuance without notice and water service will
not be restored until such unauthorized connections have been
removed, and unless settlement is made in full for all water service

estimated by the Company to have been used by reason of such
unauthorized connection.
23.0 Meters: All water meters shall be furnished by and remain the
property of the Company and shall be accessible to and subject to
its control. The Consumer shall provide meter space to the Company
at a suitable and readily accessible location and when the Company
considers it advisable, within the premises to be served, and should
be of adequate and proper space for the installation of meters and
ocher similar devices.
24.0 All Water Through Meter: That portion of the Consumer's installa-
tion for water service shall be so arranged that ali water service
shall pass through the meter. No temporary pipes, nipples, or
spacers are permitted and under no circumstances are connections
allowed which may permit water to bypass the meter of metering
equipment.
25.0 Adjustment of Bills: When a customer has been overcharged or under-
charged as a result of incorrect application of the rate schedules,
incorrect reading of the meter, incorrect connection of the meter,
or other similar reasons, the amount may be credited or billed to
the Consumer, as the case may be.
26.0 Customer Deposit: Before rendering service, the Company will re-
quire a deposit or guarantee satisfactory to the Company to secure
the payment of bills, and the Company shall give the customer a
non-negotiable and nontransferable deposit receipt. The amount of
such deposit shall be an amount necessary to cover charges for
service for three billing periods.

The Company will pay interest on customer's deposit at the rate of 8% per
annum° The payment of interest will be made once a year as a credit on
regular bills, and on final bills when service is discontinued. No
Customer depositor will receive interest on his deposit until at least

six months continuous service, then interest will be paid from date of
the commencement of service.
Upon final settlement of customer's account or when customer's credit has
been established to the satisfaction of the Company, any unused balance
of the deposit will be refunded. Refunds are contingent upon surrender to
the Company of the applicable deposit receipt or, when the receipt cannot
be produced, upon adequate identification.
27..0 R__equest for Meter Test by Consumer: Should any customer request a
bench test of his water meter, the Company will require a deposit
to defray cost of testing, such deposit not to exceed the following
schedule of fees:

If meter is found to register in excess of the accuracy limits pre-
scribed by the Commission, the deposit will be refunded; but, if
below such accuracy limit, the deposit will be retained by =he
Company as a service charge for conducting the test.
Further, upon written request of any customer, the Company shall,
without charge, make a field test of the accuracy of the water meter
in use at customer's premises, provided =hat =he meter has not been
tested within the past twelve months. This rule in no way conflicts
with Commission Rule 310-10.80.
28.0 Adjustment of Bills for Meter Error: In meter tests made at the re-
quest of the customer, the accuracy of registration of the meter and
its performance in service shall be judged by its average error. The
average meter error shall be considered to be the average of the
errors at the test rate flows.
Fast Meters - Whenever a meter tested is found to register fast, in
excess of the tolerance provided in the Meter Accuracy Requirements
provision herein, the utility shall refund to the customer the
amount billed in error for one-half the period not to exceed six
months except that if it can be shown that the error was due to some
cause, the date of which can be fixed, the overcharge shall be
computed back to but not beyond such date. The refund shall not
include a,gj part of any minimum charge.
Slow Meters - Whenever a meter tested is found to register slow, in
excess of the tolerance provided in the Meter Accuracy Requirements

provision herein, the utility may bill the customer an amount equal
to the unbilled error for one-half the period since the last test;
said one-half period not to exceed six months, except that if it can
be shown that the error was due to some cause, the date of'which can
be fixed, the charge may be computed back to but not beyond such
date and provided further that if the utility has required a
deposit, the customer may be billed only for that portion of the
unbilled error which is in excess of the deposit retained by the
utility.
In the event of a nouregister meter, customer may be billed on an
estimate based on previous bills for similar usage, such estimate to
apply only to the current billing.
In the event of unauthorized use, the Customer may be billed on a
reasonable estimate of the service taken.
Meter Accuracy Requirements - All meters used for measuring quantity
of water delivered to a customer shall be in good mechanical
condition and shall be adequate in size and design for the type of
service which they measure. Before being installed for the use of
any customer, every water meter, whether new, repaired, or removed
from service for any cause, shall be adjusted to register within the
accuracy limits set forth in the following table:

Terms of Payment - Bills are due and payable when rendered and become

Billing - Bills shall be rendered monthly and the meter reading dates
shall coincide as near as practically possible, and bills rendered as
soon as possible thereafter. Bills rendered for less than 50% of the
normal billing period will be billed in accordance with Rule 25-10.97(2),
Florida Administrative Code: "Whenever, for any reason, the period of
service for which a bill.is rendered is less than fifty percent (50%) of
the normal billing period, the charges applicable ~o such service,
including minimum charges, shall be prorated in the proportio~ that the
actual number of service days bears to a thirty (30) day month; except
that:
(a) Opening bills need not be rendered but may be carried over to
and included in the next regular monthly billing.
(b) For service taken under flat rate schedules, fifty percent
(50%) of the normal charges may be applied.
(c) The practices employed by the utility in this regard shall have
uniform application to ail customers."
Franchise Fee - Consumers residing within the Limits of Sebastian
Highlands will be charged the franchise fee imposed by the City of
Sebastian to the Company, with such fee being itemized on consumer's
monthly bill.
Reconnection Charge~ - On the initial turn-on of a new service or
account, there will be no charge. On reconnections due to other reasons,
there will be a reconnection charge of $20.00 for each request during
regular working hours. After regular working hours, the charge will be
$24.00.
