WARRANTY DEED
THIS WARRANTY DEED Made and entered this 24th day of October
1985 by GENERAL DEVELOPMENT CORPORATION, a corporation existing
under the laws of Delaware, and having its principal place of business at
1111 South Bayshore Drive, Miami, Florida 33131, hereinafter called the
Grantor, to the CITY OF SEBASTIAN, whose post office address is P.O.
Box 127, Sebastian, Florida 32958 -0127, hereinafter called the Grantee:
(Wherever used herein the terms "grantor" and "grantee" include all
the parties to this instrument and the heirs, legal representatives and
assigns of individuals, and the successors and assigns of corporations.)
WITNESSETH: That the Grantor, for and in consideration of the sum
of $10.00 and other valuable considerations, receipt whereof is hereby
acknowledged by these presents does grant, bargain, sell, alien, remise,
release, convey and confirm unto the Grantee all that certain land situate in
Indian River County, Florida, vis:
All of LAKE HARDEE PARK as shown on the plat of SEBASTIAN
HIGHLANDS UNIT 4, according to the plat thereof, as recorded in Plat
Book 5, Page 100 of the Public Records of Indian River County, Florida, all
situate, lying and being in the City of Sebastian, Indian River County,
Florida, and containing 13.87 acres, more or less.
Provided, however, and this conveyance is made subject to and upon
an express condition that should the Grantee cease to use the foregoing
property for park purposes, then, and in that event, the title to said
property shall revert to and vest in the Grantor, its successors and
assigns.
Reserving unto General Development Utilities, Inc., a Florida
corporation, its successors and assigns, an easement for the installation,
operation and maintenance of a water well and such appurtenant pipes,
electrical connections and driveway as are usual and customary; provided
that such well site shall not exceed. 30 feet by 30 feet; and further
provided that the well site and appurtenances shall not interfere with any
existing improvements.
Also reserving unto General Development Utilities, Inc., its successors
or assigns, the rights to all subsurface water lying below 400 feet in
depth.
This Deed is executed subject to taxes assessed for the year 1985 and
all subsequent years and to conditions, easements, limitations and
restrictions of record.
TOGETHER with all the tenements, hereditaments and appurtenances
thereto belonging or in anywise appertaining.
TO HAVE AND TO HOLD, THE SAME IN FEE SIMPLE FOREVER.
AND the Urantor hereby covenants with said Grantee that it-';s lawfully
seized of said land in fee simple; that it has good right and lawful
authority to sell and convey said land; that it hereby fully warrants the
title to said land and will defend the same against the lawful claims of all
persons howsoever, and that said land is free of all encumbrances except

IN WITNESS WHEREOF, the Grantor has caused these presents to be
executed in its name, and its corporate seal to be hereunto affixed, by its c�.t

I HEREBY CERTIFY that on this day, before me, an officer duly
authorized in the State and County aforesaid to take acknowledgments,
personally appeared HAROLD W. FENNO, Senior Vice President of the
corporation named as Grantor in the foregoing deed and that he
acknowledged executing the same in the presence of two subscribing
witnesses freely and voluntarily under authority duly vested in him by said
corporation and that the seal affixed thereto is the true corporate seal of
said corporation.
WITNESS my hand and official seal in the County and State last
aforesaid this 24th day of October 1985.
