This agreement made on the 660—day of Zy, 2004, by and between
JUDITH CAROLYN SHUTTLEWORTH, whose address is 909 Louisiana Avenue,
Sebastian, FL 32958, Grantor, and the City of Sebastian, a municipal corporation of the
State of Florida, whose address is 1225 Main Street, Sebastian, Florida 32958, Grantee.
NOW THEREFORE, in consideration of the sum of Ten Dollars ($10.00) and
other good and valuable consideration, the receipt of which is hereby acknowledged,
Grantor grants and conveys unto Grantee, its successors or assigns, a perpetual public
easement to lay out, construct, inspect, operate, maintain, repair and install sidewalks,
utilities, drainage facilities, together with the right to remove trees, bushes, undergrowth
and other obstructions interfering with the location, construction and maintenance of the
facilities all over, under, across and through the following described land (hereinafter
referred to as "Easement Area "):

IN WITNESSETH WHEREOF, the Grantor, and the Grantee have executed this
Easement on the day and year first written above.

AGREEMENT CONCERNING EASEMENT DEDICATION
THIS AGREEMENT, made and entered into this 6b day of mil, 2004, by and
between the CITY OF SEBASTIAN, a municipal corporation existing under the laws of
the State of Florida, (hereinafter referred to as the "CITY "), and Judith Shuttleworth,
(hereinafter referred to as the "LANDOWNER "), provides as follows:
IN CONSIDERATION of the mutual promises between the parties as hereinafter
provided, the receipt and sufficiency of which are hereby acknowledged, the parties agree:
1. LANDOWNER shall execute the easement attached hereto as Exhibit "A ".
2. CITY agrees that no trees shall be removed from the easement property as
part of the Louisiana Avenue Project improvements
3. For so long as LANDOWNER personally holds the underlying fee interest
to the easement lands, CITY shall give LANDOWNER prior notice of any proposed
trimming or other work affecting trees within the easement whether performed by its
personnel or by third parties working within the easement. Said notice shall be given no
less than two weeks prior to such work, so that LANDOWNER shall have the opportunity
to hire an independent contractor to perform the proposed work on the vegetation.
4. The terms of this agreement shall survive execution of Exhibit "A ".
