Dear Mr. Kreyer:
On March 24, 2006, the District received a letter from MBV Engineering that stated
they were currently working with you to obtain a contractor to complete construction
of the retention area. Said letter did not indicate when construction is expected to
begin. Within 10 days of receipt of this letter, please submit a construction schedule
to the District.

Please be aware that the above referenced permit was issued to Sebastian Harbor
Ltd. Note that it is the permittee's responsibility to ensure completion of construction
of the stormwater system and to ensure compliance with all conditions of this permit.
Until the retention area is constructed in accordance with the final approved plans
and District staff considers the as-built certification acceptable, Sebastian Harbor Ltd.
will remain responsible for the operation and maintenance of the stormwater system.
Change in ownership of the parcel associated with this project will not relieve
Sebastian Harbor Ltd. of the obligation to satisfy the conditions of this permit
unless the new owner agrees in writing to resolve the pending compliance
issue. If you do not complete construction of the retention area in the near future,
the District will pursue further enforcement action on this matter.
