The corrective actions required to bring your facility into compliance have been performed. The Department finds that you are in violation of: • Section 62.343.050, Ha. Stat., which requires that a permit must be obtained from the Department prior to filling in, on, or over wetlands and surface waters. • Section 403.161, Fla. Stat., which makes it a violation to fail to comply with Department rules. • Rule 18-21.004(7)(a), Fla. Admin. Code, which states that authorizations to use sovereign submerged lands are valid only for the specified activity or use. Any unauthorized deviation from the specified activity or use and the conditions for undertaking that activity or use shall constitute a violation. In order to resolve the matters identified in the attached letter, you are assessed civil penalties in the amount of $2,000.00, along with $500.00 to reimburse Department costs. DABROWSKI IRREVOCABLE ) TRUST DATED JULY 17, 2007 ) ) Respondent. ) CONSENT ORDER This Consent Order ("Order") is entered into between the State of Florida Department of Environmental Protection ("Department"), The Board of Trustees of the Internal Improvement Trust Fund ("Board") and Herbert V. Morrison, Trustee of the Henry J. Dabrowski Irrevocable Trust Dated July 17, 2007("Respondent") to reach settlement of certain matters at issue between the Department,the Board and Respondent. The Department and the Board find and the Respondent admits the following: 1. The Department is the administrative agency of the State of Florida having the power and duty to protect Florida's air and water resources and to administer and enforce Chapter 373, Part IV, and Chapter 403, Florida Statutes, and the rules promulgated and authorized thereunder,Title 62, Florida Administrative Code. The Department has jurisdiction over the matters addressed in this Order. 2. The Board is responsible for overseeing state owned lands and ensuring they are managed in trust for the citizens of the State of Florida pursuant to Chapter 253, Florida Statutes, and the rules promulgated and authorized thereunder, Florida Administrative Code OGC CASE NO 09-3161 HERBERT V MORRISON,TRUSTEE OF THE HENRY J f)A13ROWSKI IRREVOCABLE TRUST DATED JULY 17,2007 PAGE 1 OF 10 Title 18. The Department has the duty to perform all staff duties and functions related to the administration of state lands as provided in Section 253.002, Florida Statutes. 3. Respondent is a person within the meaning of Sections 253.04 and 373.019(15), Florida Statutes. 4. Respondent is the owner of property located at 1532 Indian River Drive, Sebastian, Parcel ID: 31390600001001000002.0, Section 06, Township 31 South, Range 39 East, Indian River County ("Property"). The Property is located adjacent to the Indian River. 5. The Department finds that the Respondent dredged and filled sovereign submerged lands without a valid environmental resource permit, and operates a commercial facility over sovereign submerged lands without a sovereign submerged land lease. An inspection by Department personnel on February 17, 2009, confirmed that the subject facility was expanded, including a clam nursery and raceways, additional mooring areas, decking, mooring pilings, and finger piers, without a valid permit and lease from the Department and the Board. The activity was conducted below the mean high water line in the Indian River, waters of the State, as defined by Florida Law,adjacent to the Respondent's property. Having reached a resolution of the matter Respondent and the Department and the Board mutually agree and it is, ORDERED: 6. Within 30 days of the effective date of this Order, Respondent shall pay the Department $2,500.00 in regulatory administrative penalties in settlement of the matters addressed in this Order. This amount includes $500.00 for costs and expenses incurred by the Department during the investigation of this matter and the preparation and tracking of this • Order, The civil penalties are apportioned as $1,000.00 for operating unauthorized activities, a violation of Section 373.430(1)(b), Florida Statutes, and Rule 62-343.050, Florida Administrative Code,, and $1,000.00 for failure to obtain a permit, a violation of Section 373.430(1)(h), Florida Statutes, and Rule 62-343.050, Florida Administrative Code. Respondent shall implement the Corrective Actions attached hereto and incorporated herein as Attachment I in the manner and within the time frames specified therein. 8. With the exception of the activities described in the Corrective Actions, effective immediately and henceforth, Respondent shall not conduct any dredging, filling, or construction activities on or within the landward extent of waters of the state without first obtaining a valid Department permit or written notification from the Department that the activities appear to be exempt as proposed from Department permitting requirements; nor shall Respondent conduct any activities on state owned lands below the ordinary or mean high water lines wit out first ob a lease, easement,or other consent 0 use from the Department. 9 Respondent agrees to pay the Department stipulated penalties in the amount of S100.0O per day for each and every day Respondent fails to timely comply with any of the requirements of paragraphs 7 and 8 of this Order. A separate stipulated penalty shall be assessed for each violation of this Order. Within 30 days of written demand from the Department, Respondent shall make payment of the appropriate stipulated penalties to the "The Department of Environmental Protection" by cashier's check or money order and shall include thereon the OGC number assigned to this Order and the notation "Ecosystem Management and Restoration Trust Fund" The Department may make demands for payment at any time after violations occur. Nothing in this paragraph shall prevent the Department from filing suit to specifically enforce any of the terms of this Order. Any penalties assessed under this paragraph shall he in addition to the settlement sum agreed to in paragraph 6 and the lease fees in arrears agreed to in Attachment H of this Order. If any event, including administrative or judicial challenges by third parties unrelated to the Respondent,occurs which causes delay or the reasonable likelihood of delay, in complying with the requirements of this Order, Respondent shall have the burden of proving the delay was or will be caused by circumstances beyond the reasonable control of the Respondent and could not have been or cannot be overcome by Respondent's due diligence. Economic circumstances shall not be considered circumstances beyond the control of Respondent, nor shall the failure of a contractor, subcontractor, materialman or other agent (collectively referred to as "contractor") to whom responsibility for performance is delegated to meet contractually imposed deadlines be a cause beyond the control of Respondent, unless the cause of the contractor's late performance was also beyond the contractor's control. Upon occurrence of an event causing delay, or upon becoming aware of a potential for delay, Respondent shall notify the Department orally within 24 hours or by the next working day and shall, within seven calendar days of oral notification to the Department, notify the Department in writing of the anticipated length and cause of the delay, the measures taken or to be taken to prevent or minimize the delay and the timetable by which Respondent intends to implement these measures. If the parties can agree that the delay or anticipated delay has been or will be caused by circumstances beyond the reasonable control of Respondent, the time for performance hereunder shall be extended for a period equal to the agreed delay resulting from such circumstances. Such agreement shall adopt all reasonable measures necessary to avoid or minimize delay. Failure of Respondent to comply with the notice requirements of this Paragraph in a timely manner shall constitute a waiver of Respondent's right to request an extension of time for compliance with the requirements of this Order. Respondent shall allow all authorized representatives of the Department access to the property at reasonable times for the purpose of determining compliance with the terms of this Order and the rules and statutes of theDepartmenL 12. Entry of this Order does not relieve Respondent of the need to comply with applicable federal,state or local laws, regulations or ordinances. 13. The terms and conditions set forth in this Order may be enforced in a court of competent jurisdiction pursuant to Sections 12069, 253.04 and 373.129, Florida Statutes. Failure to comply with the terms of this Order shall constitute a violation of Section 253.04 and 373.430, Florida Statutes. 14. Respondent is fully aware that a violation of the terms of this Order may subject Respondent to judicial imposition of damages, civil penalties of up to $10'000 per day per violation and administrative fines of up to$10,000 per day per violation and criminal penalties. 15. Persons who are not parties to this Consent Order,but whose substantia interests are affected by it,have a right to petition for an administrative hearing under sections 120.569 and 120.57, Florida Statutes. Because the administrative hearing process is designed to formulate final agency action, the filing of a petition concerning this Consent Order means that the Department's final action may be different from the position it has taken in the Consent Order. The petition for administrative hearing must contain all of the following information: a) The OGC Number assigned to this Consent Order; h) The name, address, and telephone number of each petitioner; the name, address, and telephone number of the petitioner's representative, if any,which shall be the address for service purposes during the course of the proceeding; c) An explanation of how the petitioner's substantial interests will be affected by the Consent Order; d) A statement of when and how the petitioner received notice of the Consent Order; (XGC CASE NO.V9'3l61 HERBERT vW0RR|S7N,TRUSTEE 0F THE HENRY|.D6DKOnv5K| IRREVOCABLE TRUST DATED JULY 17,2007 PAGE 5n+/0 e) Either a statement of all material facts disputed by the petitioner or a statement that the petitioner does not dispute any material facts; f) A statement of the specific facts the petitioner contends warrant reversal or modification of the Consent Order; g) A statement of the rules or statutes the petitioner contends require reversal or modification of the Consent Order; and h) A statement of the relief sought by the petitioner, stating precisely the action petitioner wishes the Department to take with respect to the Consent Order. The petition must be filed (received) at the Department's Office of General Counsel, 3900 Commonwealth Boulevard,MS#35,Tallahassee,Florida 32399-3000 within 21 days of receipt of this notice. A copy of the petition must also be mailed at the time of filing to the District Office at 3319 Maguire Blvd, Suite 232, Orlando FL 32803. Failure to file a petition within the 21-day period constitutes a person's waiver of the right to request an administrative hearing and to participate as a party to this proceeding under sections 120.569 and 120.57, Florida Statutes. Before the deadline for filing a petition, a person whose substantial interests are affected by this Consent Order may choose to pursue mediation as an alternative remedy under section 120.573, Florida Statutes. Choosing mediation will not adversely affect such person's right to request an administrative hearing if mediation does not result in a settlement. Additional information about mediation is provided in section 120.573,Florida Statutes and Rule 62-110.106(12), Florida Administrative Code. 16. The Department hereby expressly reserves the right to initiate appropriate legal action to prevent or prohibit any violations of applicable statues, or the rules promulgated thereunder that are not specifically addressed by the terms of this Order. 17. Respondent acknowledges its right to appeal the terms of this Order pursuant to Section 120.68, Florida Statutes,and waive that right upon signing this Order. 19. No modifications of the terms of this Order shall be effective until reduced to writing and executed by both Respondent and the Department. 20. All submittals and payments required by this Order to be submitted to the Department shall be sent to the Florida Department of Environmental Protection, SLERP, Central District Office,3319 Maguire Blvd,Suite 232,Orlando, Florida 32803. 21. In the event of a sale or conveyance of the property, if all of the requirements of this Order have not been fully satisfied, Respondent shall, at least 30 days prior to the sale or conveyance of the property, (1) notify the Department of such sale or conveyance and (2) provide a copy of this Order with all attachments to the new owner. The sale or conveyance of the property shall not relieve the Respondent of the obligations imposed in this Order. 22. This Order is a settlement of the Department's civil and administrative authority arising under Florida law to resolve the matters addressed herein.This Order is not a settlement of any criminal liabilities which may arise under Florida law, nor is it a settlement of any violation which may be prosecuted criminally or civilly under federal law. 23. This Order is a final order of the Department pursuant to Section 120.52(7), Florida Statutes, and it is final and effective on the date filed with the Clerk of the Department unless a Petition for Administrative Hearing is filed in accordance with Chapter 120, Florida Statutes. Upon the timely filing of a petition this Order will not be effective until further order of the Department. Respondent shall, in tandem with this Consent Order, enter into a Temporary Use Agreement("T UA") with the Department, attached and incorporated herein as Attachment }[ The TUA will address the payment of lease fees in arrears totaling S26'833.54 and the Respondent's responsibility to apply for a new lease from the Board. 2. Within 45 days of the effective date of this Order,Respondent shall complete and submit to the Department the Income Reporting Forms corresponding to the fiscal years of 2003-04, 2004-05, 2006-07 and 2008-09. The forms shall be sent to Florida Department of Environmental Protection, SLERP, Central District Office, 3319 Maguire Blvd, Suite 232, Orlando, Florida 32803. 3. Within 30 days of the effective date of this Order, Respondent shal| submit an environmental resource permit application for regulatory and proprietary authorization for the structures and activities located on surface waters and wetlands of the Indian River. Within 180 days of the effective date of this Order, Respondent shall obtain regulatory authorization and proprietary authorization for all unauthorized structures and activities located on surface waters and weUands of the Indian River. Respondent shall subsequently make annual lease fee payments accordingly. 4. If Respondent receives regulatory and proprietary authorization, Respondent shall, within 30 days of the date of authorization, complete any modifications required by the modification. 5. If Respondent does not receive regulatory and proprietary authorization for the existing unauthorized structures and activities within 180 days of the effective date of this Order, the Respondent shall remove all unauthorized structures in their entirety and cease all unauthorized activities that are located on sovereign lands, including all unauthorized mooring pilings, mooring areas, dock structures,aquaculture facilities, and vessels located waterward of the mean high water line and within the Respondents riparian rights. Within 60 days of any denial of a the lease for existing unauthorized structures and activities, Respondent shall subsequently obtain a sovereign submerged land lease and make annual lease fee payments for previous authorized and permitted structures accordingly. If Respondent does not obtain a lease within that time period, Respondent shall remove all structures located on sovereign lands. a. Prior to commencement of structure removal,Respondent shall properly install all turbidity, sedimentation, and erosion control measures and maintain them until all turbidity has ceased and or all disturbed areas are stabilized. Removal activities shall be conducted so as not to affect wetlands or surface waters or cause a violation of Chapter 62-302, Florida Administrative Code. b. During structure removal, Respondent shall employ best management practices at all times to avoid violations of water quality standards, as defined in Chapter 62- 302, Florida Administrative Code. c. During structure removal, Respondent shall take the following measures whenever turbidity levels within the Indian River or other waters of the State surrounding the Property exceed state water quality standards: 1. Immediately cease all work contributing to the water quality violation. ii. B A commercial clocking facility holds structures and operates activities on these lands adjacent to Applicant's upland real property without the Board's approval or authorization. C. The parties hereto, then,agree as follows: 1. The Applicant acknowledges and understands that the grant of this Tempo Use Agreement and the payment of the amount herein does not guarantee that the Board will grant the Applicant a lease or that the Department of Environmental Protection will recommend that a lease he granted. 2 The Applicant is hereby granted the temporary exclusive use of the structures located on these lands as depicted in Exhibit"2," consisting of approximately 31,422 square feet, waterward of Applicant's upland real property described above. This temporary exclusive use is for a term of six months from the date of this Agreement or until the date of execution of a sove i lands lease between the Board and the Applicant, whichever occurs first. The Applicant sha] make no claim of title to or interest in the sovereign lands identified in Exhibit "2" solely by reason of occupancy or use thereof under this Temporary Use Agreement. 3. The existing structures can only be utilized as they were on the date of execution of this Temporary Use Agreement, which was as a commercial docking and aquaculture facilities for the mooring of recreational and commercial fishing vessels. In the event any part of any of these structures is determined by a final adjudication issued by a court of competent jurisdiction to B0'1'#310006484 Henry|.Cuh^pvski Revocable Living Trust Pace 1 of 5 encroach or interfere with riparian rights of the adjacent upland riparian owner,Applicant agrees to either obtain written consent for the offending structure from the affected adjacent upland riparian owner or remove the interference or encroachment within 60 days from the date of the adjudication. Failure to comply with this paragraph shall constitute a material breach of this Agreement and be grounds for immediate termination of this Agreement at the sole option of the Board. 4. The consideration paid for this Agreement includes the annual lease fees due for these lands from 2004/2005 through 2009/2010, plus interest payable on past due lease fees. This consideration is not refundable, notwithstanding the denial of a sovereign lands lease by the Board. 5_ In the event that a sovereign lands lease application for the entire existing structure is not approved by the Board and executed by both parties prior to the expiration or sooner termination of this Agreement,and either the Applicant fails to timely submit the information concerning title as required herein, or the Board denies the Applicant's claim of title and the Applicant has not commenced an action to quiet title as specified herein, the Applicant shall remove all structures referenced herein from the sovereign lands in excess of the previously approved structures as identified in the 1994. lease survey, attached hereto as Exhibit 1 at the Applicant's sole expense. The complete removal of the unauthorized structures shall be accomplished within 180 days following the date of execution of this Agreement. Within 60 days of any denial of a the lease for existing unauthorized structures and activities, Applicant shall subsequently obtain a sovereign submerged land lease and make annual lease fee payments for previous authorized and permitted structures accordingly. If Applicant does not obtain a lease within that time period, Applicant shall remove all structures located on sovereign lands at the Applicant's sole expense and in accordance with Consent Order associated with this case. 6. If the Applicant asserts title to the sovereign lands identified in Exhibit"2," the Applicant must submit an application, accompanied by all evidence upon which Applicant relies for the assertion of title,to the Division of State Lands("DSL"),Department of Environmental Protection, within 90 days after the execution of this Agreement. DSL will review the application and accompanying evidence and give a response to Applicant as to whether the Board will assert title to the sovereign lands described in Exhibit"2." If DSL responds that the Board will assert title to said sovereign lands, the Applicant must file an appropriate action in circuit court within 90 days of DSL's response to obtain a legal determination of title to the sovereign lands. If DSL, after consultation with the Board, responds that the Board does not assert title to the sovereign lands, then the Applicant shall not have to apply for a sovereign lands lease, and that portion of the consideration representing lease fees and interest shall be refunded_ If DSL, after its review, responds that the Board does not assert title to a portion of the sovereign lands,any consideration for that portion representing lease fees and interest will be refunded. Failure to submit the initial application and evidence within 90 days after execution of this Agreement, or failure to file the appropriate court action within 90 days after DSL's response, shall constitute a waiver by the Applicant of all of its claim of title to the sovereign lands and an acknowledgment that the Board owns the sovereign lands. 7. Applicant shall make initial application for a sovereign lands lease to the Board within 30 days of the execution of this Agreement and complete the application by no later than 90 days of the execution of this Agreement for the lands identified in Exhibit"2." 8. Immediately following execution of this Agreement, Applicant ,shall record this Agreement and send a copy of the recorded Agreement to the Department of Environmental l3OT#310006484 Henry J. No request for an extension of the Agreement shall be considered by the Board except upon a demonstration by the Applicant that the Applicant is in full compliance with the terms and conditions of this Agreement and has exercised due diligence in its efforts to procure a sovereign lands lease from the Board. 10. As a material condition of this Agreement, Applicant agrees to comply with all of the requirements of Chapters 253, 258,and 376,Florida Statutes,and the rules promulgated pursuant thereto. The Board has the right to immediately rescind this Agreement upon the failure of Applicant to comply with either the terms of this Agreement, statutes, rules, or any permits or exemptions. The Board has the right to immediately rescind this Agreement upon the failure of Applicant to comply with either the terms of this Agreement, statutes, or regulations. Upon written notice that the Board has exercised its right to rescind under this paragraph, Applicant shall cease and desist all activity authorized by this Agreement within the timeframe specified in the notice,or within twenty days of receipt of the notice if no timeframe is specified. Applicant shall save and hold harmless and indemnify the Board, Department of Environmental Protection,and the State of Florida against any and all liability,claims,judgments or costs of whatsoever kind and nature for injury to, or death of, any person or persons and for loss or damage to any property arising out of or connected with Applicant's occupation and use of these lands and the structures or activities located thereon. By execution of this Agreement, applicant waives any claim it may have against the Department of Environmental Protection concerning the submerged lands described on Exhibit "2" except as described in Paragraph 6 above. 12. Applicant agrees that any litigation arising from matters relating to this Agreement between the Board and the Applicant shall be initiated and maintained only in Leon County, Florida. 13. This Agreement, and any rights and privileges contained herein, are for the sole benefit and use of the Applicant and shall not be assigned or transferred by the Applicant to any other party without the prior written consent of the Board, which consent shall not be unreasonably withheld. 14.
