This permit is issued under the authority of Part IV of Chapter, 373, F.S., and Title 62, Florida.
Administrative Code (F.A.C.). The activit}' is not exempt from the requirement to obtain a
Standard General Permit. Pursuant to Operating Agreements executed between the Department
and the water management districts, as referenced in Chapter o2 -113, F.A.C., the Department is
responsible for reviewing and taking final agency action on this activity.
ACTIVITY DESCRIPTION:
The Applicant, Sebastian Entertainment, d/b /a Sebastian River Boat Tours, applied on January
26, 2005 to the Department of Environmental PTOtcctior, for an environmental resource
permit/water quality certification and requested authorization to use sovereign submerged lands
owned by the Board of Trustees of the Internal Improvement !rust Fund (Board of Trustees) to
construct 2 -slip commercial dock to be used in conjunction ..A.;rii an eco -tour business constructed
on the riparian uplands. The proposed structure includes an 81 feet long by 5 feet wide extension
onto an existing 139 feet long by 5 feet wide pier and a 22 f-:.et long by 7 feet wide terminal
platform with 2 uncovered mooring areas. The dock will accommodate the mooring of (2) 48-
foot pontoon boats with a maximum draft of 18 inches. The proposed preempted area for the
entire facility is 2,914 square feet.
Mitigation: To offset impacts associated with the proposed prp+ect and to demonstrate that the
project is clearly in the public interest (SJRWM;i) Applicam's Handbook 12.2.3), the applicant
has provided the following:
• Planting Spartina alwnif7ora facing the existing ve heal seawall along the entire
shoreline (103 linear feet).
• Donation of 4 acres of submerged bottoms owned by Sebasthi Entertainmenit, that are
located immediately waterward of the vertical seawall at the subject parcel.

The Permittee has agreed to monitor the seagrass along the ingress /egress route annually for
the life of the facility. The seagrass monitoring plan will include a baseline survey with
transect locations within the route and along lateral lines 100 feet to the north and south of
route. Monitoring will comply with the approved procedures for site surveys in the
Submerged Lands and Environmental Resource Program, SLER 0945. Annual monitoring
will be provided to the Department and will be subject to verification by Department staff.
The Permittee has agreed to place floating buoys to delineate the ingress /egress route. The
Permittee has agreed that if results of the monitoring shows decreasing coverage or health of
seagrass related to the adjacent areas, that they will be responsible for implementing a
mitigation plan that complies with the criteria in 373.414 F.S. and 62 -345 F.A.C. The
Uniform Mitigation Assessment Methodology will use a current condition rating of the
seagrass beds prior to installation of the subject commercial dock.
AC'T'IVITY LOCATION:
The activity is located at 1550 N. Indian River Drive, Section 13, Township 30 South, Range 39
East, in the Indian River Lagoon Aquatic Preserve (Malabar to Vero Beach), Class III Prohibited
Shellfish Harvesting Waters, Outstanding Florida Waters, within the local jurisdiction of the city
of Sebastian.
This permit also constitutes certification compliance with water quality standards under Section
401 of the Clean Water Act, 33 U.S.C. 1341.
A copy of this authorization also has been sent to the U.S. Army Corps of Engineers ( USACOE)
for review. The USACOE may require a separate permit. Failure to obtain this authorization
prior to construction could subject you to enforcement action by that agency. You are hereby
advised that authorizations also may be required by other federal, state, and local entities. This
authorization does not relieve you from the requirements to obtain all other required permits and
authorizations.
Authority for review an agreement with the U.S. Army Corps of Engineers entitled
"Coordination Agreement Between the U. S. Army Corps of Engineers (Jacksonville District)
and the Florida Department of Environmental Protection State Programmatic General Permit,
Section 10 of the Rivers and Harbor Act of 1899 and Section 404 of the Clean Water Act.
This activity also requires a proprietary authorization, as the activity is located on sovereign
submerged lands owned by the Board of Trustees of the Internal Tmprovement Trust Fund,
pursuant to Article X, Section 11 of the Florida Constitution, and Sections 253.002 and 253.77,
F.S. The activity is not exempt from the need to obtain a proprietary authorization. The
Department has the responsibility to review and take final action on this request for proprietary
authorization in accordance with Section 18- 21.0051, and the Operating Agreements executed
between the Department and the water management districts, as referenced in Chapter 62 -113,
F.A.C. In addition to the above, this proprietary authorization has been reviewed in accordance
with Chapter 253, F.S., Chapter 18 -21, Section 62- 343.075, F.A.C., and the policies of the Board
of Trustees.

As staff to the Board of Trustees, the Department has reviewed the activity described below, and
has determined that the activity requires a lease to the use of those lands, pursuant to Chapter
253.77, Florida Statutes. On April 17, 2007 the Board of Trustees granted authority for the
Department to proceed with issuance of a one -year lease for the subject activity.
The final documents required to execute the lease will be sent to Bureau of Public Lands
Administration. The Department intends to issue the lease, upon satisfactory execution of those
documents. You may not begin construction of this activity on state - owned, sovereign
submerged lands until the lease has been executed to the satisfaction of the Department.
This permit constitutes a determination, pursuant to Section 380.0651(3)(e), F.S., that the facility
is located so that it will not adversely impact Outstanding Florida Waters or Class II waters, and
will not contribute to boat traffic in a manner that will adversely impact the manatee.
The above named permittee is hereby authorized to construct the work shown on the application
and approved drawings, plans, and other documents attached hereto or on file with the
Department and made a part hereof. This permit and intent to issue a lease to use sovereign
submerged lands is subject to the limits, conditions, and locations of work shown in the
attached drawings, and is also subject to the attached 20 General Conditions and 38
Specific Conditions, which are a binding part of this permit and intent to issue a lease
authorization. You are advised to read and understand these drawings and conditions prior to
commencing the authorized activities, and to ensure the work is conducted in conformance with
all the terms, conditions, and drawings. If you are utilizing a contractor, the contractor also
should read and understand these drawings and conditions prior to commencing the authorized
activities. Failure to comply with all drawings and conditions shall constitute grounds for
revocation of the permit and appropriate enforcement action.
Operation of the facility is not authorized except when determined to be in conformance with all
applicable rules and with the general and specific conditions of this permit/authorization, as
specifically described below.
GENERAL CONDITIONS:
1. All activities shall be implemented as set forth in the plans, specifications and performance
criteria as approved by this permit. Any deviation from the permitted activity and the
conditions for undertaking that activity shall constitute a violation of this permit.
2. This permit or a copy thereof complete with all conditions, attachments, exhibits, and
modifications, shall be kept at the work site of the permitted activity. The complete permit
shall be available for review at the work site upon request by Department staff. The
permittee shall require the contractor to review the complete permit prior to
commencement of the activity authorized by this permit.

3. Activities approved by this permit shall be conducted in a manner which do not cause
violations of state water quality standards.
4. Prior to and during construction, the permittee shall implement and maintain all erosion
and sediment control measures (best management practices) required to retain sediment
on -site and to prevent violations of state water quality standards. All practices must be in
accordance with the guidelines and specifications in chapter 6 of the Florida Land
Development Manual: A Guide to Sound Land and Water Management (Florida
Department of Environmental Regulation 1988), unless a project specific erosion and
sediment control plan is approved as part of the permit, in which case the practices must be
in accordance with the plan. If site specific conditions require additional measures during
any phase of construction or operation to prevent erosion or control sediment, beyond
those specified in the erosion and sediment control plan, the permittee shall implement
additional best management practices as necessary, in accordance with the specifications
in chapter 6 of the Florida Land Development Manual: A Guide to Sound Land and Water
Management (Florida Department of Environmental Regulation 1988). The permittee
shall correct any erosion or shoaling that causes adverse impacts to the water resources.
5. Stabilization measures shall be initiated for erosion and sediment control on disturbed
areas as soon as practicable in portions of the site where construction activities have
temporarily or permanently ceased, but in no case more than 7 days after the construction
activity in that portion of the site has temporarily or permanently ceased.
6. At least 48 hours prior to commencement of activity authorized by this permit, the
permittee shall submit to the Department an "Environmental Resource Permit Construction
Commencement" notice (Form No. 62- 343.900(3), F.A.C.) indicating the actual start date
and the expected completion date.
7. When the duration of construction will exceed one year, the permittee shall submit
construction status reports to the Department on an annual basis utilizing an "Annual
Status Report Form" (Form No. 62- 343.940(4), F.A.C.). These forms shall be submitted
during June of each year.
S. For those systems which will be operated or maintained by an entity which will require an
easement or deed restriction in order to provide that entity with the authority necessary to
operate or maintain the system, such easement or deed restriction, together with any other
final operation or maintenance documents as are required by subsections 7.1.1 through
TIA of the Applicant's Handbook: Management and Storage of Surface Waters, must be
submitted to the Department for approval. Documents meeting the requirements set forth
in these subsections of the Applicant's Handbook will be approved. Deed restrictions,
easements and ' other operation and maintenance documents which require recordation
either with the Secretary of State or the Clerk of the Circuit Court must be so recorded
prior to lot or unit sales within the project served by the system, or upon completion of
construction of the system, whichever occurs first. For those systems which are proposed
to be maintained by county or municipal entities, final operation and maintenance

documents must be received by the Department when maintenance and operation of the
system is accepted by the local governmental entity. Failure to submit the appropriate
final documents referenced in this paragraph will result in the permittee remaining liable
for carrying out maintenance and operation of the permitted system.
9. Each phase or independent portion of the permitted system must be completed in
accordance with the permitted plans and permit conditions prior to the initiation of the
permitted use of site infrastructure located within the area served by that portion or phase
of the system. Each phase or independent portion of the system must be completed in
accordance with the permitted plans and permit conditions prior to transfer of
responsibility for operation and maintenance of that phase or portion of the system to a
local government or other responsible entity.
10. Within 30 days after completion of construction of the permitted system, or independent
portion of the system, the permittee shall submit a written statement of completion and
certification by a registered professional engineer or other appropriate individual as
authorized by law, utilizing "Environmental Resource Permit As -Built Certification
by a Registered Professional" (Form No. 62- 343.9000, F.A.C.) supplied with this
permit. When the completed system differs substantially from the permitted plans, any
substantial deviations shall be noted and explained and two copies of as-built drawings
submitted to the Department. Submittal of the completed form shall serve to notify the
Department that the system is ready for inspection. The statement of completion and
certification shall be based on on -site observation of construction (conducted by the
registered professional engineer, or other appropriate individual as authorized by law, or
under his or her direct supervision) or review of as -built drawings for the purpose of
determining if the work was completed in compliance with approved plans and
specifications. As -built drawings shall be the permitted drawings revised to reflect any
changes made during construction. Both the original and any revised specifications must
be clearly shown. The plans must be clearly labeled as "as- built" or "record" drawing. All
surveyed dimensions and elevations shall be certified by a registered surveyor. The
following information, at a minimum, shall be verified on the as -built drawings:
a. Dimensions and elevations of all discharge structures including all weirs, slots, gates,
pumps, pipes, and oil and grease skimmers;
b. Locations, dimensions, and elevations of all filter, exfiltration, or underdrain
systems including cleanouts, pipes, connections to control structures, and points of
discharge to the receiving waters;
C. Dimensions, elevations, contours, or cross- sections of all treatment storage areas
sufficient to determine stage- storage relationships of the storage area and the
permanent pool depth and volume below the control elevation for normally wet
systems, when appropriate;
d. Dimensions, elevations, contours, final grades, or cross- sections of the system to
determine flow directions and conveyance of runoff to the treatment system;
e. Dimensions, elevations, contours, final grades, or cross - sections of all conveyance
systems utilized to convey off -site runoff around the system;

f. Existing water elevation(s) and the date determined; and
g. Elevation and location of benchmark(s) for the survey.
11. The operation phase of this permit shall not become effective until the permittee has
complied with the requirements of the condition in paragraphs (9 and 10) above, the
Department determines the system to be in compliance with the permitted plans, and the
entity approved by the Department in accordance with subsections 7.1.1 through 7.1.4 of
the Applicant's Handbook: Management and Storage of Surface Waters, accepts
responsibility for operation and maintenance of the system. The permit may not be
transferred to such an approved operation and maintenance entity until the operation phase
of the permit becomes effective. Following inspection and approval of the permitted
system by the Department, the permittee shall request transfer of the permit to the
responsible approved operation and maintenance entity, if different from the permittee.
Until the permit is transferred pursuant to section 7.1 of the Applicant's Handbook:
Management and Storage of Surface Waters, and Section 62- 343.110(l)(d), F.A.C., the
permittee shall be liable for compliance with the terms of the permit.
12. Should any other regulatory agency require changes to the permitted system, the permittee
shall provide written notification to the Department of the changes prior to implementation
so that a determination can be made whether a permit modification is required.
13. This permit does not eliminate the necessity to obtain any required federal, state, local and
special district authorizations prior to the start of any activity approved by this permit.
This permit does not convey to the permittee or create in the permittee any property right,
or any interest in real property, nor does it authorize any entrance upon or activities on
property which is not owned or controlled by the permittee, or convey any rights or
privileges other than those specified in the permit and chapter 40C -4 or chapter 40C -40,
F.A.C.
14. The permittee is hereby advised that section 253.77, F.S., states that a person may not
commence any excavation, construction, or other activity involving the use of sovereign or
other lands of the state, the title to which is vested in the Board of Trustees of the Internal
Improvement Trust Fund without obtaining the required lease, license, easement, or other
form of consent authorizing the proposed use. Therefore, the permittee is responsible for
obtaining any necessary authorizations from the Board of Trustees prior to commencing
activity on sovereignty lands or other state -owned lands.
15. The permittee shall hold and save the Department harmless from any and all damages,
claims, or liabilities which may arise by reason of the activities authorized by the permit or
any use of the permitted system.
16. Any delineation of the extent of a wetland or other surface water submitted as part of the
permit application, including plans or other supporting documentation, shall not be
considered specifically approved unless a specific condition of this permit or a formal
determination under section 373.421(2), F.S., provides otherwise.

17. The permittee shall notify the Department in writing within 30 days of any sale,
conveyance, or other transfer of ownership or control of the permitted system or the real
property at which the permitted system is located. All transfers of ownership or transfers
of a permit are subject to the requirements of section 62- 343.130, F.A.C. The permittee
transferring the permit shall remain liable for any corrective actions that may be required
as a result of any permit violations prior to such sale, conveyance or other transfer.
18. Upon reasonable notice to the permittee, Department authorized staff with proper
identification shall have permission to enter, inspect, sample and test the system to insure
conformity with the plans and specifications approved by the permit.
19. If historical or archaeological artifacts are discovered at any time on the project site, the
permittee shall immediately notify the Department.
20. The permittcc shall immediately notify the Department in writing of any previously
submitted information that is later discovered to be inaccurate.
SPECIFIC CONDITIONS:
1. The terms, conditions, and provisions of the required sovereign submerged land lease
shall be met. Construction of this activity shall not continence on sovereign submerged
lands, title to which is held by the Board of Trustees of the Internal Improvement Trust
Fund, until all required lease documents have been executed to the satisfaction of the
Department.
2. Turbidity must be controlled to prevent violations of water quality pursuant to Rule
62- 302.700, Florida Administrative Code. No degradation of water quality, other than
that allowed in Rule 624.242(2)(3), F.A.C. is permitted in Outstanding Florida Waters
and Outstanding Natural Resource Waters, respectively.
3. The Permince shall install a floating turbidity curtain /apron shall around the waterward
portion of the project site prior to construction and it shall remain in place until
construction is completed and turbidity within the work area has returned to background
levels.
4. The project shall comply with applicable state water quality standards, including:
a. 62- 302.500 - minimum criteria for all surface waters at all places and at all times,
b. 62- 302,500 - Surface waters: general criteria, and
C. 62- 302.400 - Class III Waters - Recreation - Propagation and maintenance of a
healthy, well - balanced population of Fish and Wildlife and
d. 62- 302.700(1) Special Protection, Outstanding Florida Waters, Outstanding
National Resource Waters. It shall be the Department policy to afford the highest
protection to Outstanding Florida Waters and Outstanding Natural Resource
Waters. No degradation of water quality, other than that allowed in Rule 62-
4.242(2)(3), F.A.C. is permitted in Outstanding Florida Waters and Outstanding
Natural Resource Waters, respectively.

All cleared vegetation, excess lumber, scrap wood, trash, garbage, etc. shall be removed
from wetland /surface waters upon completion of the project by the Permittee.
6, There shall be no fish cleaning stations, boat repair facilities, or equipment facilities on
the dock structures.
7. There shall be no bait houses, storage shelters, screen porches, wet bars, living quarters,
or other non - water- dependent structures or activities located on the dock structures.
8. The structure shall not pose a navigational hazard in the waterbody.
9. The dock pilings shall be wrapped using a polymer coat that has been installed or treated
in a manner that will prevent the leaching of constituents contained in treated wood.
10. The structure shall be elevated a minimum of 5 feet above mean high water (except for the
ramp and terminal platform), and maintain 1/i inch spacing between the deck boards after
shrinkage, and have handrails along the entire perimeter.
11. Handrails shall be installed along the entire pier as the structure is constructed. Handrails
shall be installed as the structure is built and maintained functional for the life of the
facility.
12. The maximum draft of the vessel moored at the structure is 18- inches.
13. Mooring shall only be allowed in the (2) designated slip areas, as depicted on the
attached drawings.
14. Prior to construction of work authorized by this permit, the permittee shall provide
written notification of the date of commencement of construction to the Central District
Office of the Florida Department of Environmental Protection, 3319 Maguire Boulevard,
Suite 232. Orlando, FL 32803 -3767.
15. Within 30 days of completion of work authorized by this permit, the permittee shall
provide written notification of the date of completion of construction to the Central
District Office of the Florida Department of Environmental Protection, 3319 Maguire
Boulevard, Suite 232, Orlando, FL 32803 -3767.
16. The structure shall be constructed in compliance with the dimensions, configuration, and
construction notes as outlined in the attached drawing.
17. Liveaboards shall be prohibited at the docking facility. A liveaboard shall be defined as
a vessel docked at the facility that is inhabited by person or persons for any five
consecutive days or a total of ten days within a thirty-day period.
18. The following activities are prohibited at the facility:
a. Boat maintenance or repairs activities requiring removal of a vessel from the water or
removal of an major portions of the vessel, including the engine, for purposes of
routine repair or maintenance on site;

b. Hull cleaning involving the scraping or jet washing of fouling organisms;
c. Hull painting;
d. Any discharges or release of oils or greases associated with engine and hydraulic
repairs;
e. Discharges or release of metal based bottom paints associated with hull scraping,
cleaning, or painting.
19. No overboard discharges of trash, human or animal waste, or fuel shall occur.
20_ A Florida Fish and Wildlife Conservation Commission (FWC)- approved marina
educational program (which includes, at a minimum, permanent manatee educational
signs, speed zone booklets, and manatee educational brochures) shall be developed and
implemented by the permittee within 30 days prior to completion of construction, and
must be maintained for the life of the facility. The permittee will be responsible for the
cost of the educational material. This educational program shall be developed by the
permittee with the assistance of FWC, and approved by FWC prior to implementation.

21. The following Standard Manatee Conditions for In -Water Work (revision 2005) shall be
followed for all in -water activity:
STANDARD MANATEE CONSTRUCTION CONDITIONS
The Permittee shall comply with the following manatee protection construction
conditions:
A. The Permittee shall instruct all personnel associated with the project of the potential
presence of manatees and the need to avoid collisions with manatees. All
construction personnel are responsible for observing water - related activities for the
presence of manatee(s).
B. The Permittee shall advise all construction personnel that there are civil and criminal
penalties for harming, harassing, or killing manatees, which are protected under the
Marine Mammal Protection Act of 1972, The Endangered Species Act of 1973, and
the Florida Manatee Sanctuary Act.
C. Siltation barriers shall be made of material in which manatees cannot become
entangled, are properly secure, and are regularly monitored to avoid manatee
entrapment. Barriers must not block manatee entry- to or exist from essential habitat.
D. All vessels associated with the construction project shall operate at "no wake /idle"
speeds at all times while in the construction area and while in water where the draft

of the vessel provides less than a four -foot clearance from the bottom. All vessels
will follow routes of deep water whenever possible.
E. If manatee(s) are seen within 100 yards of the active daily construction/dredging
operation or vessel movement, all appropriate precautions shall be implemented to
ensure protection of the manatee. These precautions shall include the operation of
all moving equipment no closer than 50 feet of a manatee. Operation of any
equipment closer than 50 feet to a manatee shall necessitate immediate shutdown of
that equipment. Activities will not resume until the manatee(s) has departed the
project area of its own volition.
F. Any collision with and /or injury to a manatee shall be reported immediately to the
FWC Hotline at 1- 888 - 404 -FWCC. Collision and/or injury should also be reported
to the U.S. Fish and Wildlife Service in Jacksonville (1 -904- 232 -2580) for north
Florida or Vero Beach (1- 561 - 562 -3909) in south Florida.
G. Temporary Signs concerning manatees shall be posted prior to and during all
construction/dredging activities. All signs are to be removed by the Permittee upon
completion of the project. A sign measuring at least 3 ft. by 4 ft. which reads
Caution: Manatee Area will be posted in a location prominently visible to water
related construction res. A second sign should be posted if vessels are associated
with the construction, and should be placed visible to the vessel operator. The
second sign should be at least 8 1 /2" by 11" which reads Caution: Manatee Habitat.
Idle speed is required id operating a vessel in the construction area. All equipment
must be shutdown if a manatee comes within 50 feet of operation. Any collision
with and /or injury to a manatee shall be reported immediately to the FWC Hotline at
1- 888 - 404 -FWCC. The U.S. Fish and Wildlife Service should also be contacted in
Jacksonville (1904- 232 -2580) for north Florida or in Vero Beach (561 -562 -3909) for
south Florida.
22. At least one person should be designated as a manatee observer when in -water work is
being performed. That person should have experience in manatee observation, and be
equipped with polarized sunglasses to aid in observation. The manatee observer should be
on site during all in -water construction activities and will advise personnel to cease
operation upon sighting a manatee within 50 feet. The observer shall maintain a log
detailing sightings, collisions, or injuries to manatees, and finalize a report with FFWCC
within 30 days following completion of the project. Movement of the work barge, other
associated vessels, or any in -water work should not be performed at night, when the
possibility of spotting manatees is negligible.
23. Installation Requirements for Permanent Display
Within 30 days prior to completion of construction, the Permittee shall install and maintain
a permanent manatee signs that provide information on the characteristics of manatees and
the potential threat to this endangered species from boat operation. The number, type and
procedure for installation should be determined by the FWC, Imperiled Species

24. The issuance of this permit does not infer, nor guarantee nor imply that future permits, or
modifications will be granted by this Department. This permit does not infer authorization
from any other agency.
25. If the Permittee is found to be mooring more than the 2 vessels that are authorized in the
permit or vessels with drafts greater than 18- inches, the Department of Environmental
Protection may, at its option, terminate all consent to lease and use of state -owned lands
and order the removal of all structures and facilities located on state -owned lands at the
expense of the lease holder/grantee.
26. Mitigation to offset impacts and provide public benefit includes the enhancement of the
existing shoreline by planting Spartina alterniora and Rhizophora mangle along the
entire shoreline extending waterward from the mean high water line 10 feet. Spartina
alterniflora plugs or potted seedlings will be planted on 12 -18 -inch centers, and 15 red
mangroves (Rhizophora mangle) will be placed in staggered rows placed 3 -foot on center
as depicted on the attached Planting Plan (Attachment A).
27. Mitigation Enhancement Success Criteria:
Mitigation plantings (noted in condition 26 above) shall be deemed successful when the
following conditions are met;
a. Nuisance/Exotics (as listed in Attachment B) occupy less than 5 percent of the total
cover within the enhancement area;
b. Percent cover by non - nuisance, non - exotic (desirable) wetland species shall he 95
percent or greater within the remaining wetlands on the parcel. Percent cover shall
be reported for the aggregate of those wetland species, relative to the total area, bare
ground and water. A list of the wetland species included in the aggregate shall be
included. Wetland species shall be those listed in Florida Administrative Code
(F.A.C.) Rule 62 -340;
C. Wetland species shall be reproducing naturally in the ground, shrub and canopy
stratum;
d. The vegetation monitoring data for the wetland areas of the enhancement shows that
not less than 95 percent of the vegetation cover comprises of Rule 62 -340, F.A.C.
listed species.
The final success determination shall not be made less than five years from the completion
of implementation of the initial enhancement measures and when the above mentioned
criteria have been continuously met for a period of at least one growing season, without
intervention in the form of removal of undesirable vegetation.

28. Monitoring is required for at least 5 years after the initial planting time. If the outlined
activities are not 95 percent successful with desirable species, then replanting will be
required until the success criteria is met. The first monitoring report shall be submitted 34
days after the initial planting, and annually thereafter.
29. MITIGATION SITE MONITORING REPORTS REQUIRED:
The permittee shall furnish to the Central District annual status reports which describe in
detail the following:
a. status of construction (with a description of the extent of work completed since
previous report or since permit was issued);
b_ problems encountered and solutions undertaken;
C. anticipated work for the following year;
d. panoramic photographs taken from the same permanent stations (at least 2 stations
to be approved by the Department);
C. status of nuisance eradication_ on the parcel;
f. status of enhancement on the parcel;
g. herbicide listing and date of application;
h. percentage survival, density and cover trees and herbaceous species using
acceptable methods.
These methods are described in Daubemmire (1968), Oosting (1956), and Mueller -
Dombois and Ellenberg 1974).
The first monitoring report shall be submitted within 6 months of permit issuance and prior
to construction commencement_ The remaining monitoring reports shall be submitted
annually on the anniversary date of the permit, for five years after completion of
construction and all enhancement work. If work authorized in this permit does not start
immediately, the Permittee shall submit to the Department a site status letter as notification
that "No Work" has occurred. The site status letter is due within 6 months after permit
issuance and any additional site status letters shall be submitted on the anniversary date of
the permit.
The monitoring reports should include a cover page with the following information:
a. penmittee name;
b. permit number;
C. who performed the assessment;
d. signed and attested: "To the best of the undersigned's knowledge, this report
represents a true, accurate and representative description of the site conditions present at the
time of the monitoring."
Other information may be included by the penmittee at their discretion.

30. The Permittee shall monitor the submerged aquatic vegetation along the ingress/egress
route annually for the life of the facility. The Submerged Aquatic Vegetation monitoring
plan will include a baseline survey with transects within the route and along lateral lines
100 feet to the north and south of route. A minimum of 2 transects shall be established on
each side of the access route. Annual monitoring will be provided to the Department and
will be subject to verification by Department staff.
31. The permittee shall furnish to the Central District in Orlando annual Submerged Aquatic
Vegetation Monitoring Reports, as required in Specific Condition No. 30, of the resources
within the route and along lateral lines 100 feet to the north and south of route. Acceptable
methods may be found in Daubenmire (1968), Green (1979), Grieg -Smith (1983),
Mueller- Dombois and Ellenberg (1974), Oosting (1956), Poole (1974), and Southwood
(1978). It is the responsibility of the permittee to ensure that the monitoring report
provides qualitative and quantitative depictions of the sites that are representative of the
conditions along the entire access route.
The Baseline Report and annual statistical reports shall include percent coverage, canopy
height, shoot counts and epiphyte loading. The reports shall include aerial photographs and
those taken from the permanent stations in the vegetation monitoring area. Data for any
nuisance species present shall be tabulated separately from the remaining data Data shall
be taken during the summer growing season (April through August). Reports shall be
submitted annually within 60 days of data acquisition for the life of the facility. The
Permittee shall demonstrate that the health of the resourccs based on the required criteria is
statistically equivalent to or grater than the adjacent resources.
If it is determined by Department staff, based on visual inspection and review of the
monitoring reports that the ingress/egress area is statistically different than the adjacent
seagrass beds, the permittee shall present methods and proposals to be reviewed and
approved by the Department within 60 days of the Department's notification to ensure
further degradation of the vegetation does not occur. The plan of corrective actions shall
be implemented within 60 days of tivritten approval by the Department.

32. Baseline and Annual Submerged Aquatic Vegetation Monitoring Reports
Annual Submerged Aquatic Vegetation Reports shall be submitted annually to the DEP
Central District Office, 3319 Maguire Blvd., Suite 232, Orlando, Florida 32803. The cover
page shall indicate the permit number, project name and the permittee name. The baseline
report shall be submitted prior to any mooring at the docking facility, and the annual
reports shall be submitted one year from the date of permit issuance, and reports shall
continue for the life of the facility. The report shall include the following information:
Annual statistical reports shall describe as appropriate those parameters quantified as
indicators, in accordance with the requirements of Specific Condition No. 31. The
monitoring reports should include a cover page with the following information:
a. permittee name;
b. permit number;
C. who performed the assessment;
d. signed and attested: "To the best of the undersigned's knowledge, this report
represents a true, accurate and representative description of the site conditions present at the
time of the monitoring"
Other information may be included by the permittee at their discretion.
33. The Permittee shall place floating buoys to delineate the ingress/egress route. The buoys
shall be marked with FDEP Permit No. 31- 243941 -001 and shall be maintained for the life
of the facility.
34. The Permittee shall provide a warranty deed to the Board of Trustees for approximately 0.2
acres of privately -owned submerged lands located waterward of the seawall at the subject
parcel, as depicted on permit attachment B, prior to receipt of a fully executed lease.
35. The Permittee shall implement a free education program to take a minimum of 250 children
annually out on the water and educate them about the value of the Lagoon and the Aquatic
Preserve. The program shall be developed and implemented by the permittee within 30
days prior to completion of construction, and must be maintained for the life of the facility.
The permittee will shall submit a yearly log to the Department with the dates of the tour
and the number of children that were provided the free tour.
36. This permit authorizes the Hurricane Queen and Harbor Princess II, as described in the
application, to moor at the subject docking facility. Those vessels shall be used for the
sole purpose of providing eco -tours to the general public. The mooring of any other boat
will require a modification of the permit and lease. The draft of these vessels shall be a
maximum of 18- inches below the water line.
37. A portable sewage pumpout unit shall be provided and operable prior to the use of the
subject docking facility.
38. The sewage pumpout unit shall be maintained and operable for the life of the facility.

GENERAL CONDITIONS FOR AUTHORIZATIONS

Chapter 18- 21.004(7), F.A.C., provides that all authorizations granted by rule or in writing under
Rule 18- 21.005, F.A.C., except those for aquaculture activities and geophysical testing, shall be
subject to the general conditions as set forth in paragraphs (a) through (1) below. The general
conditions shall be'part of all authorizations under this chapter, shall be binding upon the
grantee, and shall be enforceable Under Chapter 253 or Chapter 258, Part II, F.S.
Chanter 18- 21.004(7), F.A.C.. General Conditions for Authorizations:
(a) Authorizations are valid only for the specified activity or use. Any unauthorized deviation
from the specified activity or use and the conditions for undertaking that activity or use shall
constitute a violation. Violation of the authorization shall result in suspension or revocation of
the grantee's use of the sovereignty submerged land unless cured to the satisfaction of the
Board.
(b) Authorizations convey no title to sovereignty submerged land or water column, nor do they
constitute recognition or acknowledgment of any other person's title to such land or water.
(c) Authorizations may be modified, suspended or revoked in accordance with their terms or the
remedies provided in Sections 253.04 and 258.46, F.S., or Chapter 18 -14, F.A.C.
(d) Structures or activities shall be constructed and used to avoid or minimize adverse impacts
to sovereignty submerged lands and resources.
(e) Construction, use, or operation of the structure or activity shall not adversely affect any
species which is endangered, threatened or of special concern, as listed in Rules 68A- 27.003,
68A- 27.004, and 68A- 27.005, F.A.C.
(f) Structures or activities shall not unreasonably interfere with riparian rights. When a court of
competent jurisdiction.determines that riparian rights have been unlawfully affected, the
structure or activity shalt be modified In accordance with the court's decision.
(g) Structures or activities shall not create a navigational hazard.
(h) Structures shall be maintained in. a functional condition and shall be repaired or removed if
they become dilapidated to such an extent that they are no longer functional. This small not be
construed to prohibit the repair or replacement subject to the provisions of Rule 18- 21.005,
F.A.C., within one year, of a structure damaged in a discrete event such as a storm, flood,
accident, or fire..
(i) Structures or activities shall be constructed, operated, and maintained solely for water
dependent purposes, or for non -water dependent activities authorized under paragraph 18-
21.004(1)(f), F.A.C., or any other applicable law.

SPART17VA PLANTING PLAN
Spartina alternii fora will be planted in an area facing the existing seawall along the entire
shoreline of the applicant's property. The proposed planting area lies along
approximately 103 feet of shoreline, and extends from MHWL (e)isting seawall) seaward
10 feet. Spartina plugs or potted seedlings will be planted using 12" — 18" on center
spacing. The planting plan also includes 15 red mangroves (Rhizophora mangle) to be
planted in an Offset pattern using 3 foot on center spacing along the shore in the existing
shoreline restoration area south of the seawall. The attached Plan View Drawing for
planting shows:
a.) MHWL and MEWL;
b.) Plantings referenced to both MHWL and MLWL, distance in feet;
c.) The uplands and existing seawall;
d.) Dimensions of the planting area;
e.) Water depths within the planting area, taken from MHWL, then
waterward every 2 feet.

➢ the adverse effects exotic pest plants have on Florida's biodiversity and plant
communities,
➢ the habitat losses from exotic pest plant infestations,
D the impacts on endangered species via habitat loss and alteration,

it has not "become" native). fnvasiw exotic —an exotic that not only has naturalized but is expanding on
its own in Florida plant communities.
