SUMMARY
Attached is the latest notice submitted to Fisherman's Landing Sebastian. The office of the City
Manager remains in constant communication with FCT and FLS regarding modifications to the
operations. A more formal update will be provided at the meeting with staff recommendation.

RE: COMPLIANCE POINTS—FISHERMAN'S LANDING SEBASTIAN (FLS)
1540 INDIAN RIVER DRIVE
Dear Mr. Adams:
On September 27, 2011, the City of Sebastian received notice from the State of Florida
(FCT) listing operational noncompliance problems at 1540 Indian River Drive. Since the
issuance of the Warning Notice, the City, FLS and FLS subtenants have discussed the
matter. These discussion points have been shared with representatives from the State
and with Sebastian City Council. Subject to approval by the FCT and City Council, you
are hereby notified to make the following operational adjustments at 1540 Indian River
Drive to avoid potential state action.
FRESH FROM FLORIDA MEMBERSHIP - Food service activity needs to highlight
Florida seafood, especially the Florida seafood that is available at the adjacent seafood
market. Both the seafood market and eatery should become members of Fresh from
Florida and display Fresh from Florida materials.
MUSIC - The playing of live music, such as live bands, DJ's or karaoke, is prohibited
unless governed by a Temporary Use Permit issued by tI a City. Such Temporary Use
Permit will only be issued to FLS. FLS will be required;to manage any special event
under the guidance that such event shall be in support of the"Working Waterfront".
FOOD SERVICE - Food service on site shall not be refgrenced as a restaurant. The
food serving activity at the site shall be identified by keeping with the nature of a seafood
shack, seafood eatery or seafood café.
OUTSIDE DEC=SERVICE/DECK "TIKI BAR" — Service! on the outside deck and "tiki
bar" area is prohibited unless a special event is being conducted by FLS. In that event,
it will be required that FLS receive a Temporary Use Permit issued by the City. Such
Temporary Use Permit will only be issued to FLS when FLS displays that the event will
be in support of the "Working Waterfront". Further, at anytime television screens or
similar projections are to be used on the outside deck, it must be limited to support of
"Working Waterfront".
"BAR" AND "RESTAURANT" REFERENCE - All reference to "bar" and "restaurant"
shall be prohibited and all reference to the same shall be removed from the site plan to
be
prepared.
CREATION OF SERVICE COUNTER - The "old bar area" shall be identified and
function coon as a food service counter with sit-down food service. There shall be no more
than 10 stools at the service counter.
TABLE SEATING —There shall be no more than six (6) tables that have a maximum
seating capacity of twenty-four(24) persons. These tables shall be located in the eatery
portion of the facility as identified on the site plan.
SITE PLAN—The City shall partner with FLS to develop a site plan as directed by FCT.
The site plan shall be made part of the lease, sublease(s) and business plan which shall
be reviewed and approved by FCT and City Council.
The parties also discussed other adjustments that are not compliance issues. These
include:
BUSINESS PLAN AMENDMENT — FCT is requiring that the City amend the Working
Waterfront Business Plan. City and FLS will collaborate to redevelop bench mark dates
for the completion of other amenities to be developed at the sites. Other amenities
include, but are not limited to museum, renovation of the fish house, construction of the
ice house, decks linking the facilities together, and "touch pool".
EDUCATIONAL TOUR RECOGNITION—FLS acknowledges that, from time to time, the
facilities may host educational field trips. At such event, FLS shall not have for
consumption, on display or dispense beer or wine.
HOURS OF OPERATION AT THE EATERY - The parties agree to discuss
modifications to the operational hours at the eatery when the lease and site plan
documents are addressed.
Please ensure that actions are taken to correct the identified compliance points by no
later than October 27, 2011. Failure to meet this deadline will result in a notice of
violation being issued to FLS. Should you have any questions concerning this matter,
