RE: City of Sebastian Working Waterfront
Fisherman's Landing
Dear Mr. Gelhardt:
I want to thank you for your prompt attention to forwarding to me the comments that you and
your staff had which were forwarded to Mr. Al Minner the other evening. The comments
helped to set an agenda for the meeting which was scheduled for all of the local parties on
the morning of October 5h. That meeting was well attended and very beneficial for all
concerned and lasted more than 2 hours. Particularly encouraging is the fact that each side
was exchanging ideas and discussing options and understandings with the others. Because
of the numerous factors, as well as the need for virtually all of the parties to get further
consultation and possible changes to the management plan as well as the sublease between
Fisherman's Landing, Inc. and Fisherman's Landing Restaurant did not reach any final
written agreement. However, I do not think it to be a misstatement that the parties are
significantly on their way to an amiable resolution which would be presented to your office
for consideration and approval.
The areas where the parties appear to be in conceptual agreement, subject to working out
language for the management plan and any lease addendum as applicable for your
consideration include the following:
(1) There would not be live bands,DJs or karoke except upon days
agreed upon by City of Sebastian or specially issued Special Events Permit.

The days would include all national holidays, and yet to be determined other
days that are common for the public to plan special events;
(2) There would no longer be a tiki bar. All of the stools would be
removed from around it and it would be utilized on only designated periods
including special events for counter service to place orders and pick up food
and beverages;
(3) The TV would be removed from the area of the outside service
counter. Any use of a television screen on the exterior deck area would only
be as associated with education pertaining to commercial fishing, Florida
seafood or upon a special fund raiser for purposes of continuing and
preserving the project or in connection with a special event that centers upon
a television experience (definitely not routine weekly sports events);
(4) There will not be more than forty-nine seats allowed at inside
tables or an inside bar/counter service. Any other areas, or persons not seated
may obtain food and beverages through the inside counter order location;
The parties are envisioning exchanging drafts of necessary documentation in the next few
days and any other necessary discussions to continue. It is hoped that a joint proposal may
be presented for the Florida Communities Trust's consideration within the next ten(10)days
or so. It is sincerely hoped that the showing of efforts being undertaken by all concerned
will,if not fully resolved on or before October 27,2011,that the State will grant further time
to the City of Sebastian before making any determination under your letter of any compliance
issues.
