Dear Mr. Minner:
The draft proposal to address the September 27, 2011, letter has been reviewed by staff and the Division
Director. Overall the proposal looks good; however,we do have the following comments:
• The focus of the menu should be Florida Seafood, and this should be reinforced in any subsequent
documents.
o Both the seafood market and food service operation should become a "Fresh From Florida"
member, if they aren't already a member.
o Both the seafood market and food service operation should stock"Fresh From Florida"
material, which is available online at www.fl-seafood.com.
• In keeping with the concept of a seafood market offering food service, there should not be
televisions located in the outdoor deck area or at the Tiki bar. This type of activity tends to suggest
a full service restaurant and bar motif, which is not the intent.
• The discussion regarding outdoor music should also preclude karaoke and DJ's.
• It needs to be clear that a "special use permit" is not something the lessee can request every
weekend; please provide some clarification on how this would work.
• It needs to be clear that the tables and chairs that are located in the common area are for use by
the general public and not reserved for restaurant customers.
We are still reviewing the lease and subleases to bring them into compliance. Once our review is completed we
will contact you to discuss what actions are needed.
Thank you for your attention to this matter. Should you have any questions, please feel free to contact me.
