After review of the First Amendment of the Lease between Martin County (County)
and the Pt. Salerno Commercial Fishing Dock Authority (Authority), I was able to
DUNCAN BALLANTYNE calculate the adjustments. This First Amendment now splits the cost of the submerged
County Administrator land lease between the Authority and the County. The Authority's share is about 69%
STEPHEN FRY and the County's share is about 31%.
County Attorney
As requested by Sarah Woods, Esq., we would not request December's payment of rent
until this Amendment was approved by the Board of County Commissioners. Also,
Ms. Woods requested that I credit the Authority's overpayments back to the date of the
original lease and apply the credit to the current amount owed. Currently, you have a
credit of$5,398.96.
Your semi-annual payment due in December 2005 has been adjusted to $3,831.57.
This leaves the Authority with a credit of$1,567.39 ($5,398.96 - $3,831.37 =
$1,567.39). The next semi-annual payment will be due in July 2006 in the amount of
$3,831.57. After applying the remaining $1,567.39 the Authority will only owe
$2,264.18 in July 2006. ($3,831.57 - $1,567.39 = $2,264.18).
From that point on both the Authority and the County will be whole. Semi-annual rent
payments from the Authority will continue based upon a 69%/31% split of the cost of
the submerged land lease from the State.
