I am in receipt of your letter dated April 10, 2013 requesting additional information regarding the City of
Sebastian's FY 13/14 Waterways Assistance Program - Grant Application. Through that letter you
requested that the City respond to seven additional questions. Enclosed are those responses and
attached are modifications for grant forms E -3, E-4 and E -5.
Please let me know if these responses makes our application complete and ready for review by the
Board. Thanks for your assistance through this process.
Question #1 - The City has removed the request for landscape and preliminary engineering services. By
making this change, no funds will be expended on items occurring prior to October 1, 2013 or for ineligible
expenses. This action reduces our grant request from $166,600 to $157,350. Forms E -3 and E-4 have
been modified to reflect the changes.
Question #2 - This response further verifies that there are no requests for pre- agreement expenses
Question #3 - Form E-4 - question 5(c) - has been modified to reflect that while City forces will be used to
bring down overall project costs, in -kinds services will not be requested to reimburse the City for
personnel or equipment costs. This change is reflective in the Project Budget on form E -5.
Question #4 - Joe Griffin has previously delivered to you a correspondence between the FDEP and COS
stating that DEP permits are NOT required for the fish house rehabilitation. Please keep in mind that
local building permits will be required.
Question #5 - Joe Griffin has previously delivered to you a copy of the latest lease between the City of
Sebastian and Fisherman's Landing Sebastian, Inc.
Questions #6 - Please see the City's response on form E-4 question #5(d). That response indicates that
FLS will control vessel lease and wholesale fees. Those fees are to remain market driven and used for
capital improvements or perpetual maintenance at the site.
Question #7 - Joe Griffin has previously delivered a copy of the City's submerged lands lease.

1. Collectively, the Indian River County area requests total approximately $287,000 more than the
anticipated maximum assistance funding available to the Indian River County area through this
program, this year. We may be asking you later in the process, if necessary, to work with your
local FIND Commissioner to assist in the prioritization or modification of the applications to
meet the funding limitation.
2. Please note that due to the significant resources necessary for the District's primary mission
(maintenance of the Intracoastal Waterway) within the next few years, the overall assistance
program budget may be subject to additional funding reductions through subsequent Board
actions.
3. Please note that due to fluctuating tax revenues, the assistance program budget could be reduced
to meet any significant decreases in revenue.

District.
The Sebastian grant proposal provides direct access to the ICW by creating a working waterfront
destination point. First, the project provides a location for licensed Florida commercial fishermen to
dock their vessels. Second, it provides a location for commercial fishermen to ice and prepare their
catch for market. Finally, the proposal makes the working waterfront a destination point in the
Sebastian Community Redevelopment Agency (CRA) district.
b) How does the project benefit public navigation or access to the ICW or adjoining
waterways?
The project creates a working waterfront which benefits commercial fishermen and the general public.
The location of the project is Sebastian, Florida possesses special qualities because it is (1) home to
Pelican Island, the first national Wildlife refuge; (2) an historic fishing community; and (3) located
with immediate access to the Sebastian Inlet and the ICW.

3) PUBLIC USAGE & BENEFITS:
a) How is the public usage of this project clearly identified and quantified?
This site is currently in use by the public as a working waterfront and fresh fish market, therefore, it is
already locally known and utilized. However, a few major concepts have not been fully developed due
to a lack of funding. It is anticipated that by completing all project goals — (1) a functioning working
waterfront; (2) seafood market; (3) seafood eatery; and, (4) commercial fishing museum — the location
will become a destination point. In so doing, public usage and identification can be measured. This
question is answered in additional detail in item 3.C.
b) Discuss the regional and local public benefits and access that will be provided by the project.
FIND grant funds will assist the Sebastian Working Waterfront benefit the public in two major ways.
First, funds will complement the goal of the Stan Mayfield grant, by rebuilding a historic over -water
fish house. This facility will provide licensed commercial fishermen with a location to ice and prepare
fresh catch for market. Second, the project offers the general public educational opportunities to
witness commercial fishing operations through the visitor observation areas that will be part of the fish
house and historic museum.
c) Estimate the amount of total public use.
Public use will be quantifiable in the following ways:
➢ Revenue generated from slip rentals to licensed Florida commercial fishermen;
➢ Tonnage of product sold from the working waterfront;
➢ Sales from the eatery and fish market; and,
➢ Visitor and program counts at the museum and over -water fish -house (There will be no visitor
admission for the general public).
d) Can residents from other counties of the District reasonably use the project? Explain.
Absolutely. All licensed Florida commercial fishermen will have equal opportunity to deliver product
to the working waterfront or use the facility. With regard to the general public, the Sebastian Working
Waterfront's primary goal is to be a destination point. The Working Waterfront is located in the
Sebastian Community Redevelopment Agency (CRA) district. As such, the working waterfront seeks
local and non -local tourism and eco- tourism dollars to help (1) address blight and redevelopment
within the community's waterfront district; and, (2) revitalize the local business economy.

The City of Sebastian Working Waterfront proposal is in a position to quickly and effectively get

There are two unique aspects that may influence the project timeline:
➢ Permitting — Currently, the site is in operation under FDEP submerged lands lease #310006484.
Permitting may be an area that could delay the proposed timeline.
➢ Construction — While the refurbishment of the project seems uncomplicated, delays in construction
are unforeseen. The timeline allocates six months for construction.

5) COSTS & EFFICIENCY:
a) List any additional funding sources and the status and amount of the corresponding funding
that will be utilized to complete this project.
The City of Sebastian Working Waterfront proposal seeks to share the cost of constructing the fish
house renovation. The City will provide a 50% cash match. Concerning another portion of the
working waterfront - the historical museum - the City has applied for a $10,000 FDEP CPI grant
which will be used to purchase museum equipment and a DVD kiosk display.
b) Identify and describe any project costs that may be increased because of the materials
utilized or specific site conditions.
The City received an engineer's estimate in the amount of approximately $300,000 to complete
construction on the project. It is not anticipated that cost will overrun the estimate. If costs exceed
estimates, the City is prepared to absorb any project overruns.
c) Describe any methods to be utilized to increase the cost efficiency of this project.
The City has planned for the project to be constructed by an outside contractor, procured through the
City's purchasing policies. The City is also planning to provide in -kind services (labor and equipment)
to reduce the cost of the project. Such in -kind services will include demolition of existing structures,
as well as construction of pedestrian decks and boardwalks needed to serve the working waterfront. In
providing these in -kind services, the City has not charged the project for the cost of personnel and
equipment (this is displayed in the project budget on form E -5). Rather, the in -kinds services are
aimed to reduce overall project costs.
d) If there are any fees associated with the use of this facility, please detail. In addition, please
provide a listing of the fees charged by similar facilities, public and private, in the project
area.
There are no public fees for the use of the facility. Through the lease agreement between the City of
Sebastian and Fisherman's Landing Sebastian, Inc. (FLS), FLS will control pricing for the working
waterfront. It is anticipated that commercial fishermen will pay $8.00 per boat foot for slippage and a
market rate per pound for wholesale fish. These revenues will then be used to fund future capital
improvements and /or operation /maintenance at the working waterfront facility. The City will ensure
that pricing for working waterfront operations does not provide an economic advantage to one
waterfront over another. The general market for Sebastian can be considered a range of pricing from
Fort Pierce to Southern Brevard County.

6) PROJECT VIABILITY:
a) Does the project fill a specific need in the community or is it consistent with an existing
maritime management plan?
The project fills a community need in the following ways:
➢ It provides a stimulus to the Florida commercial fishermen by providing alternatives to dock their
vessels and sell their catch in a location that has quick and easy access to the ICW and the
Sebastian Inlet.
➢ The project addresses the removal of blight in a recognized CRA, which will benefit local business
within Sebastian's waterfront district.
➢ The project is open to the general public to learn about Sebastian's commercial fishing heritage,
purchase seafood products and enjoy the benefits /ambiance of the Indian River Lagoon.
b) Clearly demonstrate how the project will continue to be maintained after District funding is
completed.
Through the lease between the City and FLS, FLS will have responsibility to maintain and operate the
docks and fish house. It is estimated that dockage and wholesale fish sales revenues will generate
$75,000 annually with expenses of $60,000. The City will pay to insure all properties for liability and
casualty requirements.
c) Will the program result in significant and lasting benefits? Please describe any
environmental benefits associated with this project.
Yes, as described within the application, the project seeks to improve public, commercial and
industrial waterway access.

There are no major impediments to consider in completing this project. Area(s) where potential delays
may arise are (1) FDEP modification to the existing permit; (2) construction permitting though the City
of Sebastian Building Department; and, (3) construction. Through the ongoing process of managing
the working waterfront, the City is of the opinion that the basic design and preliminary permit
investigation is complete. The only delay in moving the project forward has been funding for the fish
house.

As a recipient of the Stan Mayfield Working Waterfront Grant, the City of Sebastian seeks grant funding from FIND's 2013
Waterways Assistance Program to complete the community's Working Waterfront Rehabilitation Project.
Sebastian has a rich commercial fishing history. In its heyday, Sebastian was home to
nineteen fish houses along the Indian River Lagoon. Today, however, the fishing
industry struggles due to a number of factors. In response, the City of Sebastian has
undertaken a project to redevelop a historic working waterfront in order to benefit
licensed Florida commercial fisherman, local business owners and the general public.
Specifically the project has three goals. First, it seeks to rebuild an historic over -water
fish house (pictured here) to provide commercial fishermen a place to dock vessels
and prepare /wholesale their catch in close proximity to the ICW and Sebastian Inlet.
Second, the project seeks to provide the public general access to the working
waterfront for educational and retail purposes. Third, because the working waterfront is located in the Sebastian
Community Redevelopment Agency (CRA) District, the project is a destination point that seeks to remove blight from the
waterfront area and generate economic activity.

3) PUBLIC USAGE & BENEFITS:
a) How is the public usage of this project clearly identified and quantified?
This site is currently in use by the public as a working waterfront and fresh fish market, therefore, it is
already locally known and utilized. However, a few major concepts have not been fully developed due
to a lack of funding. It is anticipated that by completing all project goals - (1) a functioning working
waterfront; (2) seafood market; (3) seafood eatery; and, (4) commercial fishing museum - the location
will become a destination point. In so doing, public usage and identification can be measured. This
question is answered in additional detail in item 3.C.
b) Discuss the regional and local public benefits and access that will be provided by the project.
FIND grant funds will assist the Sebastian Working Waterfront benefit the public in two major ways.
First, funds will complement the goal of the Stan Mayfield grant, by rebuilding a historic over -water
fish house. This facility will provide licensed commercial fishermen with a location to ice and prepare
fresh catch for market. Second, the project offers the general public educational opportunities to
witness commercial fishing operations through the visitor observation areas that will be part of the fish
house and historic museum.
c) Estimate the amount of total public use.
Public use will be quantifiable in the following ways:
➢ Revenue generated from slip rentals to licensed Florida commercial fishermen;
➢ Tonnage of product sold from the working waterfront;
➢ Sales from the eatery and fish market; and,
➢ Visitor and program counts at the museum and over -water fish -house (There will be no visitor
admission for the general public).
d) Can residents from other counties of the District reasonably use the project? Explain.
Absolutely. All licensed Florida commercial fishermen will have equal opportunity to deliver product
to the working waterfront or use the facility. With regard to the general public, the Sebastian Working
Waterfront's primary goal is to be a destination point. The Working Waterfront is located in the
Sebastian Community Redevelopment Agency (CRA) district. As such, the working waterfront seeks
local and non -local tourism and eco- tourism dollars to help (1) address blight and redevelopment
within the community's waterfront district; and, (2) revitalize the local business economy.

There are two unique aspects that may influence the project timeline:
➢ Permitting — Currently, the site is in operation under FDEP submerged lands lease #310006484.
Permitting may be an area that could delay the proposed timeline.
➢ Construction — While the refurbishment of the project seems uncomplicated, delays in construction
are unforeseen. The timeline allocates six months for construction.

5) COSTS & EFFICIENCY:
a) List any additional funding sources and the status and amount of the corresponding funding
that will be utilized to complete this project.
The City of Sebastian Working Waterfront proposal seeks to share the cost of constructing the fish
house renovation. The City will provide a 50% cash match. Concerning another portion of the
working waterfront — the historical museum - the City has applied for a $10,000 FDEP CPI grant
which will be used to purchase museum equipment and a DVD kiosk display.
b) Identify and describe any project costs that may be increased because of the materials
utilized or specific site conditions.
The City received an engineer's estimate in the amount of approximately $300,000 to complete
construction on the project. It is not anticipated that cost will overrun the estimate. If costs exceed
estimates, the City is prepared to absorb any project overruns.
c) Describe any methods to be utilized to increase the cost efficiency of this project.
The City has planned for the project to be constructed by an outside contractor, procured through the
City's purchasing policies. The City is also planning to provide in -kind services (labor and equipment)
to reduce the cost of the project. Such in -kind services will include demolition of existing structures,
as well as construction of pedestrian decks and boardwalks needed to serve the working waterfront.
d) If there are any fees associated with the use of this facility, please detail. In addition, please
provide a listing of the fees charged by similar facilities, public and private, in the project
area.
There are no public fees for the use of the facility. Through the lease agreement between the City of
Sebastian and Fisherman's Landing Sebastian, Inc. (FLS), FLS will control pricing for the working
waterfront. It is anticipated the commercial fisherman will pay $8.00 per boat foot for slippage and a
market rate per pound for wholesale fish. These revenues will then be used to fund maintenance and
operation of the facility. The City will ensure that pricing for working waterfront operations does not
provide an economic advantage to one waterfront over another. The general market for Sebastian can
be considered a range of pricing from Fort Pierce to Southern Brevard County.

maritime management plan?
The project fills a community need in the following ways:
➢ It provides a stimulus to the Florida commercial fishermen by providing alternatives to dock their
vessels and sell their catch in a location that has quick and easy access to the ICW and the
Sebastian Inlet.
➢ The project addresses the removal of blight in a recognized CRA, which will benefit local business
within Sebastian's waterfront district.
➢ The project is open to the general public to learn about Sebastian's commercial fishing heritage,
purchase seafood products and enjoy the benefits /ambiance of the Indian River Lagoon.
b) Clearly demonstrate how the project will continue to be maintained after District funding is
completed.
Through the lease between the City and FLS, FLS will have responsibility to maintain and operate the
docks and fish house. It is estimated that dockage and wholesale fish sales revenues will generate
$75,000 annually with expenses of $60,000. The City will pay to insure all properties for liability and
casualty requirements.
c) Will the program result in significant and lasting benefits? Please describe any
environmental benefits associated with this project.

the working waterfront, the City is of the opinion that the basic design and preliminary permit
investigation is complete. The only delay in moving the project forward has been funding for the fish

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEBASTIAN, FLORIDA,

WHEREAS, the City of Sebastian, Florida is interested in carrying out the following
described project for the enjoyment of the citizenry of our community and the State of Florida:

Florida Inland Navigation District in the amount of fifty percent (50 %) of the actual cost of the
project on behalf of the City of Sebastian, Florida.
AND, be it further resolved by the City of Sebastian that it certifies to the following:
1. That it will accept the terms and conditions set forth in FIND Rule 66B -2 F.A.C. and
which will be a part of the Project Agreement for any assistance awarded under the
attached proposal.
2. That it is in complete accord with the attached proposal and that it will carry out the
Program in the manner described in the proposal and any plans and specifications
attached thereto unless prior approval for any change has been received from the
District.

that the project will be operated and maintained at the expense of the City of
Sebastian for public use.
4. That it will not discriminate against any person on the basis of race, color or national
origin in the use of any property or facility acquired or developed pursuant to this
Form No. 90 -21 (Effective date 12- 17 -90, Rev. 10- 14 -92)
proposal, and shall comply with the terms and intent of the Title VI of the Civil
Rights Act of 1964, P. L. 88 -352 (1964) and design and construct all facilities to
comply fully with statutes relating to accessibility by handicapped persons as well as
other federal, state and local laws, rules and requirements.
5. That it will maintain adequate financial records on the proposed project to substantiate
claims for reimbursement.
6. That it will make available to FIND if requested, a post -audit of expenses incurred on
the project prior to, or in conjunction with, request for the final 10% of the funding
agreed to by FIND.
