Attorney, Robert Ginsburg, and City Manager, Al Minner.

The Chairperson called the Sebastian Canvassing Board meeting to order at 4 pm.
The October 30 and October 31, 2013 Canvassing Board minutes were approved on motion by
Mr. Minnner and second by Mr. Ginsburg with a voice vote of 3 -0.
The Canvassing Board met to review any remaining questionable absentee ballots, but none
required review. Recess was called at 4:30 pm to await the poll closings at 7 pm. Dinner was
provided in the SOE warehouse at 5:30 pm. All members of the Canvassing Board individually left
the SOE office during the recess. At 6:30 pm one more absentee ballot was hand delivered and
opened by Absentee Ballot coordinator Trisha Verdugo as witnessed by Canvassing Board
Member Ms. Maio. It was added to the absentee count.
The Canvassing Board moved to the tabulating room for vote counts after the close of the polls at
7 pm. Absentee vote count was tabulated, initialed by each member of the Board (see copy
attached), with results not released until after 7 pm. The #2 report with 2 of 4 precincts was
initialed by each member of the Board (see copy attached), and the #3 report - unofficial
cumulative total for 4 of 4 precincts was initialed by each member of the Board (see attached).
The Supevisor of Elections advised the Boards that they could wait for review of provisional
ballots from the polling places by her staff and a final certification could be completed so they
would not have to return on November 7d' for provisional review.
After the #3 report was submitted, a member of the press asked if a recount was to be conducted
due to the close number for the third and fourth vote numbers.
The Canvassing Board met with the Supervisor of Elections, and based on the number of votes
being less than a half of a percent of the total votes cast (at that time 6188 on report #3), it was
decided that a machine recount was required by Florida law. It was decided that the recount
would have to take place after notification of all candidates and notice of the recount was
provided. The recount was to take place on Thursday, November 7, 2013 at 9 am in the SOE
Office, unless the candidate receiving the fourth highest number declined the recount. The City
Manager called each candidate to advise them of the anticipated recount. Candidate Don Wright
indicated that he may decline the recount but would provide a written statement the next morning.
SOE staff provided one provisional ballot to the Board for review. The voter had forgotten her ID
at the polls, but her signature matched the signature on file in the SOE office so the vote was
accepted. This changed the total votes cast for the election to 6191, but did not change the
requirement for the Canvassing Board to order a machine recount.
A copy of report #4 showing the cumulative totals including the provisional count is attached.
The City Manager drew a card from a hat to pick a precinct for the manual audit to be held on
November 12v'. He drew Sebastian precinct 10.
The Canvassing Board Meeting adjourned at 8:55 pm.
For the record: Candidate Don Wright submitted a letter to Canvassing Board member Sally Maio
on Wednesday, November 6, 2013 declining a machine recount (see attached. This letter and
notification was provided by email by Ms. Maio to SOE, all candidates, Canvassing Board
members, City Council and the press. They were notified that a recount would not take place and
that the Canvassing Board would certify the results the next morning on November 7, 2013 at 9
am in the Supervisor of Elections office.
The Canvassing Board signed the Certificate of Canvassing Board, certifying the results of the
November 5, 2013 election on Thursday, November 7, 2013 at 9 am in the Supervisor of
Elections Office (see attached). The Supervisor of Elections provided her notes on the recount
issue to the Canvassing Board for their records.

Hi Sally:
I am comfortable with the posted results of the election and am not seeking a recount. The City will be
well served by the newly elected council members and existing members of council. Actually, I am
pleased to be able to take some time off from my activities on council and other related responsibilities.
But, I do want to be kept up -to —date by email on what is going on in the City so would appreciate being
added to the public distribution of council agendas, minutes and other pertinent information that is
normally distributed.

RECOUNT CALCULATION
1) Add the total number of votes for each candidate in the race
2) Multiply the total number of votes by 5% (.005)
3) If the number is less that .5 %, than a machine recount is required
4) Alternate method — subtract the % amounts, if less than .5 %, than a
machine recount is required
