MOTION by Ms. Coy and SECOND by Mr. Adams, that we move for a continuation until Monday, December 2nd at 6 pm when there can be a full complement of Council to make this decision, that he also put an investment in. Narrative of proposed action: Sebastian Inlet Marina & Trading Co. (Captain Hiram's), represented by Tom Collins, is planning to add a new two -story 16 -unit motel to their resort site. In the design phase of this project, a number of issues have been identified which do not meet City code. Although some issues have been resolved, the applicant is seeking two variances from setback code, two variances from landscape code and two variances from design criteria for parking areas. b. Staff Comments: New Parcel — 12,271 SF (.28 acres) Entire Parcel — 217, 690 SF (5 acres) vacant public water public sewer In regards to past development of the Sebastian Inlet Marina and Trading Co. properties, on January 4, 2000, Captain Hiram's Key West Inn site plan was granted a variance to allow their canopy tree requirement to be made up of 10 hardwoods with the remainder, 80 %, to be palms. This allowed an exception to the code that limits palms to no more than 35% of the total tree requirement and no single tree species to more than 50% of the total number of trees. A copy of the conceptual site plan has also been provided, as well as a letter of support from Oyster Point & Oyster Bay Resort. 9. Board Action: Conduct quasi-judicial hearing to consider the requested variances. epared by J Ki g, Senior Planner Community Development Department //- lV- 13 Date 3 7of13 BOARD CRITERIA FOR DETERMINING VARIANCES Section 54 -1 -2.5 Six variances have been requested, including two for setbacks, two for landscape issues, and two for design criteria as listed below: (1) Variance from Section 54- 2- 5.5(d)(6) — Reduction of side yard setback from 5 feet to 2.5 feet. (2) Variance from Section 54- 2- 5.5(d)(6) — Reduction of front yard setback from 10 feet to 5 feet. (3) Variance from Section 54- 3- 14.11(b)— Reduction of the perimeter landscape strip along the north property line from 10 feet to 2.5 feet. (4) Variance from Section 54- 3- 14.11(b) — Elimination of the perimeter hedge requirement along the north property line. (5) Variance from Section 54- 3- 10.6(a)(5) — Reduction of the drive aisle width from 25 feet to 21 feet. (6) Variance from Section 54- 3- 10.6(a)(5) — Reduction of the parking stall length of standard and handicapped spaces from 20 feet to 19 feet. For review purposes, staff has grouped the talking points provided by the, applicant for the related variances. Following is the board criteria for determining variances, as stated in Section 54-1 - 2.5(c)(2): "In order to authorize any variance from the terms of the land development regulations, the Board of Adjustment must use the following criteria for approving or denying a variance:" "a. Existence of special conditions or circumstances. That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures, or buildings in the same zoning district." (1) The side yard setback (north property line) borders on a 50 -foot state right -of -way. Oyster Point & Oyster Bay Resort has maintained this right -of -way as an open landscape area for years. In essence, the proposed building will be at least 52.5 feet from the nearest buildable property to the north. (2) The front yard setback along Indian River Drive is required to be 10 feet when there is no sidewalk, curb and gutter. However, the setback is reduced to zero when there is a sidewalk, curb and gutter. The site plan shows existing on- street city parking in the area where you might expect a sidewalk, and the traffic lane of Indian River Drive is 4 8of13 approximately 27 feet from the building. Only a triangular portion of the building actually extends into the setback area, and not the entire side of the building. Also, the neighboring property across Indian River Drive that would be most impacted by a reduction to the setback is also part of Captain Hiram's. (3) If the (north) side setback is reduced from 10 feet to 2.5 feet, as requested in variance (1), the perimeter landscape strip in that area must also be reduced. (4) The applicant wishes to maintain an open vista to the 50 -foot state right -of -way area being maintained as a landscape feature by Oyster Point & Oyster Bay Resort. Rather than a solid perimeter hedge, Mr. Collins is proposing ligustrum understory bushes 4 feet to 5 feet tall planted to accent the architectural features of the building. (5) Regarding the drive aisle, Mr. Collins points out that it is not a through street. He acknowledges that a drive aisle needs to be wider when it is used as a principal pathway through the site, such as the one he has connecting U.S. 1 to Indian River Drive. However, in this case, it simply enters and exits a parking lot, with little impact on the remainder of the site. (6) The reduction in the parking stall length, in conjunction with (5) above will allow 14 additional parking spaces to be created along the southern portion of the new site. It must be noted that the overall resort site continues to meet the city parking code, even with the additional parking needs of the proposed 16 -unit hotel. But the reality is that every additional parking space that can be created is vitally important to this resort. "b. Conditions not created by applicant. That the special conditions and circumstances do not result from the actions of the applicant." Prior to the purchase of this property by Sebastian Inlet Marina and Trading Co., it contained three residential apartments which were badly damaged by the hurricanes. The new owners have demolished the buildings, stabilized the area and are currently using it as a parking lot. "c. Special privileges not conferred. That granting the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, buildings, or structures in the same zoning district." All requested variances are related to the proposed site plan which will provide 16 hotel units, while still providing an additional 27 parking spaces for the overall benefit of the entire resort. 5 9of13 "d. Hardship conditions exist. That literal interpretation of the provisions of the ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of the ordinance and would create unnecessary and undue hardship on the applicant." "e. Only the minimum variance granted. That the variance granted is the minimum variance that will make possible the reasonable use of the land, building, or structure." "f. Not incurious to public welfare or intent of ordinance. That the granting of the variance will be in harmony with the general intent and purpose of the comprehensive plan and this code, and that such variance will not be injurious to the area involved or otherwise detrimental to the public welfare." "¢. Conditions and safeguards may be imposed. In granting any variance, the board of adjustment may prescribe appropriate conditions and safeguards in conformity with chapter 163 F.S., the comprehensive plan, and any ordinance enacted under its authority. Violation of such conditions and safeguards, when made a part of the terms under which the variance is granted, shall be deemed a violation of the ordinance." "h. Time limit may be imposed. The board of adjustment may prescribe a reasonable time limit during which the applicant shall commence and /or complete the subject actions and conditions approved by the board." "i. No use variance permitted in specified instances. Under no circumstances shall the board of adjustment grant a variance to permit a use not generally permitted in the zoning district involved or any use expressly or by implication prohibited by the terms of the ordinance in the zoning district.
