TWO OR MORE ELECTED OFFICIALS MAY BE INATTENDANCE. MINUTES NATURAL RESOURCES BOARD REGULAR MEETING TUESDAY, FEBRUARY 3, 2014 6:00 P.M. "To improve the quality of life in Sebastian by nurturing the balanced relationship between our citizens and our environment by protecting, preserving and promoting our natural resources" 1. Vice Chairman Northcott called the meeting to order 6:00 p.m. 2. The Pledge of Allegiance was recited. 3. ROLL CALL Present: Alan Northcott — Vice Chair Gil Gordian Ann Lucier George Millar Not Present: Robin Graves — Chair (excused) Al Alvarez (excused) Hank Kriss (excused) Also Present: Dord Bosworth, Planner Jeanette Williams, Recording Secretary 4. APPROVAL OF MINUTES: January 7.2014 Regular Meeting MOTION by Vice Chair Northcott and SECOND by Ms. Lucier to approve the January 7, 2014 minutes as amended on page two. 5. ANNOUNCEMENTS Mr. Gordian said he was still working on musicians for Earth Day. Vice Chairman Northcott noted Mr. Deredita has left the Board. 6. PUBLIC INPUT - None. Natural Resources Board Meeting 2 February 4, 2014 7. OLD BUSINESS Mrs. Lucier reminded everyone of the spoil island clean -up scheduled for March 1 "t. Mr. Gordian announced for anyone watching that if they would like to join them, they would love to have another boat available for the clean -up. Vice Chairman Northcott noted the collected trash would only be transported on the City's boat. Mrs. Lucier said employees of a Sebastian orthodontic practice would like to participate in the clean -up. Mr. Gordian said he also received an e-mail from a doctor that wanted to donate some mangroves and sea grapes to plant on Earth Day and asked if the Board would need permission. The Planner advised him to contact Parks Superintendent, Chris McCarthy. 8. NEW BUSINESS Discussion with City Attorney Robert Ginsburg regarding the Sunshine Law and its applicability to the Natural Resources Board The City Attorney noted this was brought to the forefront because of the recent Council workshop on the Lagoon. Everyone agreed that the health of the Lagoon was of concern to all and in fact, the workshop could have been held by the Natural Resources Board. He was asked if there would have been a Sunshine problem if two or more came to workshop since it was not noted on the Council agenda that "Two or More Natural Resource Board Members May Be In Attendance." At the time of the workshop, he responded that two or more members could have attended even if it was not noted on the agenda because the issues of the Lagoon's health are within the Board's jurisdiction, the issues are expected to come before them in the future, and it was the equivalent of them holding the meeting. The City Attorney said he was relying on legal precedence that is close; and certainly the conservative position would have been that they shouldn't attend. 6.16 pm Vice Chairman Northcott reiterated that is reasonable to expect members of the Board to attend and members of the public shouldn't be surprised. The City Attorney said that was correct. Vice Chairman Northcott said he served on the Planning Commission in Arizona who also subscribed to open government. He suggested they advertise in advance if they want to come to a future meeting and asked if the Board members could attend meetings at the County. The City Attorney said his opinion would not apply to a County meeting because the Board and the Council's concerns overlapped with the workshop; whereas the County has a larger portion of the Lagoon with more expensive programs beyond the budget of a city. Mr. Millar asked if he could attend a City Council meeting, as a citizen and if there was another Board member could he remain at the meeting. The City Attorney said their position on the Board elevates them from ordinary citizen and they do need to be careful of the Sunshine Law and because he would not know what the situation would be, he said the question was too indefinite. Vice Chairman Northcott asked they were to see each other in Walmart, would they have to walk away. The City Attorney said they couldn't discuss anything that might come before them as a Board. Natural Resources Board Meeting 3 February 4, 2014 The Planner asked if this applied to only items they are voting on or all items. The City Attorney responded if it is discussed at this Board or expected to be discussed at the Board, the Sunshine Law applies. Mrs. Lucier noted the fertilizer ordinance may come back up, and if they attend the City Council meeting, should it be noted on the agenda that "Two or more members of the Board may be there." The City Attorney said it should be noted on the agenda. He said the posting should be done within a reasonable amount of time but he prefers 24 hours, with as much notice time as possible. Continuation of planning activities for Earth Day Mrs. Lucier reported that she has only received four vender applications. The Planner said she met with Waste Management who decided to have electronic recycling on the same day, from 9 a.m. to 4 p.m. They planned to participate with a booth and were reviewing their budget to place a newspaper ad or flyer that will include mention of the Earth Day celebration. She said the City would provide website advertising and signs indicating traffic flow for the event. Mr. Millar asked if they could get an ad in the Sebastian River News two weeks in advance. Mrs. Lucier noted they didn't have any advertising money. Mr. Millar said he spoke with the School District Webmaster who might put a line item on their website with a link for more information. He requested a flyer without the vender solicitation, but with more children's events to post on the District's website. Mrs. Lucier reported the venders that have responded include a lady who face paints for kids, Vickie Wilde with KIRB, a jeweler, and the National Estuary Program. Mrs. Lucier said she approached additional food vendors at the Fine Arts and Music Festival but haven't heard from any of them. In response to Mrs. Lucier, Mr. Gordian said he was still working on the banner and the cost maybe over $150.00 which included a discount. Mrs. Lucier said she might approach the orthodontic practice to endorse the cost of the banner. In response to Vice Chairman Northcott, the Planner said a sign permit would not be necessary as it is part of a public event. Mr. Gordian said Thomas Bowman would be singing. Mr. Millar said the Fire Dept. would need to know how venders will be there, and how many feet apart will people be cooking. He offered to contact some food venders. Vice Chairman Northcott offered to contact Sebastian River News. Mr. Millar said the School District has some school buses powered by liquid propane, and asked if the Board would be interested in having a bus on display focusing on alternative fuels. The Board agreed that would be an informative display. Mrs. Lucier said she would love to have the group that made the tennis ball terrariums again. In response to Mrs. Lucier, Mr. Gordian said the Elephant Center may come. She said would talk to Home Depot about coming and would start collecting pine cones to make bird feeders. Natural Resources Board Meeting 4 February 4, 2014 Vice Chairman Northcott said he hasn't heard back from the Sebastian Middle School on the a cappella group for music. 9. MEMBER MATTERS Discussion followed on the two Board vacancies. Vice Chairman Northcott suggested a budget would help them do some things. Mr. Gordian said it would help with the island clean -ups. The Planner suggested they approach the Citizens Budget Review Advisory Board to be included in the next budget cycle. Mr. Gordian said the High School Green Club will be coming with bird feeder donations. Mrs. Lucier suggested a craft involving the recycling of water bottles. 10. STAFF MATTERS — None. 11. Being no further business, Vice Chairman Northcott adjourned the Natural Resources Board meeting at 6:44 p.m.
