QUASI- JUDICIAL PUBLIC HEARING: TODD HOWDER OF MBV ENGINEERING, AS REPRESENTATIVE FOR THE OWNER MICHAEL DINZLEY, IN REGARDS TO PROPERTY LOCATED AT 13085 U.S. 1 IS REQUESTING THE FOLLOWING VARIANCES: 1. PER SECTION 54- 2- 5.4.(d)(5), A REDUCTION OF THE REAR YARD SETBACK ALONG THE WEST PROPERTY LINE FROM 30 FEET TO 20 FEET. 2. PER SECTION 54- 3- 15.2., A REDUCTION OF THE REQUIRED PARKING FOR AN ASSISTED LIVING FACILITY FROM 52 SPACES TO 44 SPACES. 2of19 Board of Adjustment Meeting February 26, 2014 Page Two The City Attorney read the title of the variance request and advised that this is a quasi - judicial hearing. All members except Mr. Adams said they had received phone calls from Mr. King but nothing of substance was discussed. The City Attorney said it doesn't sound like anything of substance was discussed so this fine. The City Clerk swore in all who intended to give testimony. The Interim City Manager gave a brief introduction on the request and said Todd Howder, MBV Engineering, will make the presentation on the application for the two variances. Todd Howder, consulting engineer for the project, gave the presentation, noting this is the site of the former planned Sonic, north of the St. Sebastian Catholic Church, described each variance; 1) reduction of rear setback from 30 to 20 feet, noting 30 feet is required currently because they abut a residential use at this time but in the future that zoning will revert to CR use which would then require only a ten foot setback, and the reason for the request is to have the nicest site they can by providing as much green space and landscaping for calming as they can including a six foot hedge and 16 foot trees at twenty -five foot spacing; and 2) for the reduction in parking from the City Code (he provided a one page proposed elevations to show the design of the building) he said in an attempt to make a more desirable design for the residence which will take up a little extra room. He said they have done research and said the City parking code requires .6 per bed, and trip generation studies as set out in 8t' Edition of ITU (2012) assesses a peak parking rate of .18 or .35, which would take spaces down to the high thirties and they are seeking 44. He said this is the best use and will be the best neighbor as opposed to the other uses that were proposed and requested approval. Ms. Coy said she was impressed with the design and she appreciates them thinking out of the box, and this will be a much better neighbor to adjacent properties. Mayor McPartlan called for input in favor of the request and there were none. Mayor McPartlan called for input opposed to the request. Claire Ranahan, Shady Rest Mobile Home Park, said this will be in her backyard and said Shady residents would appreciate having copies of the plans, that she was not against it but wanted verification of where dumpsters would be located and traffic routes for delivery trucks. She said she had pictures of the rear of her home, hoped they have priority to move in when it is ready, and would like to be kept up to date with what is going on. She said there were rumors it would be seven stories high so they need information. Ms. Coy gave her the agenda packet she had. Mayor McPartlan said she could contact the Interim City Manager and he would keep her up to date. Todd Howder said he would be happy to meet with Ms. Ranahan and let them be involved with the process. 2 3of19 Board of Adjustment Meeting February 26, 2014 Page Two The Interim City Manager reiterated his recommendation to approve the variance requests for the setback with a contingency for installation of type A buffer, with enhanced canopy trees as per staff report, and the second variance with reduction of parking spaces from 52 to 44. MOTION by Mr. Gillmor and SECOND by Ms. Coy to approve staff recommendation to approve variances A and B on this project with conditions. Ms. Coy said in our packet there is a stipulation that there is an acknowledgement that when Shady Rest time is up in 2018 should there not be another owner for that property the owner could request another extension or make another deal with Council. The Interim City Manager said that is correct. Mr. Hill said his only issue is on the parking issue, and asked was Sebastian's Code a little strict for this type of use. The Interim City Manager said 52 spaces is based on the LDC and staff examined eight different studies and all were less than what we require, sometimes less that 113, so reducing to .5 is still below the industry standards. Mr. Adams asked if we need to look at the LDC to see if it needs changing to be more in line with Indian River County which is .5, and the ICM said we had recently went through a review and made some changes to the LDC and this was not one of them, and have been working with the Chamber on some provisions and perhaps this parking could be looked at going forward. The new design will take care of these items, except for the front yard encroachment of the canopy. The new design will relocate the gasoline pumps and canopy to an area parallel to Barber Street and further away from Sebastian Boulevard. The Barber Street access drive will be relocated further south (away from the intersection), and the access drive onto the alley will be closed. The entire existing canopy, consisting of 1,875 SF, encroaches into the front yard setback. Although the new canopy is substantially bigger, 3,320 SF, the portion of encroachment has been reduced to 1,420 SF. As designed, Cumberland Farms is requesting a variance to allow the new canopy to be 38.5 feet from the front property line. Staff has analyzed the variance request based on the location of the property, existing conditions of the site and city records. The attached Board Criteria for Determining Variances outlines the staff findings. 10. Board Criteria for Determining Variances: See attached analysis. 11. Staff Recommendation: Regarding the Cumberland Farms property located at 957 Sebastian Boulevard, staff recommends approval of a variance to allow a fuel canopy to be 38.5 feet from the front property line. 12. Board Action: Conduct quasi-judicial hearing to consider the requested variance. f Pre&kd by `t_z_I'f Date 3 7of19 BOARD CRITERIA FOR DETERMINING VARIANCES Section 54 -1 -2.5 In order to authorize any variance from the terms of the land development regulations, the Board of Adjustment must use the following criteria for approving or denying a variance: a. Existence of special conditions or circumstances. That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures, or buildings in the same zoning district. Meets Standard Yes Q' No ❑ As a fully developed site, the subject property has a number of existing issues including a side yard encroachment of the building, lack of a recorded cross access easement, general nonconformance with the 512 Overlay District requirements of architecture and landscaping, and a front yard encroachment of the canopy. The redesign of the site will address all issues except for the front yard encroachment, which will be reduced, while improving the traffic flow on and off the site at this busy intersection. b. Conditions not created by applicant. That the special conditions and circumstances do not result from the actions of the applicant. Meets Standard Yes B' No ❑ The front yard setback problem appears to date back to the original site plan approval in 1987, even though the Land Development Code at that time also required a 74 foot setback. The proposed new plan will increase the canopy setback by 18.9 feet. C. Special privileges not conferred. That granting the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, buildings, or structures in the same zoning district. Meets Standard Yes � No 0 The required 74 foot setback for properties along Sebastian Boulevard was designed to facilitate a cross access easement among those lots. In most cases, this easement area should remain clear to allow for traffic flow. However, in this case, the area between their Sebastian Boulevard driveway running east to Barber Street does not need to remain clear, because an 8of19 access point onto Barber Street in that location would be entirely too close to the intersection. d. Hardship conditions exist. That literal interpretation of the provisions of the ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of the ordinance and would create unnecessary and undue hardship on the applicant. Meets Standard Yes 0" No ❑ Cumberland Farms wishes to completely renovate their property with a new building and better site design. They propose to increase the size of the canopy, but will also be reducing the size of the building and will eliminate the existing three retail units. The new plan will address a number of other site issues and conform to the 512 Overlay District architectural and landscape requirements. However, to facilitate these improvements, they have requested a reduction to the front yard setback for the canopy. e. Only the minimum variance granted. That the variance granted is the minimum variance that will make possible the reasonable use of the land, building, or structure. Meets Standard Yes &' No ❑ Cumberland Farms has made every effort to resolve their site issues and meet the additional requirements of the 512 Overlay District. They feel that their variance request is the minimum required to implement these improvements. f. Not incurious to public welfare or intent of ordinance. That the granting of the variance will be in harmony with the general intent and purpose of the comprehensive plan and this code, and that such variance will not be injurious to the area involved or otherwise detrimental to the public welfare. Meets Standard Yes R- No ❑ The redevelopment of the site will improve the flow of traffic to and from this property, primarily by relocation of the Barber Street access south (further from the intersection), and by repositioning the canopy to run parallel with Barber Street. This will not be possible unless a portion of the canopy can be located in the front setback. 5 9of19 g. Conditions and safeguards may be imposed. In granting any variance, the board of adjustment may prescribe appropriate conditions and safeguards in conformity with chapter 163 F.S., the comprehensive plan, and any ordinance enacted under its authority. Violation of such conditions and safeguards, when made a part of the terms under which the variance is granted, shall be deemed a violation of the ordinance. The variance application accompanies a site plan which involves the complete demolition and reconstruction of the Cumberland Farms facility at the corner of CR 512 and Barber Street. The existing facility is out of date and has four or five major non- conformities on site. The proposed site plan will eliminate those non - conformities in exchange for one minor variance. Among the improvements or benefits to the City of Sebastian will be relocation of a driveway from Barber Street into the site, and improved traffic flow within the shopping center. The elimination of the major non - conformities and the removal of the driveway constitute special circumstances which are not applicable to other properties within the same zoning district. These conditions were not created by the applicant, and no special privileges are being sought by this variance. The literal interpretation of the provisions of the ordinance would prevent the applicant from employing the most modem design to improve the site for the benefit of the public health, safety and welfare. Only the minimum variance is being sought to accommodate the designed fuel canopy. The granting of the variance will be in harmony with the general intent and purpose of the comprehensive plan and will not be detrimental to the public welfare, and in fact, the removal of the major non - conformities to the site will benefit the public welfare.
