Conditions of Street Cut Permit
Procedures: The applicant shall be required to follow the procedures and meet the requirements as
outlined in the City of Sebastian Code of Ordinances,Chapter 90,Article II Street Construction and Repair.
Permitee: The applicant shall make opening and repairs in accordance with approved plans. Applicant
shall bury cable 36"deep and in location along easements as shown on permit drawings.
Maintenance of Traffic: The applicant shall not obstruct or create a traffic hazard. Measures shall be
provided during construction in accordance with FDOT and MUTCD.
Road Closures: Closures are not permitted without separate permit that include traffic control and detour
plans. Contact the Engineering Department at 772-589-5490 with road closure requests NLT 48 hours

harmless from any and all costs, damages, and liabilities which may accrue or be c e
reason of any work performed under permit.
Time Limitations: All work must be completed within 90 days from the date of issuance of this permit.
Restoration in ROW: Any disturbed swale areas must be restored to original grade. Brace soil with sod
if adjoining occupied lots, or seed and mulch if adjoining unoccupied lots. Any permittee damaging any
City road or other City improvements within Right-of-Ways and Easements shall be required to restore the
damaged area to its condition prior to the damage and accepted by the Public Works Department or shall
pay to the City of Sebastian the sum of money determined by the Public Works Department to be necessary
to restore the damaged area to its condition prior to the damage. In the event discrepancies arise as to the
responsibility for damage,the burden of proof shall in all cases be that of the permittee.
Inspections: The City Engineer(or designee) shall inspect during construction and at fmal approvals. A
minimum of twenty-four (24) hour notice is required when fmal inspection is requested. Inspection fees
will be charged against the security deposit. After six months and repair work is satisfactory, deposit will
be returned to permittee minus any costs for inspections. If restoration work is not restored satisfactorily,
the deposit will be used to defray the cost of the work to be performed by the City.
Insurance: The permittee shall provide certificate of insurance in accordance with provisions of Section
90-66 of City Code. Public utilities may be relieved of providing certificate if insured in accordance with
referenced section.
