As I understand the situation, you desire to redevelop your storm - damaged residence while also enhancing the site to accommodate not only your primary residence but also quite possibly an artist's studio. Additionally, your request includes the possibility of including a second story addition to the structure, understanding that a 25' height limit exists. As we discussed, your residence is a nonconforming structure based on not satisfying current residential setback standards established within the CWR zoning district. However, your proposal to include a commercial use combined with the accessory residential use dictates that commercial building setbacks would prevail, thus greatly reducing the nonconformity as only the south side yard setback remains as the only setback failing to meet the setback standards. You have two options in resolving this matter: the first is to apply for a variance as the building predated today's setback standards, and the other is to only add to that portion of the building that complies with zoning setbacks. Additionally, you will be required to provide parking for any commercial use included on your site, and by initial observance of your site survey, you have sufficient land area to accommodate two commercial parking spaces as would be required by the approximately 360 square foot commercial artist studio. The comments contained in this letter simply address zoning as related to your site. You are referred to Building Director Wayne Eseltine with respect to any structural and building code compliance issues that may arise as the result of planned modifications to your structure. Further, the Commercial Waterfront Residential District was implemented to enhance the viability of the waterfront district by permitting uses such as those you've discussed in your proposal.
