My license is contingent upon approval of three parking spaces, in which I wish to lease from the city. Said spaces would he located in the municipal parkin; area, west of the town boat ramp, or adiacent to my i huildng, iust north of it. I am willing to maintain your boat_ ramp in exchange for the parting spaces. Please understand that T have invested my life's savings into this building, and have no other direction to turn. Krages City Clerk M E M 0 Attached, please find the pertinent information regarding the proposed Indian River Discount Beverage and Tackle, to be located at the river side of Indian River Drive ana Main Street, next to the municipal dock. Mr. Fey is re- questing use of three parking places at the municipal park- ing lot and the issuance of an occupational license. I have attached a copy of the proposed changes to the building, a copy of the approval by the health department regarding the septic tank and Mr. Fey's letter stating that he would maintain the dock in exchange for the parking facilities. The City, attached copies, owns the lots on both sides, his property is commonly known as the Cutshaw, Farmer, Sharp property. Should it be the councils desire to approve this request I would appreciate your considering the approval pending the execution of the attached "Hold Harmless Agreement ", the previous owners had an identical agreement with the city. FEY, his wife. WHEREAS, said property is utilizing water from an artesian well which is located on property owned by the City of Sebastian; and WHEREAS, the City of Sebastian is not receiving any consideration for the use of said well bit is desirous of a hold harmless agreement from RICHARD R. FEY and JODY R. FEY, his wife, releasing the City from any obligation or responsibility in connection with the use of said artesian well; NOW, THEREFORE, IT IS MUTUALLY AGREED between the parties as follows: 1. The City of Sebastian agrees that RICHARD R. FEY and JODY R. FEY, his wife, shall continue to use the water from the artesian well located on property owned by the City to service their property on Indian River Drive. 2. In return, RICHARD R. FEY and JODY R. FEY, specifically hold the City harmless and release the City for themselves and anyone occupying said property from any claims of allergy, sick- ness or other use of said artesian well water. Box 127 Sebastian, Florida 32958 -0127 Re: Indian River Discount Beverage & Tackle Shop Dear Mr. Eisenbarth, This letter is in reference to the above matter and letter of June 18, 1985, transmitted to you from Mr. Hector A. Franco, Building Official. After a review of the applicable zoning regulations for the City of Sebastian I have come to the conclusion that full compliance including site plan review will be necessary prior to issuance of approval for construction by the Planning and Zoning commission and the City of Sebastian. It will be necessary for the owner to follow applicable procedures which would include appearance before your zoning commission. I am presently in the capacity of Acting City Attorney due to the fact that Mr. Palmer is presently on vacation leave. I base my foregoing opinion on Section 20A -10.1 of Ordinance No. 202 -9. I am enclosing partial copies of same for your review. Kindly contact me should you have any questions concerning this matter. Franco Building Official After an on -site inspection of the property and having performed a detailed review of the Project, I submit the following comments: 1. No Site Plan Review is necessary. The physical location of the building will not be changed. 2. The Project calls for the approval of (4) four parking spaces on the general parking plan. I have no objection to this approval. The existing municipal parking can be used in this particular case if necessary. The general parking area must have the corresponding bumpers and should be paved and marked. In addition to this re- quirement, one parking space must be for the handicapped. Lateral drainages must be provided. 3. The main concern about this building is public safety. The approval must be conditioned to the fact that the owner should obtain the appropriate certificate that the foundation and main structure of the building is in good shape and can be used. This certification is to be obtained from a structural professional engineer. If the structure of the building needs changes, then a permit will be necessary. 4. The exterior remodeling of the building will be done as per Plan. 5. I have no objection to the Change of Use proposed. 6. Box 127 Sebastian, Florida 32958 Dear Commissioners: JUN 1985 ti i I recently purchased the South 30' of the North 65" of Lot 2, Block 3, Hardee's Subdivision, Indian River County, Florida, commonly known as the Cutshaw /Sharp property, located at the corner of Main Street and Indian River Drive. This property is zoned C -2, Mrs. Sharp advised me that she had used this property to operate an Interior Design Shop. My intent is to operate a small scale retail. sales business, which would accomodate the boaters of Sebastian. I will. be selling fishing tackle, ice, soda and beer. I respectfully request that you 1.) approve a change of use and 2) approve the parking plan submitted, which will accomodate four (4) parking spaces, with a floor area of approximately five hundred fifty (550) square feet. I have applied for and reveiced a liquor license, type 1--APS, license number 26160. I plan on attending your commission meeting of June 20, 1985, if you should have any additional questions.
