Trial Coming.
Mrs. Marguerite E. Cut -
shaw is scheduled to go on
trial again this Monday on
charges of maintaining a
sanitary nuisance and having
an illegal septic tank system.
Her first trial, on charges
brought by the Indian River
Health Department, resulted
in a hung jury..
The property involved is a
40 -foot strip on the Indian
River across from the City
Hall in Sebastian. A two-
bedroom frame cottage
covers all but 10 feet of the lot
and the house is constructed
on pilings over the shore of the
river.
The condition of the septic
tank system was brought to
the attention of the health
department by the building
inspector of Sebastian, Allan
Mumm.
Mrs. Cutshaw was given
several alternatives to
remedy the situation but
failed to do so, maintaining
that she was being singled out
and harassed by the City of
Sebastian because they
wanted to purchase her
property for a park but did not
want to meet her price.
Attorney Richard Bogosian
said he expects to have some
additional witnesses for the
Monday trial. Mayor F.
Eugene Cragg, Councilman
Pat Flood, Building inspector
Allan Mumm and Jack Allen,
sanitarian for the north county
area, were among the wit-
nesses subpoenaed for the
defense at the last trial.
Bogosian said nothing
further has been done to
improve the septic tank
system but that Mrs. Cutshaw
had completed some work on
repairing the pilings under the
house, as was requested by the
City of Sebastian.
