Narrative of proposed action: The applicant is requesting approval of a conditional use permit for a business office with drive - through facility in 1 the Commercial Riverfront (CR) Zoning District in conjunction with an administrative site plan modification. b. Be so designed, located, and proposed to be operated so that the public health, safety and welfare will be protected, The drive - through facility has been designed to protect pedestrian and vehicular traffic on the site, b. Does not present an unduly adverse effect upon other properties in the impacted area in which it is located. The proposed use is consistent with the intent of the surrounding commercial zoning district and does not present an unduly adverse effect upon other properties in the impacted area, There is an existing restaurant with drive - through facility immediately south of the subject property. 2 C. The scale, intensity and operation of the use shall not generate unreasonable noise, traffic, congestion or other potential nuisances or hazards to contiguous residential properties. The site is not contiguous to residential properties. d. Conforms to all applicable provisions of the district in which the use is to be located. The proposed use will be incorporated into an existing mixed use commercial site which conforms to the district regulations. e. Satisfies specific criteria stipulated for the respective conditional use described in subsection 54 -2- 6.4(41): 1) Separate entrances and exits shall be provided and clearly identified and in conformance with the sign regulations of Article XVI of this Code. Joint entrancelexit curb cats may be allowed for the ingress and egress and for traffic not utilizing the drive - through facilities. The proposed drive- through is located within the previously developed parking lot. The existing means of ingress and egress to the site are directly off U.S. 1 and a shared driveway connection to the north and south properties. 2) No more then two curb cuts shall be permitted on any single street frontage, Curb cuts shall be limited to a maximum width of 25 feet, shall be located no closer than 35 feet to any intersection, and shall be at least ten feet removed from property lines. No additional curb cuts are proposed_ 3) The site plan shall provide for efficient circulation of vehicles on -site and maintain an adequate separation of drive - through and non-drive- through traffic. The drive - through is located within an existing parking lot. An existing one-way lane will be converted to the drive - through and pass -by lane. Signage will be provided. 4) Ito the CG and CR district, no business or professional office with drive- through facility shall be located within 100 feet of a residential district, In the CL District, no business or professional office with drive- through facility may abut a residential zoning district. The site is not located within 100 feet of a residential district. 5) Ail side and rear yards abutting or adjacent to residential districts or arses shall be screened in accordance with the standards established in Section 54 -3 -14.16 of this chapter. In addition, walls or fences may be required by the planning and zoning commission for the sole purpose of screening light beams from motor vehicles utilizing drive - through facilities if such light beams will cause undue glare to 3 surrounding properties, taking into account the use of the surrounding properties, the distance therefrom, and the existence of other obstructions to such light beams. Any such requirements imposed by the Planning and Zoning Commission as to walls and fences shalt be supported by stating the basis for such requirements. This requirement may be required by the Planning and Zoning Commission after original site plan approval if the use of the adjacent land(s) on the side or rear of the property changes and becomes sensitive to glare. The site is not abutting or adjacent to a residential district. It is acknowledged that in the future, the Planning and Zoning Commission may impose additional buffering requirements if conditions change on the surrounding properties. f. Consistent with the Cade of Ordinances and Comprehensive Plan. The proposed bank with drive- through facility is consistent with the Code of Ordinances regulations and Comprehensive Plan elements. 11. Other Matters: In additional to the conditional use permit, application has been made for a modification to the existing site plan. Since the change to the plan is limited to a redesign of the drives and a new 91 SF roof structure, it is classified as a minor modification and will be administratively reviewed and approved. 12. Conclusion: A conditional use permit for a bank with drive - through facility to be located at 1627 U.S. 1 is consistent with the Comprehensive Plan and Land Development Code. 14.
