East Coast Railway Invoices

Based upon our discussion on January 2nd and the attached
Accounting Manager Inquiry summary sheet of invoices that you gave
me, I had Linda Kinchen research our files to determine what the
invoices pertained to.
Invoice No. 12350105 and Invoice No. 124500708, both in the amount
of $2639.70, are for insurance costs for the Barber Street (fka
Stratton Ave.) Railroad Crossing. This annual cost, according to
Shirley Driver of: the Florida East Coast Railroad, (FEC) varies
from year to year depending upon the FEC insurance company. Please
refer to the attached January 4, 1996 memo Linda wrote to me. Page
6 of the August 30, 1994 agreement between the City of Sebastian
and the Florida East Coast Railway Co. specifies that the City
shall maintain a $1 million general liability policy indemnifying
the Railway against claims. However, the agreement does not specify
a dollar amount because of the variable cost.
Invoice No. 54500106 and No. 55500065 are for annual signal
maintenance costs as per the August 30, 1984 agreement between the
City and FEC Railway and are paid annually as per Section 114 G" of
the Agreement. The annual costs are determined by the Florida
Department of Transportation's Schedule of Annual Costs of
Automatic Highway Grade Crossing Traffic Control Devices.
Initially, the annual cost was $980 when the August 30, 1984
Agreement was signed. Now the annual cost has incremented to
$2117.00. Please refer to the attached copy of my June 22, 1995
letter to City Manager Joel Koford.
Invoice 64500106 in the amount of $1058.50 was for signal
maintenance costs for the Main Street Crossing. As per my attached
letter of August 25, 1995 to William Sasser of the FEC Railway, the
City should not be paying the bill for this crossing because the
City does not have an agreement with the railroad for the Main
Street crossing. Evidently, Indian River County has been paying
