CITY COUNCIL CHAMBERS 1225 MAIN STREET, SEBASTIAN, FLORIDA 1. Mayor McPartlan called the Regular Meeting to order at 6:30 P.M. 2. Invocation was given by Pastor Karen Leedahl, Christ the King Lutheran Church. 3. The Pledge of Allegiance was led by Mayor McPartlan. 4. PROCLAMATIONS, AWARDS, BRIEF ANNOUNCEMENTS Presentations of proclamations, certificates and awards, and brief timely announcements by Council and Staff. No public input or action under this heading. 14.142 A. Proclamation — Attendance Awareness Month — September — Accepted by Dr. Torres -Martinez Mayor McPartlan read and presented the proclamation to Dr. Torres -Martinez, who commented on the importance of the nationwide initiative on school attendance, citing activities in each of the schools and use of school and community resources to assist in getting the word out. Proclamation - Ed Herlihy — Volunteer Contribution to City of Sebastian Communications — 2008-2014 Mayor McPartlan read and presented the proclamation to Mr. Herlihy. Mr. Herlihy thanked City staff he worked with over the years, his wife for her patience with him being away so often, and City Manager, Joe Griffin for all they accomplished together. 14.144 C. Proclamation — Constitution Week — September 17-23, 2014 - Accepted by Holly Hamilton. Daughters of the American Revolution Mayor McPartlan read and presented the proclamation to Holly Hamilton. Ms. Hamilton thanked him on behalf of the Treasure Coast Chapter of the DAR and Children of DAR. 14.018 D. Presentation by Senator Altman Regarding All Aboard Florida Issue (Backup w/Item Senator Altman addressed the Council in regard to his concern about the lease agreement between the Expressway Authority and All Aboard Florida and his request to Attorney General Bondi on the agreement, which, he stated, imposes a "special tax" to residents of the Brevard and Indian River County because they will continue to have to pay tolls to travel to Orlando if no stations can be constructed in these areas, and freezes out these residents from the process. He asked the City to support the resolution and have their City Attorney look into the legality of the lease agreement. Mr. Hill said it is a pleasure having him and his staff here and strongly supported the resolution and appreciated his support of our residents. Ms. Coy said she hoped we can get Brevard County more involved, noting Brevard Commissioners are not really that concerned, thanked Commissioner Solari for being here tonight, and thanked Senator for this item. Senator Altman said he shares their disappointment about Brevard, noting the Cape Canaveral Port Authority are set to support the plan and that he was prepared to object to their resolution. He said he had a copy if Council wants it, and said it was his hope it does not pass. He commended the Council for their efforts and said they are the first in the region to step up for residents. E. Brief Announcements L City Council Candidate Qualifying Ends September 5, 2014 for November 4, 2014 General Election Mayor McPartlan read the announcement above. Ms. Coy said she had received calls about people collecting saw palmetto berries for money, and announced that they are not allowed on private property and if they are on public property to call Code Enforcement, noting the police have been alerted. She also announced that the City Salvation Army bell ringing day is coming up on December 6, volunteers can call 978-0265X106 and all funds from that day go to north county hunger relief. 2 Regular City Council Meeting August 27, 2014 Page Three 7. CONSENT AGENDA All items on the consent agenda are considered routine and will be enacted by one motion. There will be no separate discussion of consent agenda items unless a member City Council so requests, in which event, the item will be removed and acted upon separately. If a member of the public wishes to provide input on a consent agenda item, helshe should request a Council Member to remove the item for discussion prior to start of the meeting or by raising his/her hand to be recognized. UNFINISHED BUSINESS - None Regular City Council Meeting August 27, 2014 Page Four 11, PUBLIC INPUT New information or requests to city council not otherwise on the prepared agenda Walt McCarty addressed City Council regarding a neighbor who keeps multiple exotic birds outside his house and the sound of their squawking has disturbed the peace for him and his wife for the fourteen years they have lived there. He said the police and code enforcement have been there and in his opinion there are holes in the law. He requested that an ordinance be written to prohibit keeping the birds outside the house, because he would like to be able to sit outside and enjoy his yard,, noting another neighbor left the area due to this problem and actually told him he wanted to kill the birds. Mayor McPartlan asked if the noise ordinance covers barking dogs and the City Attorney said yes and then asked if someone can get a citation and the City Attorney responded they could. The City Manager said he would find out about how many police reports there have been on this issue. Mr. Gillmor said he didn't think the noise ordinance has been enforced and the City Manager said he would look into that as well. Mr. Gillmor said the ordinance put into place in the riverfront seemed to be working but we need to put something in place in the residential area. He said he had personal experience owning a parrot, and said if the neighbor had been fined in the past the noise would have ceased, and he would be surprised if we have ever collected a fine from a noise ordinance. Ms. Coy said she encouraged Mr. McCarty to attend, stating she also had a parrot and understood the noise level, and agreed we need to see what we can do to tighten this up. Robin Donahey (?), Quarry Lane, spoke on the proposed disk golf project at the Stormwater Park, expressing her objections to using this location, noting she was a regular visitor because of the wildlife, said she had contacted St. Johns River Water Management District about her concerns about the wildlife. She said they also bring in leagues and tournaments which could present a parking problem, and that trails become flooded and walkers and players will be competing for space. She asked if other parks were considered, such as Main Street, and will a plan be submitted for review before it is finalized. The City Manager said this came up via Parks and Recreation to Council and is contingent upon St. Johns approval which has not yet been given. He said there are no other venues being considered and this is the only one brought forward. He said if St. Johns considers this an inappropriate use they will have to find another venue. Ms. Coy said they did look back here on Main and said it would be difficult, that they want obstacles for the game not open space. 12. NEW BUSINESS 14.148 A. Himanshu Mehta, IRC Solid Waste PP Presentation (No Backup) Vincent Burke, Indian River County Utility Director, said he would be presenting the Power Point and thanked Himanshu Mehta, Solid Waste for his assistance and Commissioner Bob Solari for his support in being here tonight. He then presented and narrated the Power Point entitled "2014 Master Plan Update" (see presentation attached to minutes), which is scheduled to go before the County Commission on September 23 in light of a future RFP, and was seeking Council comment. 4 Regular City Council Meeting August 27, 2014 Page Five Mayor McPartlan said he had a lot of questions going forward. Ms. Coy said it was a great eye-opening presentation, stated Mr. Griffin had done a great job negotiating the City's contract with Mr. Minner, she hoped we go with single stream recycling, and that the proposed 1-1-1 concept is very exciting to her because we currently have two trash days, one yard waste and one recycling day for a total of four pickups. She said with proper recycling there is no reason for too much garbage, said she was proud of Sebastian and the number of people who participate in trash pickup but disappointed that it is difficult to get more people to recycle, and part of the reason is they are lazy. She said she wants to be in the process with the County noting they could learn from our bid process which was very competitive. Mayor McPartlan and Mr. Gillmor expressed concern for closing the Roseland and Fellsmere stations. Mr. Gillmor said he did not understand why people wouldn't want their trash picked up, cited his previous Key's mandatory pickup which was not good, noted here it is a choice and 54% participate, and defended people's right to take their trash to the centers since they pay for it. Mr. Hill said this is an important and timely issue, had worked with Himanshu Mehta for years, that dual stream recycling is a financial barrier to our business community, understood the need to close convenience centers, was not concerned Fellsmere would close after the millions that were spent, that the 1-1-1 method and getting to single stream is important and cost effective. Mr. Adams asked if people can request a smaller size recycling bin and Mr. Burke said there are three sizes (35, 65 and 95 gallon) will be available with the 65 gallon as the default, and determining who pays for the bins will be considered. Ms. Coy noted the City got their bins for free as part of the deal. Mayor McPartlan complimented Mr. Burke stating he is extremely professional and that he knows his subject very well. Himanshu Mehta said potentially the convenience centers could be repurposed, if we go to universal collection costs could be lowered, and noted this issue will tentatively go before the County Commission on September 23. Ms. Coy said Sebastian customers have individual garbage contracts which are set in stone, and if the centers close she would hope her county landfill fee would go down, so she is not paying for a service she does not use except for the landfill. Mr. Mehta responded that part of the assessment is for recycling pickup and disposal. Damien Gilliams, 1623 US 1 Sebastian, said he had been in front of Council requesting this for three or four years, suggesting with wheels on carts the percentage of use goes up, this is long overdue and it is shameful it took this long. Mayor McPartlan reiterated the item would go before the commission on September 23. Mr. Burke said solid waste operates as an enterprise fund and recyclables are a commodity, and the idea is to find the best method to increase the return on that commodity so we don't have to raise the assessment for our residents. He thanked Council for the opportunity to address them and said he would take their comments back. 5 Regular City Council Meeting August 27, 2014 Page Six 14.127 B. One Blood PP Presentation —Wendy Przedweicki, Community Relations Coordinator (No Backup) Wendy Przedweicki, One Blood, gave a Power Point presentation (see presentation attached) on the newly formed group which was consolidated from three organizations to coordinate efforts. She said her goal in being before Council was to find ways to reach out to the public and bring more donors in, and partner with the business community. She asked that they continue to partner with One Blood and help educate donors. 14.006 C. Michael Gardner, VP Marketing and Communications VNA Hospice and Frannie Southern, Earl's Hideaway — Presentation and Request for Approval for "Weekend on Wheels Event" October 25 & 26, 2014 in Riverview Park, Sebastian Tiki and Earl's Hideaway (Transmittal, VNA Letter, Park Use and Stage Permit Applications) Frannie Southern, Blessing of the Bikes, said they had to postpone the proposed March event due to other conflicting events, and introduced Mr. Gardner from VNA Hospice. She said they were amending their request to ask for a road closing shown on a new schematic she provide prior to the meeting (see attached), so that motorcycle could park on Indian River Drive with one or two lane closings during the blessing rather than the grass area. She said the Lion's Club will assist, asked if they could borrow some City barricades and said they are paying for police assistance. Michael Gardner, VNA, said this is a benefit for VNA and there will be educational booths for VNA and Testifire outreach and briefly described the planned events. The City Manager said he had been informed about this this yesterday and said he believed we can make this work. Ms. Southern invited One Blood to be part of the event. Resolution No. R-14-16 — P Quarter Budget Amendment (Transmittal, R-14-16, Quarterly Financial Report) A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, AMENDING THE BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2013 AND ENDING SEPTEMBER 30, 2014 AS PROVIDED FOR IN EXHIBIT `A'; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. The City Attorney read R-14-16 by title. The Finance Director stated this is the City's normal quarterly reporting, that three of the proposed changes for project funding had been withdrawn at this time so he had provided a revised resolution tonight. He said those items required additional discussion and will be brought forward on a future agenda. He reviewed the overall status of the current year budget, noted the Budget Review Advisory Board met the night before and did not have a quorum at their last meeting but conducted a workshop and indicated they were supportive of the amendments and recommended Council approval. n Regular City Council Meeting August 27, 2014 Page Seven He said Mr. Gillmor had a question about Golf Course numbers, and that he would be looking into this further to see if corrections needed to be made, then went on to briefly review the Cl P report, investment report, and departmental reports. Mr. Hill said he thought it prudent to table this until we get answers on the Golf Course, and Mr. Adams concurred. Mr. Hill asked the City Attorney if we should defer or table and the City Attorney stated "defer". MOTION by Mr. Hill and SECOND by Mr. Adams to defer to the next Council meeting. Resolution No. R-14-18 — Request for Lagoon Funding — Baffle Boxes (Transmittal, R-14-18) A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, REQUESTING THE GOVERNOR OF THE STATE OF FLORIDA TO TASK THE DEPARTMENT OF ECONOMIC OPPORTUNITY WITH PROVIDING FUNDING TO THE FLORIDA DEPARTMENT OF TRANSPORTATION TO ASSIST THE CITY OF SEBASTIAN WITH MATCHING FUNDS TO RETROFIT FDOT OUTFALLS IN THE CITY OF SEBASTIAN WITH MODERN BAFFLE BOX TECHNOLOGY TO HELP ALLEVIATE POLLUTION FROM ENTERING THE INDIAN RIVER LAGOON. The City Attorney read R-14-18 by title . The City Manager noted this was brought forward by Council Member Gillmor. MOTION by Mr. Hill and SECOND by Mayor McPartlan to approve. Roll Call: Ayes: Coy, Gillmor, McPartlan, Hill, Adams Nays: None Passed: 5-0 Ms. Coy suggested this be sent to all of our State Senators and Representatives. 13. CITY ATTORNEY MATTERS 14.018 A. Authority to Meet with Indian River County Attorney and All Aboard Florida Relatinq to Rail Crossing Agreements (No Backup) The City Attorney requested authorization to attend a meeting with the Indian River County Attorney and All Aboard Florida in regard to the crossing agreements on September 15th and will not agree to anything without Council approval. Mayor McPartlan said "go forth" and there was no objection from Council. The City Attorney said Council as Board of Adjustment approved a variance for a motel facility for Captain Hiram's which was challenged in the courts by Mr. Gilliams, and reported that the appellate court has dismissed the challenge. 14. CITY MANAGER MATTERS 14.149 A. Fundraisinq Event for Indian River Historical Society (No Backup) The City Manager said the City is partnering with the Indian River County Historical Society on the Working Waterfront Museum and they have asked for an early 2015 fundraising event at the site, which he stated, he did not believe counted toward the two events allowed for the fishermen. There was no objection from Council. 7 Regular City Council Meeting August 27, 2014 Page Eight 15. CITY CLERK MATTERS - None 16. CITY COUNCIL MATTERS A. Mayor McPartlan Mayor McPartlan said there is a dire need for foster homes, and provided a foster family training schedule, asking that it be posted; announced a NOPE presentation by Sheriff Loar on September 4t' to address the opiate problem in the community, said we need to be educated on the issue of medical marijuana should it pass in November, and said he had spoken to Justice Hawley at a recent juvenile drug court graduation and asked him if they could do some sort of community service in the north county such as cleaning up parks and washing police vehicles. The City Attorney said in light of amendment two on the ballot a number of communities are looking at zoning ordinances so they are prepared to have facilities in certain zones and he had provided that information to the Community Development Director. He said he can bring this forward for first reading in the near future, and there is a possibility that the County may enact a countywide ordinance and we can buy into that. Mayor McPartlan said he would be interested in that, noting that it has been stated that 1800 facilities could be opening up for business if the amendment passes. B. Vice Mavor Hill - None C. Council Member Adams Mr. Adams asked if it is up to the City to designate school zones or the State, and the City Manager said he was not sure but would find out, though we control school crossing zones. Mr. Adams noted concern about Fleming by the Charter Junior High and by the Sebastian Middle School on 512, he did not see zones. The Community Development Director said regulation is a combination of school district and local agencies, and are set by levels of walking students and traffic. He said we can ask the school district on the issue of the middle school, and the issues of signage outside the school property is responsibility of the local agency in which it lies. D. Council Member Coy 14.150 i. Discussion — Youth Advisory Council (No Backup) Ms. Coy said she was seeking Council approval for creation of a Youth Advisory Council advisory to City Council, has spoken to PD staff and said we could follow Florida League of Cities guidelines already established. She said they could advise the Council on future plans and projects, and could attend other board meetings such as Parks and Recreation. Mayor McPartlan said at the last juvenile justice meeting the subject of things to do in Vero Beach came up and he asked what about the north area of county, and then he was invited to the next meeting where they talked about creating focus groups to find out what they want. Ms. Coy cited a former group of agencies which was a big effort for youth and the only thing is produced was a list, and not youth were involved, so we can get input from the middle and high school. She asked the City Clerk to send the FLC flyer to Council members and she will get the wheels going and bring back a report in a month or so. Regular City Council Meeting August 27, 2014 Page Nine E. Council Member Gillmor Mr. Gillmor discussed the Florida League of Cities Annual Conference, said the seminars were good, he had brought back information from Comcast whereby they were establishing a program for the 2014-2015 school year to provide internet access for $9.95 per month for low income households and at least one child in the national school lunch program, as well as offering a low cost computer purchase program if you can meet certain criteria. He said he would leave the information with the City for posting. Mr. Gillmor also talked about other ideas he heard about at the conference such as eucalyptus mulch, solar outdoor lighting which could light or Golf Course restrooms, and Soldier for Life community covenant which he shared with Ms. Coy. She said she can provide it to the Veterans Council. Mr. Gillmor asked the City Manager to bring forward water testing results at the next meeting. 17. All general provisions for use of City Recreational Facilities as set out in the Code of Ordinances shall apply. CODE OF ORDINANCES CHAPTER 74 SECTIONS Sec. 74-1. Definitions. The following words, terms and phrases, whenG used in this Article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: Enclosed Public -Use Facilities means those city properties such as the Yacht Club and Community Center, which by their very nature, are generally best utilized by designated groups for meetings, events and private parties. Open -Air Public Use Facilities means those city properties such as the ball fields of the Barber Street Sports Complex, the sketepark facility, that by their very nature, are generally best utilized by either the general public or designated groups for sporting events, and may be leased on a long-term basis to specific organizations. Park Areas means any and all outdoor and covered grounds and facilities owned, operated or designed by the City for the purposes of recreational or leisure activities, except those facilities designated as Waterway Facilities or Public -Use Facilities. Park Event means utilization of a Recreation Facility, other than an enclosed Public -Use Facility, or any portion thereof for any planned or organized event, other than a city -sponsored event, at which the City Manager reasonably believes between 50 and 300 persons will attend. Recreation Facilities means any and all real property owned or maintained by the City for the purposes of active or passive recreation, community and civic gatherings, open space and such other traditionally related activities. However, these provisions shall specifically not apply to the Sebastian Municipal Golf Course. Special Event means utilization of a Recreation Facility, other than an enclosed Public -Use Facility, or any portion thereof for any planned or organized event, other than a city -sponsored event, at which the City Manager reasonably believes more than 300 persons will attend. Waterway Facilities means any structure constructed on or over the waterways of the City such as a public dock, boat ramp, seawall or boardwalk, as well any pedestrian walkway onstructed or maintained by the City running over or along its waterways. Sec. 74-2 Dealt nation by Resolution. Thu City Council shall, by resolution, designate the classification, and the fees, where applicable, for use of each Recreation Facility in the City. Sec. 74-3. Regulations; promulgation and approval by resolution. (a) The City Manager is hereby empowered and authorized to adopt, promulgate and enforce reasonable rules and regulations which shall apply to City Recreational Facilities. (b) All rules and regulations promulgated and adopted pursuant to this article shall, in order to be effective, be posted in a conspicuous place In the area where they are intended to be effective. The existence of such signs at any place within the City shall be prima facie evidence such signs were erected or placed with the authority of the City Manager. (c) Any person violating any such rule or regulation promulgated and posted pursuant to this article shall be subject to a fine of up to $500.00. (d) The City Council may by resolution, remove or modify any regulation promulgated pursuant to this section. Sec. 74-4. General Regulations for Recreational Facilities. (a) Prohibited conduct; unlawful acts. No person shall: (1) Use profane, obscene or threatening language or conduct within the area which unreasonably interferes with the enjoyment of the Recreational Facility by others. (2) Smoke in buildings or other areas except where designated by signs posted by the City Manager or his designee. (3) Knowingly interfere with, encumber, obstruct or render dangerous any part of a Facility. (4) Enter or leave any park facility by motor vehicle except at established entrance ways or exits, or at established times. (5) Use an electronic public address system or other mechanical sound amplification devices, Including adios and electronic sound reproduction equipment of any kind at such a high volume level as to unreasonably interfere with the use and enjoyment by others of the facility. (6) Build or set fires except on cooking grills or self-contained cooking units in specified areas or upon written approval of the City Manager. (7) Possess, consume or serve any alcoholic or intoxicating beverages in any area therein unless in accordance with regulations allowing the same in conjunction with a City -sponsored event, or as authorized by city permit for a function held at a Public -Use Facility. (8) Cause or permit a dog or other domestic animal, other than a service animal within the scope of Fla. Stat. 413.08, to enter the area unless such pet is maintained on a leash of six feet or less. No dogs or other domestic animals shall be brought into any enclosed public -use facility except in accordance with the aforementioned statute. (g) Dump, deposit or leave any bottles, broken glass, ashes, paper, boxes, cans, dirt, rubbish, waste, garbage, refuse or other trash anywhere on the grounds of the parks other than in proper receptacles provided therefore, and no such refuse or trash shall be placed in any waters in, or contiguous to, the parks or beach areas. Where receptacles are not so provided, all such rubbish or waste shall be carried away from the park by the person responsible for As presence and properly disposed of elsewhere. (10) Drive or park any unauthorized motor vehicle on any area within any park or recreational area except designated park roads or parking areas; park any motor vehicle that is not authorized by the City Manager in any area other than an established or designated parking area: or park any motor vehicle that is not authorized by the City Manager within any Recreational Facility during the established hours that said area is closed to the public. 01) Ride a bicycle on other than a designated vehicular road or path dsignated for that purpose; leave a bicycle In any place other than a bicycle rack when such is provided, or leave a bicycle lying on the ground or paving or any place or position so as to present any obstruction to pedestrian or vehicular traffic. (12) Post public notices of a non-commercial nature except in designated areas and in accordance with time and place restrictions established by the City Manager. (13) Operate a concession; sell, peddle, or solicit sell in any park without wrilten prior approval of the City Manager or his designee. (14) Bed down or sleep in parks or recreational areas including any parking area except upon written approval of the City Manager, nor shall camper trucks, buses or trailers be permitted to remain In such parking area between the hours of 12 midnight and 6:00 a.m, except boat trailers may remain in areas designated for the parking thereof during the time between launch and return of the watercraft it has transported. (b) Signage. The City Manager is hereby empowered and authorized to regulate the use of Recreational Facilities within the context of this article by erecting or placing of signs regulating such use and hours of use. (c) Violations and penalties. Violations of this section are punishable by a fine not exceeding $500.00 or imprisonment not exceeding 60 days, or both. (d) Parental liability. Parents shall be held liable for conduct of their minor children." Sec. 745. Additional Regulations Affecting Waterway Facilities. (a) Prohibited conduct; unlawful acts. In addition to the restrictions set -forth elsewhere in this Chapter, no person shall within or upon Waterway Facilities: (1) Dive or jump into the water from such facility. (2) Use railings or benches on piers or riverwalks for cleaning or cutting ball or fish. (3) Push, propel or ride bicycles, scooters, skates or skateboards on piers or docks. (4) Fish with more than two lines or poles at one time on piers or rivenvalks, (5) Park or dock watercraft utilized for a commercial purposes, including rental to the public, longer than reasonably necessary to launch or retrieve the some. (b) Signage, The City Manager is empowered and authorized to further regulate Waterway Facilities within the context of this article by erecting or placing of signs governing their use. The existence of such signs at any place within the city shall be prima facie evidence that such signs were erected or placed with the authority of the City Manager. (c) Violations and penalties. Violations of this section are punishable by a fine not exceeding $500.00 or imprisonment not exceeding 60 days, or both. (d) Parental liability. Parents shall be held liable for conduct of their minor children. Sec. 74-6. Park event permits. (a) No person shell conduct a Park Event without the prior approval of the City Manager. Any person desiring to conduct a Park Event shall submit a written application to the Recreation Department on forms promulgated by the City Manager and shall pay fees as established by resolution of the City Council. Further conditions for park event permit approval may be set out by resolution of the City Council." Sec. 74-7 Special event permits. (a) No person shall conduct a Special Event without the prior approval of the City Council. Any person desiring to conduct a Special Event shall submit a written permit application to the Recreation Department on fortes promulgated by the City Manager. The amount of the permit fee and conditions for special event permit approval shell be established by resolution of the City Council. (b) The City Council shall deny an application if the Special Event will unreasonably conflict with public policy or adequate measures cannot be taken by the applicant to protect the public health, safety and welfare. A decision of the City Council to deny, or to grant with conditions, an application made pursuant to this section shall be final. Sec. 74-8. Enclosed public -use facility pernit(This section does not apply (a) No person shall utilize an enclosed public -use facility without the prior approval of the City Manager, except that certain uses shall require City Council approval as set out in paragraph (c) below. Anyone desiring to utilize an enclosed public -use facility shall submit a written application to the Recreation Department on forms promulgated by the City Manager and shall pay fees as established by resolution of the City Council. Further conditions may be set out by resolution of the City Council. (b) No permit shall be granted for the commercial use of an enclosed public -use facility, although fund-raising for non- profit organizations shall be allowed subject to Council approval as set forth below. In the event that gambling activity Is to be a part of the permitted use, the City Council shall make a determination that such activity is not in conflict with the general law of the State of Florida. (c) In the event that the proposed use may include activities involving gambling, alcoholic beverages, the use of a facility after 11:00 p.m., or if a charge for admission, food costs, required donation or other fee is to be assessed, then the permit can only be issued upon approval of the City Council. Sec. 74-9. Claims against security deposit. All or part of the security deposit for any permit issued under this Article shall be forfeited to the City if it is determined by the City Manager that non-compliance with the terms of this Article or conditions of the permit occurred, or if damages to the facilities have occurred which can be attributed to the applicant. The City Manager is authorized to pro -rate the amount of estimated damages and shall return any amount of the deposit in excess of estimated damages. Damages are determined to be either physical destruction to the facilities or costs associated with specific clean-up attributable to the applicant. Any decision of the City Manager may be appealed to the City Council. The City Council may affirm, reverse or modify the decision of the City Manager after considering the facts as presented by both the applicant and the City Manager. Sec. 74-10. Permit rescission. The City Manager is authorized to rescind any permit found in violation of provisions of this Article when it is deemed in the best Interest of the public. Violations of any provisions of this Article may result In the forfeiture of the security deposit as provided above. The decision of the City Manager may be appealed to the City Council. The City Council may affirm, reverse or modify the decision of the City Manager after considering the facts as presented by both the applicant and the City Manager.
