As part of the water management district's permit process, the City received notice that the permit may be challenged by Dr. John Peden, who owns property at 1200 Indian River Drive (See attached diagram). In researching the complaint, staff determined that it is within the City's right to utilize the Washington Street outfall to discharge stormwater as the area is within an FDOT easement. However, Dr. Peden argues that if the City brings additional stormwater, his property is negatively impacted. Staff is of the opinion that the best option for the project is to pipe the outfall in order to protect both parcels (Dr. Peden's property and Tiki Bar) from effects of potential erosion. In designing this project, the City opted not to make this easement improvement because (1) it is FDOT easement; and, (2) would increase project costs. In light of the potential blockage of the permit and because the best design corrects this situation, staff believes that the easement should be improved. The cost of absorbing this project will be realized by being able to move forward with the project quickly and avoiding potential permit challenge costs. Toward that resolution, staff and Dr. Peden have reached an agreement whereby the project can move forward, provided that the City immediately incorporate the Washington Drainage Outfall Improvements into the scope of the project. It is estimated that the scope of these improvements is $10,000, which can be later shared between the City and FDOT. RECOMMENDATION Authorize City Manager to execute CSA #67, payable from the Presidential Street Project Fund (DST at this time). CITY OF SEBASTIAN, FLORIDA WORK AUTHORIZATION FORM CONSULTANT SERVICE AGREEMENT (CSA) Work Authorization No: #CSA -67 Project Identification: Washington Street Drainage Outfall Design IT IS AGREED to undertake the following work in accordance with the provisions of the Neel -Schaffer, Inc. Master Agreement entitled NON-EXCLUSIVE CONTINUING PROFESSIONAL SERVICES AGREEMENT FOR ENGINEERING dated September 4, 2012. Description of Assignment: Neel -Schaffer will provide engineering design service for the preparation of the Washington Street Drainage Outfall Improvements. Our design services will include the following: • Prepare FDOT permit application (4 sets) - $1,000 • Prepare FDOT Drainage Analysis (GEOPAK)- $4,000 • Topographic survey of outfall area - $1,000 • Prepare design plan of outfall pipe/headwall/rip rap - $1,600 Total Fee for Design $7,600 Basis of Compensation/Period of Services: The above referenced Professional Engineering Services for CSA 67 will be performed for the lump sum fee amount of $7,600.
