MINUTES OF REGULAR MEETING
JUNE 20, 2012
Chair Jean Carbano called the meeting to order at 6:00 PM.
The Pledge of Allegiance was said.

Mr. Fortier volunteered to take the position if so moved by a Board member.

NEW BUSINESS:
PROPOSED CHANGES TO CHAPTER 26 OF THE CITY CODE OF
ORDINANCES ENTITLED: BUILDING AND BUILDING REGULATIONS
Mr. Wayne Eseltine, Building Director, reviewed why the changes were necessary,
explaining that some were clean-up items, and some were changes that would bring the
city's code more in line with the current Florida Building Code. The Board was given a
Power Point presentation which highlighted the new wind speed maps, and changes being
proposed to various sections of the chapter. (See attached)
The Board had questions regarding the proposed changes to contractor licensing and test
scores for reciprocity, and the test sponsoring process.
Mr. Fortier, and the other Board members, thanked Mr. Eseltine, and his staff, for the
time they put in addressing the changes, and the clear presentation.

HIGHLIGHTS OF PROPOSED
CHANGES TO CHAPTER 26 OF THE
CITY CODE OF ORDINANCES
• Chapter 26 of the Code of Ordinances entitled:
Building and Building Regulations
• Due to recent changes to the Florida Building Code, it
has become necessary to make modifications to this
chapter.
• Many places within specific sections of Chapter 26
also required modifications and updates to current
standards. These changes were made as well.
Article II
Building Code
Section 26-31 Technical Codes Adopted:
Model Administrative Code:
The Florida Building Code is mandated by Florida Statute and can not be modified in any way witl-
the exception of Chapter 1 - Administration. The proposed amendments to this chapter of the
building code comes from The Model Administrative Code 2010 produced by the Building Officials
Association of Florida. This standard is adopted by reference in Section 26-31. This standard is
widely adopted by municipalities state wide and is updated every three years with every new
building code cycle. Many of the amendments added are for the purpose of clarification and
adherence to statutory requirements.
Wind Speeds:
The current adopted wind speed for Sebastian is 140 mph @ 3 second gusts. Which was based
on the 2001 Florida Building. The new 2010 Florida Building Code became effective on March 15,
2012 and is based on a new engineering code known as ASCE7-10 which uses Ultimate Winds
Speeds. As a result there are now three new wind speed maps depending on the risk category
classification of a particular building. The proposed adopted wind speeds for Sebastian will now
be 150, 160 and 170 mph Ultimate Wind Speeds. This change is consistent with what has already
been adopted by Indian River County.

Building Code

• Wind speed lines have changed because of the improved science
(i.e. computer simulations).
• The updated maps are based on a new and more complete analysis
of hurricane characteristics performed over the past 10 years.
• The wind speed indicated for each wind speed line is different for
the 2010 standard due to changes in wind speed calculation
philosophy.
RISK CATEGORY AND NATURE OF OCCUPANCY
I
Buildings and other structures that represent a low hazard to human life in the event of failure, including but not limited to:
• Agricultural facilities.
• Certain temporary facilities.
• Minor storage facilities.
II Buildings and other structures except those listed in Occupancy Categories I. III and IV
III
Buildings and other structures that represent a substantial hazard to human life in the event of failure, including but not limited to:
• Buildings and other structures whose primary occupancy is public assembly with an occupant load greater than 300.
• Buildings and other structures containing elementary school, secondary school or day care facilities with an occupant load greater than 250.
• Buildings and other structures containing adult education facilities, such as colleges and universities, with an occupant load greater than 500.
• Group 1-2 occupancies with an occupant load of 50 or more resident patients but not having surgery or emergency treatment facilities.
• Group 1-3 occupancies.
• Any other occupancy with an occupant load greater than 5,000a.
• Power -generating stations, water treatment facilities for potable water, waste water treatment facilities and other public utility facilities not
included in
Occupancy Category IV.
• Buildings and other structures not included in Occupancy Category IV containing sufficient quantities of toxic or explosive substances to be
dangerous
to the public if released.

Buildings and other structures designated as essential facilities, including but not limited to:
• Group 1-2 occupancies having surgery or emergency treatment facilities.
• Fire, rescue, ambulance and police stations and emergency vehicle garages.
• Designated earthquake, hurricane or other emergency shelters.
• Designated emergency preparedness, communications and operations centers and other facilities required for emergency response.
• Power -generating stations and other public utility facilities required as emergency backup facilities for Occupancy Category IV structures.
• Structures containing highly toxic materials as defined by Section 307 where the quantity of the material exceeds the maximum allowable

• Aviation control towers, air traffic control centers and emergency aircraft hangars.

Building Code
EFFECT OF NEW WIND SPEEDS AND DESIGN PRESSURES:
The new code uses new calculation methods and higher wind speeds to
determine design pressures on buildings and building components.
However; when the design pressures are determined using the new
formulas to convert Ultimate Wind Speeds to Nominal Wind Speeds the end
result is the design pressures for buildings and building components roughly
stay the same or are slightly less than they were in previous code editions.
This has had little or no effect on construction industry methods or products.
Important Note:
Ultimate Wind Speeds are not the same as Fastest Mile Wind Speeds.
Even though most construction will be to the 160 mph ultimate wind speed
this translates to approximately 120 mph fastest mile wind speed. These are
the sustained wind speeds that we speak about when a storm is
approaching.
We are not building homes or other structures to withstand a 160 mph
sustained wind.

Building Code
Section 26-34 — Unsafe Structures Abatement Code:
• Previously this section of the code referenced the
Standard Unsafe Building Abatement Code which is a
1985 code edition.
• The proposed changes incorporate specific language
from the 2012 edition of the International Property
Maintenance Code. These provisions deal with the
abatement of unsafe structures in the event that such an
occurrence would jeopardize the health, safety and
welfare of the public. This code reference is widely used
throughout the state of Florida.

Section 26-40 - Construction Board to serve as
board of Appeals:
• Language was added to expand and clarify the board's role in
hearing appeals on decisions made by the Building Official
and/or Community Development Director
Section 26-66 — Powers and Duties of the Building
Official:
• Much of the language was relocated from what was previously
Article III — Electrical Code. Modifications were made to
encompass all construction related activities.

Permits
Section 26-81- Required; application:
• Again, much of this language was relocated from the former
electrical code section and modified to encompass all types of
construction.
Section 26-85 — Conditions of permit:
• Additional language was inserted to clarify time limitations on
building permits and be consistent with Florida Building Code
requirements.
Section 26-87 — Inspections:
• Language was relocated from the former electrical code section and
modified to encompass all types of construction.

Swimming Pools
Section 26-138 — Enclosure Required
• Clarification of pool barrier requirements to
prevent accidental drowning in accordance with
the Florida Building Code and Statutory
requirements.
Article VI
Contractors
• Specific language related to sponsoring applicants for contractor
license testing was deleted throughout this section of the code. The
city no longer provides this service due to staff reductions. This was
administratively approved in 2006.
• The city accepts test scores from other jurisdictions through
reciprocity and issues local licenses to contractor's. Test score
requirements through reciprocity were reduced from 75% passing to
70% passing to be consistent with Indian River County.
Section 26-267- Fees
• Fee schedule was adjusted to reflect current rates for licensure
renewal. City of Sebastian rates are equal to or lower than St. Lucie,
Indian River and Brevard Counties.
