Meeting was called to order by Ch. Carbano at 6:00 P.M. Pledge of Allegiance was led by Ch. Carbano. ROLL CALL: Present: Mr. Berry Mr. Hosey Mr. Fortier Mr.Dalessandro Mr. Redden Ch. Carbano APPROVAL OF MINUTES: Regular meeting held September 18, 2012. I make a motion we approve the minutes of meeting held September 18, 2011 with the correction of the year to 2012. MOTION: Fortier / Berry A voice vote was taken — passed unanimously. ANNOUNCEMENTS: None OLD BUSINESS: None NI 91111A 118M I L11 W&I IN THE MATTER OF MR. ROBERTO BERLINGIERI DBA Right Choice Plumbing, LLC; State of Florida License No. CFC 1427711 Summary of findings: Mr. Alan Curtin, agent for Right Choice Plumbing, LLC entered into a contract to replace plumbing lines, faucets, and hot water heater without the knowledge of the qualifier Roberto Berlingieri. Contract included permit fees, but no permit was obtained. Complaint filed by homeowner due to quality of work, and length of time the job is taking to be completed. Violations: Under Section 26-172(1) — willful disregard of the applicable building codes. Florida Building Code 105. 1, performing work without a building permit. Mr. Eseltine read from the packet of staff findings. The complaint was received be the building department from the homeowner regarding some plumbing work that was performed by Right Choice Plumbing. Only a water hook up permit had been issued in May of this year, but the homeowner had a contract from March 23, 2013 to re -pipe the entire house including new faucets, and hot water heater. The homeowner was not happy with the work, and on June 12, 2013 a citation was written to the contractor with a fine of $300.00 per City Resolution. On June 24, 2013 Mr. Alan Curtin, representative for Right Choice Plumbing attempted to comply by coming in with a check for $300.00, but the permit application was not accepted because it was not signed by the qualifier. The check was returned by the bank NSF. Mr. Curtin was notified to bring in cash with the application signed by the qualifier. Mr. Curtin was again notified on July 23, 2013, September 5, 2013, and September 23, 2013, each time asking for an additional two weeks to comply. On October 8, 2013 Mr. Berlingieri was sent a notice to appear before the Construction Board. Mr. Curtin again came into the building department on October 11, 2013 with the $300.00, and was informed he also needed to pay the NSF fee of $20.00, and again did not have the application signed by the qualifier. Mr. Berlingieri has paid all outstanding fees, and has been issued a permit, inspections have been performed. Mr. Berlingieri stated that he was not aware of this contract, and that a permit application was never brought to him for signature. After much discussion, a motion was made to suspend the license for Right Choice Plumbing for six months in the city of Sebastian, and to pay fine of $500.00. MOTION: Fortier / Hosey ROLL CALL: Mr. Dalessandro Ms. Carbano Mr. Hosey Mr. Fortier Mr. Redden Mr. Berry MOTION CARRIES: 6-0 IN THE MATTER OF MR. PATRICK SILAS Dba Patrick J. Silas Jr Land Development Co., LLC; State of Florida License No. CBC1254328. Summary of findings: Mr. Patrick Silas Jr., entered in to a contract to add an addition to a home. The homeowner stated the contractor has abandoned the project, and did not adequately waterproof the roof where it tied into the main roof structure causing leaks inside the home resulting in mold. Violations: Section 12-172(5) — Diversion of funds received for completion of a specified construction project or operation or as a result of the diversion the contractor is or will be unable to fill the terms of his obligation or contract. Section 26-172(10) — abandonment of a construction project in which the contractor is engaged or under contract as a contractor a project is to be considered abandoned if the contractor terminates such project without notification to the current owner for at least 30 days without just cause. Mr. Eseltine read from the packet of staff findings. The complaint was received be the building department from the homeowner regarding unfinished work at his home. The contractor had stated through a text message on January 7, 2013, to the homeowner that he could not complete the job for the quoted amount and that he did not do due diligence when pricing this job. After much discussion a motion was made on violation of section 26-172(10) that we refuse to issue building permits for an indefinite period to protect health and safety of citizens from the company Patrick L Silas Jr. Land Development Company, and fine him $500.00 for the violation. MOTION: Fortier / Carbano ROLL CALL: Mr. Redden Mr. Berry Mr. Fortier Ms. Carbano Mr. Dalessandro Mr. Hosey MOTION CARRIES: 6-0 Motion on section 12-172(5) diversion of funds that Mr. Patrick L. Silas of Patrick L. Silas Jr., Land Development Company be fined $500.00 and his permittingprivileges be suspended indefinitely for the City of Sabastian. MOTION: Carbano / Fortier ROLL CALL: Mr. Redden Mr. Berry Mr. Fortier Ms. Carbano Mr. Dalessandro Mr. Hosey MOTION CARRIES: 6-0 Motion amended on section 12-172(5) to say if we receive documentation within 30 days that he spent the funds given him on labor and materials for the then he will be released on the $500.00 fine on this violation. MOTION: Carbano /Redden ROLL CALL: Mr. Fortier Mr. Redden Mr. Hosey Ms. Carbano Mr. Dalessandro Mr. Berry MOTION CARRIES: 6-0 BUILDING OFFICIAL MATTERS: Building of single family homes is up. For FY 2011/2012, 61 permits we issued for single family homes. For FY 2012/2013, we did 168 single family homes. Inspections for FY 2011/2012 were 5625, and up to 8692 for FY 2012/2013. Commercial is about the same. And gave update on HB 269 witch has made changes to FS 489. BOARD MATTERS: None Meeting Adjourned 7:38 PM
