HomeMy WebLinkAboutR-14-31 Disabilities Advisory CommitteeRESOLUTION NO. R-14-31 A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, AMENDING RESOLUTION NO. R-01-80 TO RE-ESTABLISH AND RENAME THE EXISTING "HANDICAPPED SELF-EVALUTION COMMITTEE" TO BE NAMED THE "DISABILITIES ADVISORY COMMITTEE"; PROVIDING FOR MEMBERSHIP, LIAISON, AND GOALS AND OBJECTIVES; PROVIDING FOR REPEAL OF RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Handicapped Self -Evaluation Committee has been an advisory standing committee of City Council since first established by Standing Committees Resolution No. R-84-16; and WHEREAS, upon the enactment of the Americans with Disabilities Act in 1990, handicapped accessibility for all City properties and facilities was regulated by Federal law; and WHEREAS, in 1991, the City Manager made a recommendation to the City Council to disband the committee due to the ADA regulations and recent inactivity of the committee, however, the City Council asked that the role of the committee be redefined and Resolution No. R-01-80 was adopted, re-establishing the committee, assigning the Human Resources Director as liaison, and providing a new goal of evaluating all City of Sebastian owned and operated facilities open to the public ensure individuals with disabilities have equal access; and WHEREAS, the Handicapped Self -Evaluation Committee met briefly in 2001 and 2002 and once again it became difficult to fill vacancies on the committee; and WHEREAS, the City Manager finds it in the City's best interest to re-establish and rename a "Disabilities Advisory Committee" for the City of Sebastian to advise City staff and Council on needs for the disabled in the City and recommends adoption of Resolution No. R-14-31. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, as follows: SECTION 1. CREATION OF "DISABILITIES ADVISORY COMMITTEE". The City Council hereby re-establishes a committee to be named "Disabilities Advisory Committee", to advise City Council and City staff on equal accessibility to City of Sebastian properties and facilities for individuals with disabilities. SECTION 2. MEMBERSHIP AND LIAISON. The Disabilities Advisory Committee shall be composed of five members appointed by City Council through the application process set out in Chapter 2 of the Code of Ordinances. The City Manager shall act as liaison to the Committee. SECTION 3. MISSION, GOALS AND OBJECTIVES. The Disabilities Advisory Committee shall provide an effective process for evaluation of City of Sebastian owned and operated facilities to ensure that all facilities are equally accessible to individuals with disabilities. Committee members will conduct evaluations on City properties and facilities accessible to the general public, including parking lots, permitting offices, council chambers, city hall, restrooms, etc., and will submit a report to the City Manager to express concerns and inquiries for review. The Committee will meet at the request of the City Manager, no less than two times per year, to share their views and be updated on status of facility evaluations. The City Manager will report facility evaluation reports and resulting actions of City Staff to City Council. SECTION 4. SUNSET PROVISION. In accordance with Chapter 2 of the Code of Ordinances, "Committee shall mean any temporary committee or commission of the city, which is established by resolution to study a specific problem and recommend a solution or policy alternative within a time certain. Its existence shall terminate upon the completion of its assignment or on a date certain as provided by the resolution creating the committee or commission". Unless re-established by a succeeding Council resolution on or before December 31, 2019, this advisory committee shall be disbanded. SECTION 5. CONFLICT. All resolutions or parts of resolutions in conflict herewith are hereby repealed, including Resolution No. R-01-80. SECTION 6. EFFECTIVE DATE. This Resolution shall take effect upon its adoption.
