FS., hearing based on the notice of proposed District action shall have the right to request such a hearing within 14 days of receipt of the notice of final action, otherwise such right is deemed waived. History—New 8-1.89. 40C-1.609 Suspension, Revocation or Modification of licenses or Permits (1) The District shall suspend a license or permit when it determines that the licensee or his agent has: (a) violated chapter 373, FS., and the rules promulgated thereunder, or any other provision of Florida law related to the operations of the District; (b) failed to comply with an administrative order issued pursuant to section 373.119, FS.; (c) violated the terms of a license ora condition of the permit; or (d) failed to allow inspection of the subject property. (2) The District shall revoke a license or permit when it determines that the licensee or his agent has: (a) submitted false or inaccurate information on an application, operational report or completion report; (b) committed three or more repetitive violations as set forth in subsection (1) above; (c) allowed a violation to continue after District direction to remedy it. (3) The District shall revoke a permit or modify its terms when it determines such an action is necessary to protect the public health, safety and welfare, prevent a public or private nuisance or when the continued utilization of the permit becomes inconsistent with the objectives of the District. (4) The provisionsof subsecdons (1)—(3) shall not preclude the District from exercising other enforcement remedies pursuant to chapters 120 and 373, FS., when it determines such action is necessary and appropriate either in addition to or instead of suspension or revocation described above. A determination under this subsection shall be based on the extent of damage or potential for damage due to the violation, the need for immediate action and the kind of sanction which would most likely deter future violations of a similar nature. (1) Holders of renewable licenses or permits shall make timely and sufficient application for renewal so as to avoid expiration during the renewal process. When timely and sufficient application is made, the existing license or permit shall not expire until final agency action, or if the permit is denied or the terms limited, until the last day for seeking review of the District order or a later date fixed by order of the reviewing court. (2) Applications for extension of time limits or time frames of permits or licenses issued by the District may be applied for and will be treated as modifications of the permit or license. (3) Application for a license or permit renewal is timely only if actually filed at the District prior to expiration of the existing license or permit. (1) Transfer of Permitted Facility. Within 30 days of any sale, conveyance, or other transfer of a facility, system, or well permitted by the District, the existing permittee must notify the District, in writing, of such transfer, giving the name and address of the transferee and providing a copy of the instrument effectuating the transfer. (2) Transfer of Interest in Real Property. Within 30 days of any transfer of ownership or control of the real property at which any permitted facility, system, consumptive use, or activity is located the permittee must notify the District, in writing, of the transfer, giving the name and address of the new owner or person in control and providing a copy of the instrument effectuating the transfer. (3) Transfer of Permit. To transfer a permit, the permittee must provide the information required in subsections (1) and (2), together with a written statement from the proposed transferee that it will bound by all terms and conditions of the permit. Additionally, where applicable, the transferee must demonstrate that it is capable of constructing, operating and maintaining the permitted facility, system, consumptive use, well or activity. Use Permit No. 2-061-0142UNR-Sebastian In conjunction with Mr. Leighton Hew's letter of December 16, 1993, in reference to the above, the City of Sebastian is willing to comply with all conditions of the Consumptive Use Permit No. 2- 061-0142UNR as required. The City of Sebastian is employing the GDU employees at the Filbert Street Water Treatment Plant where the wells are located. These employees have been responsible for operating and maintaining the wells in addition to the plant and will continue to do so under the employment of the City. In view of the information provided to you, I request that the St. Johns River Water Management District transfer the referenced permit from General Development Utilities, Inc. to the City of Sebastian as soon as possible.
