Sneakers 1. Walter Barnes - President of the Sebastian Highlands Property Owners Association Walter took a poll of membership of 27 people, 23% of the membership of the Sebastian Highlands Property Owners Association. 48% want to see the Utilities System sold 30% had no opinion 22% want to keep the system 100% Walter expressed the opinion that the system could not be run in a professional manner. He said one City Council buys it and says it is a great deal; another Council says it is a "pig -in -a -poke". The City is having trouble running a golf course. It took 2 years to write a tree ordinance. People have lost faith in the Government of Sebastian. Walter questioned mandatory connection to water and mandatory liens - Terry Pinto said that there are only liens for assessments. The County is convinced that it can not require mandatory connection. 2. Mr. "Wojo" Wojokowski spoke incessantly on all sorts of items which lacked focus on making a point and was finally asked to conclude his remarks by the Mayor. Page 2 of 3 - Chapter 180 Hearing July 19, 1995 minutes 3. Ed Miquelon said he was in favor of the County taking over the utilities system. Mr. Miguelon asked if the water meter is still in place would the County require him to pay an impact fee, he said he disconnected from the water system. Terry Pinto said Mr. Miquelon would be considered as a vested customer and no further impact fees would have to be paid. 4. George Reid said that the City paid too much for the water system. To date the City has not done anything to correct the THM problem. 5. Lonnie Powell asked about assessments and what the changes would be made by the County. He wanted an answer as to how much the assessments would cost the residents of Sebastian. Terry Pinto said that it depends on the cost of the water distribution system and how many residents would be sharing the cost. 6. Clay Price lives in Roseland. He asked when the impact fees were determined, who determined them, and when would they go up. He asked about current debt service and longevity of bonds, and about the current rate of interest. Also, if the interest would vary and affect debt service in the long run. He was always against the City being in the water and sewer business. Mr. Koford said that under the rate structure, capitalized interest on the first two years goes from 3.4% to 5%. The reason for increasing the rates was because the bond has a debt -to -revenue ratio. The current interest rate structure is between 5.4% and 5.8%. Clay Price was in favor of having the County operate the water and wastewater systems. Clay has written a report regarding expansion of the water and wastewater system. City Attorney Cliff McClelland stated that in accordance with the Agreement between the City and County, Section 6.03 affords the opportunity for any citizen to have the right to challenge (to sue in court) the reasonableness of the rates. Carolyn Corum expressed concerns about the map in the packet (Item 12) and the map on the wall. She hopes that South Moon Under and San Sebastian Springs are connected to the utilities system. The City has the power to do a special assessment to go into those areas according to Cliff McClelland, Attorney. Carolyn asked about the San Sebastian Lakes Service Area. The agreement with the City went into default. The County provided sewer service. The City took over an existing agreement from GDU. There is a credit of $80,000+ which was paid to GDU. The City has no documentation but recognized the credit in the agreement. Page 3 of 3 -Chapter 180 hearing July 19, 1995 minutes Norma Damp asked no questions. She commented about voting against acquiring the system and was impressed with the County in the negotiations. She is very pleased. Mr. Halloran spoke regarding impact fees. He favors the sale to the County. Mrs. Cartwright said she doesn't feel this is a quick decision. She asked many questions of the staff, manager, and attorney and feels that we ought to sell the system to the County. Mayor Firtion ran for office because he was against the purchase of the water system all along. He said that this is a win-win situation. Attorney read the Resolution by title only; it was approved unanimously. Asher's July 24, 1995 Request for Additional Information In reply to Harry Asher's Request No 1 whereby the County wants a list of galvanized water services in the water distribution system, my response is as follows: The City of Sebastian purchased the water system on Dec 16, 1993. General Development Utilities furnished the City with as -built plans on the water distribution system which revealed that Unit 9 contained the oldest water distribution system in the Sebastian Highlands. Although the type of pipe used for services is not shown on the plans, it is my opinion that galvanized steel pipe services were used exclusively in this unit. Most probably, the 221 lots within blocks 409 through 418 and Block 626 would have galvanized steel pipe services since the water distribution system was installed in the early 19601s. The 51 lots in Blocks 622-625 may or may not have galvanized pipe water services since the water system for these lots was constructed in the early 19701s. Assuming that the water services for these lots are all galvanized, and that 10% are simple services, the possibility exists that there are 26 single services of 3/4" diameter galvanized pipe and 123 double services of 1" diameter galvanized pipe. This is approximate only as none of the GDU as -built drawings show the size and type of water service installed, and water services have been installed at lots after these as built drawings were completed where houses were later constructed. Page 2 of 2 - Harry Asher Requests In reply to Request No 2, the County established the boundaries of Phases 1, 2, and 3; the City of Sebastian Utilities Department did not. I would suggest that the County check with Pat Brown of the Property Appraiser's office who has developed a very accurate map of Sebastian showing all of the 17 units and all replats of Sebastian Highlands shaded in various colors. This letter is in response to your letter of July 27, 1995. Although the Customer Service Representatives, Utilities Department Administrative Assistant, and I have personally explained to you on several occasions why you continue to receive delinquent bills, I will again attempt to provide you with the same explanation in this letter. When you had lived at 141 Crawford Drive, you paid the $30 water and sewer deposit to General Development Utilities in 1980. When the City purchased the General Development Utilities Water and Sewer System in December 1993, General Development Utilities did not forward to the City a deposit but billed you for a deposit of $100, $50 for water and $50 for sewer. Delinquent payments on your account prompted General Development Utilities to reinstate the $50 water and $50 sewer deposits prior to the systems being turned over to the City. Your account history showed that on February 10, 1994, you had paid your water and sewer charges in full but did not pay your deposit. On March 9th, 1994 you neglected to pay $9.62 of your water and sewer charges in addition to the deposit. On April 5, 1994, you failed to pay $5.00 of your water and sewer charges. On May 3, 1994, for some unknown reason, you did not pay $4.83 of your water and sewer charges. From June 9 through August 3, all your water and sewer charges were paid in full but you did not pay anything towards your $100 deposit. On September 2, 1994, you paid your entire bill except for $1 and, of course, the $100 deposit. In addition, each bill paid was consistently late. That is, the bill was always paid after the date it was due. Additional deposits are required when payments are constantly late or bills are not paid in full. You neglected to pay your August 1994, bill for $49.83 and your September 1994, bill for $40.42. Page Two of Three - August 11, 1995 letter to George and Theresa Wood On October 18, 1994, you called me. I researched your file to find that you had a $100 deposit still outstanding from January 1994, your payments had been consistently late, and most of the time payments were not made in full amount of the utlitity bill. On October 21, 1994, I called both of you to explain my findings. My memo to the file documents this. On October 24, 1994, George Wood came to the Utiliites Department office at Main Street and US #1, and entered into a payment agreement to pay the $100 deposit charges on a monthly basis at $20 per month. A copy of the agreement is enclosed. To date, $60 has been paid toward the deposit; $40 is still owed. On February 3, 1995, George Wood came to the Utilities Department office and insisted that the $100 deposit was paid. In fact, only $40 had been paid. Mr. Wood left the office still maintaining that the deposits had been paid in full, the City was at fault, and that he was going to see the City Manager. He left the office without paying anything although the outstanding bills for your account totalled $167.21. The amounts owed them were as follows: Amounts Owed $ 1.00 14.83 45.69 45.69 60.00 Total $167.21 Bill dates 7/29/94 8/30/94 12/31/94 1/31/95 Balance owed on Deposits Due as of February 3rd On February 7, 1995 Mrs. Theresa Wood came into the Utilities Office. She paid $45.69 in current charges plus $20 toward the deposit. At this time, $60 total was paid towards the deposit. I reviewed the account with her and explained how the amount due was determined. Looking at your payment history from February 7, 1995, your payments once again are not consistent with the amount due and are creeping upward in outstanding charges. No payment has been received for the June 28, 1995 and July 27, 1995 bills. Therefore, your outstanding balance totals $155.58. Part of this is the $40 remaining balance for your deposits; $115.58 is for outstanding water and sewer charges. Page Three of Three - August 11, 1995 Memo to George and Theresa Wood To summarize this letter and answer your questions in your letter, I am replying with the following response: 1) You have not paid the $100 deposit in full; you still owe $40. 2) our meter readers read the meters by scraping the sand away. Once done, the sand recovers the meter lens over a short period of time. 3) Water/Sewer bills can be consistently the same month after month if you maintain the same water use habits. 4) Evidence shows that you do not pay your bills every month and when you do pay, the amount on your check is usually less than the amount on the bill which continues to increase the amount owed. Our department has continually worked with you and has explained the above problems on several occasions. I suggest that you visit our customer service representatives, the utilities Department Office and pay the outstanding balance soon. Otherwise, I may be forced into shutting off your water service soon. Sincerely, Richard B. Since that date, the County has given priority to construction of water lines required to connect the Sebastian Highlands water system to the County water system. This will enable the County to improve the water quality by supplying water from the County Reverse Osmosis water plant and to shut down the Filbert Street water plant. The water connections will be complete by December 8, 1995. Prior to establishing full service from the County system the existing system must be flushed to clean out and test the existing Sebastian Highlands system. During the week of December 11, Indian River County Utility Services will be conducting extensive fire hydrant flushing. The purpose is two -fold; one being to clean out main water lines, and the second being testing of the system capability and locating trouble areas. This flushing program will last approximately 2 weeks, with County Utility workers operating hydrants and flushing mains every night, Monday through Friday from 10:00 p.m. until 1:00 a.m. While flushing the system, you may experience the following: 1. Red (rusty) water 2. Particulates in water 3. Turbid water/ice cubes Every effort will be made to eliminate or minimize the effects of the flushing. Customers should be aware of items in their homes which may need servicing such as: 1. Faucet screens 2. Water -saving devices 3. Hot water heaters 4. Indian River County provides water that has been treated by reverse osmosis. This treatment process is considered to be state-of-the-art in water treatment. It typically softens the water to a greater degree than most processes. It also is ideally suited to removing the causes of trihalomethanes in drinking water. There should also be a decrease in turbidity and color of the water. If the water continues to remain red or turbid, you are advised to refrain from doing laundry until the water is clear again. I had the occasion to visit the Indian River County Planning Department regarding bike paths. Keith Burnsed, Planner, mailed me a copy of the 1993 FDOT Transportation Costs booklet, a copy of which is attached for your perusal. The booklet contains unit costs for bicycle and pedestrian facilities, as well as airport and road costs. Also, attached is a copy of the Indian River County Comprehensive Bikeway and Sidewalk Plan. Unfortunately, the map of Existing and Proposed Facilities on pages 31 and 32, and Designated Bikeway Network Plan on page 64, do not accurately display the existing and proposed bike paths in the City of Sebastian. Votapka, Utilities Director SUBJECT: Change of Ownership of Park Place Mobile Home Park Mr. Joe Morozowski, past Vice President of the Park Place Homeowners' Association, called me this morning to tell me that Nelson Hyatt had recently sold Park Place. Mr. Morozowski said that he had an attorney in Vero Beach review the July 11, 1989 County Takeover Agreement between Indian River County and Nelson Hyatt, with specific regard to the payment of the $10.00 monthly surcharge. The attorney informed Mr. Morozowski that there was no provision in the Agreement which allowed the City to continue collecting the surcharge for a new owner. Based on the attorney's opinion, Mr. Morozowski will not pay the $10.00 surcharge on this month's utility bill. I informed Mr. Morozowski that I would bring this matter to your attention, but unless I received authorization from you, I could not automatically discontinue the collection of the surcharge on a monthly basis. Although the issue is a legal one, I am of the opinion that the Takeover Agreement mandates the City to collect the $10.00 surcharge for Nelson Hyatt regardless of whether or not he sells Park Place. The surcharge is payment to Nelson Hyatt for the improvements he made when he constructed the utility system. I would like your opinion and/or that of our City Attorney on this matter, so that I can contact Joe Morozowski before the due date of his next bill in February. Also, now that Park Place has been sold, will the City now have to negotiate with the new owner to procure the necessary right-of-way for Barber Street? Votapka, Utilities Director ?dV1 SUBJECT: Insecontrol Termite and Wood Destroying Organism Agreement Mr. Wayne Black, Service Manager, sent a letter dated December 16, 1994, to the City (Attention Mr. Coop) regarding the subject agreement dated August 18, 1994. The letter states that Insecontrol must receive the signed warranty within 10 days to continue coverage. Our office received the December 16, 1994, letter and agreement on January 11, 1995, which exceeded the expiration date by 16 days. I discussed this letter and agreement with Mr. Koford, who suggested I speak with Bruce Cooper. Bruce told me that, since the City is leasing the building at 700 Main Street to the Utilities Department, the City's Building Maintenance Department under Public Works should be responsible for the agreement and associated costs. The agreement is not signed by anyone from the City, although the last (yellow) page shows "Workers there from the City of Sebastian" under "Accepted By" in the lower right hand corner. Evidently Insecontrol never bothered to have any authorized representative of the City sign the Agreement. Also, the last page shows that the $800.00 Post Construction Corrective Treatment was not paid (shown as NOT PD). You should check with the Finance Department to see if they ever received a bill and, if they have, if it was processed for payment. Purchase Order 252 was issued. Insecontrol also wants an additional $105.00 per year for the annual premium.
