On September 20, 1993, the Department of Environmental
Protection (Department) held a public hearing in Room A-204 of the
Lab Complex Building, 2600 Blair Stone Road, Tallahassee, Florida.
Don W. Berryhill, Chief of the Bureau of Local Government Wastewater
Financial Assistance (Bureau), presented the staff recommendations
on adopting
the Revolving
Loan Priority List for
Fiscal Year 1994
(attached as
Exhibit A)
for wastewater financial
assistance.
FINDINGS OF FACT AND CONCLUSIONS OF LAW
1. The Bureau published notice of the proposed priority
list and the public hearing in the Florida Administrative Weekly and
mailed notice to all concerned parties.
2. Projects must be included on the Revolving Loan Priority
List to receive loans from the State Revolving Fund. The Bureau
presented a revised estimate of $107.6 million for funds expected to
be available in Fiscal Year 1994 for revolving fund loans. The
estimate includes $15 million in State funds, $68 million in new
federal funds, plus investment earnings, loan repayments and

carryover of uncommitted FY 1993 funds. Of this amount, $20,000,000
is reserved for projects in areas of Dade county affected by
Hurricane Andrew. Fifteen percent of available funds is reserved
for small community ,pr: ;eots.. Each local government is limited to
20 percent of the unreserved funds. Adjustment of the small
community reserve and loan amounts affected by the 20 percent limit
will be required if the amount of funds that actually becomes
available differs from the estimate.
3. The amount of Sanford's Project No. -586190 was reduced
to $500,000 at the request of the City. Since FY 1993 funds. were -
committed to this carryover project, the reduction made more funds
available for the FY 1994 fundable portion and is included in the
$107.6 million estimate stated in paragraph 2.
4. The small community reserve amount was adjusted to
$17,900,000 based on the revised estimate of total funds available.
(The reserve amount includes the uncommitted FY 1993 reserve balance
of $5,600,000.)
5. The limit described in paragraph 2 was revised based on
the new estimate of available funds, and the listed amounts for each
of three projects (Tampa No. 47382F, Cape Coral No. 675110 and West
Palm Beach No. 489161) were revised to $13,940,000.

6. The City of Lakeland's Project No. 608130 was formally
added to the fundable portion of the list. The project consists of
sewer rehabilitation, treatment and sludge facilities; the
estimated loan amount is.$13,447,000; the score is 1496; the rank
is 1402. The City completed listing prerequisites after June 1,
1993 but before the public hearing date, thereby qualifying for
addition to the fundable portion. The project was included on the
fundable portion of the draft list because it was clear that no
other project with a competitive score could qualify for listing by
the hearing date.
7. The City of Hollywood requested that their project
No. 594270 for Reclaimed Water Reuse Facilities, be added to the
fundable portion of the list for $11,614,000. The City's
representative testified that the Department's Categorical Exclusion
Notice for the project had been published, but the 30 -day public
comment period had not yet expired. The Department recommended
adding the project to the fundable portion of the list, with a rank
of 1403, contingent upon the City adequately responding to any
comments received in response to the Categorical Exclusion Notice.
The priority score is 638 points.
8. Okaloosa County completed fundable listing requirements
for its Niceville Area Transmission Facilities (Project No. 640220)
before the hearing date and the Bureau recommended adding the
project to the bottom of the fundable portion with a rank of 1404
for use of $999,000 from the small community reserve. The priority

score is 199 points.
9. Cape Coralfs Projects Nos. 675103 and 675130 were
reassigned to the contingency portion of the list at the request of
the City. The total amount of contingency funds assigned to Cape
Coral will not be affected. Project costs exceeding the contingency
limit will be included on the planning portion.
10. The Bureau recommended that the Department adopt the
Revolving Loan Priority List for Fiscal Year 1.994, as amended under
paragraphs 2, 31 41 51 6, 71 8, and 9, above, and contained in
Exhibit A; further, that the reserve for small communities and
listed loan amounts directly affected by the amount of funds
available be adjusted administratively if the Department determines
that more or less funds will be available.
11.. The Revolving Loan Priority List is. developed annually
and adopted by the Department.under the provisions of -chapter 17-503
of the Florida Administrative Code.

Having considered the foregoing findings of fact and
conclusions of law, it is
ORDERED:
The proposed Revolving Loan Priority List for Fiscal Year
1994,. as contained in Exhibit A, is adopted with the provision that

the small community reserve and listed loan amounts directly
affected by the amount of funds available will be adjusted
administratively if the Department determines that more or less than
the projected amount will become available.. The City of Hollywood's
Project No. 594270 is included on the fundable portion with the
provision that the City must adequately respond to any comments
received in'response to the Categorical Exclusion Notice.
Persons whose substantial interests are affected by this
order have a right under section 120.57 of the Florida Statutes to
petition for an administrative hearing on it, unless the right to
petition has been waived. The petition must conform to the
requirements of chapter 17-103 of the Florida Administrative Code
and must be filed (received) in the Department's Office of General
Counsel, 2600 Blair Stone Road, Tallahassee, Florida, 32399-2400,
within 21 days of receipt of this notice. Failure to file a
petition within that time constitutes a waiver of any right.that
such a person may have to request an administrative proceeding under
section 120.57 of the Florida Statutes.
The petition shall contain the following information:
(a) the name, address, and telephone number of each petitioner; the
Department's identification number and the county in which the
subject matter or activity is located; (b) a statement of how and
when each petitioner received notice of the Department's action;
(c) a statement of how each petitioner's substantial interests are
affected by the Department's action; (d) a statement of the material

facts disputed by petitioner, if any; (e) a statement of facts which
petitioner contends warrant reversal or modification of the
Department's action; (f) a statement of which rules or statutes
petitioner contends require reversal or -modification of the
Department's action; (g) a statement of the relief sought by
petitioner, stating precisely the action petitioner wants the
Department to take with respect to the Department's action.
If a petition is :filed, the administrative hearing process is
designed to formulate agency action. Accordingly, the Department's
final action may be different from the position taken by it in this
notice. Persons whose substantial interests will be affected by -any
decision of the Department with regard to the subject agency action
have the right to petition to become a party to the proceeding. The
petition must conform to the requirements specified above and be
filed (received) within 21 days of publication of this notice in the
Office of General Counsel at the address of the Department set forth
above. Failure to petition within the allowed time frame
constitutes a waiver of any right that such a person has to request
a hearing under section 120.57, Florida Statutes, and to participate
as a party to this proceeding. Any subsequent intervention will be
only on the approval of the presiding officer upon motion filed
under the applicable administrative rules.
This order is final and effective on the date filed with the Clerk
of the Department unless a petition is filed in accordance with this
paragraph. Upon the timely filing of a petition this order will not

be effective until further order of the Department.
Any party to the order has the right to seek judicial review of the
order under section 120.68 of the Florida Statutes, by the filing of
a notice of appeal under rule 9.110 of the Florida Rules of
Appellate Procedure with the Clerk of the Department in the -Office
of General Counsel, 2600 Blair Stone Road, Tallahassee, Florida,
32399-2400; and by filing a copy of the notice of appeal accompanied
by the applicable filing fees with the appropriate district court of
appeal. The notice of appeal must be filed within 30 days from the
date when the final order is filed with the Clerk of the Department.

RESUME OF CONVERSATION: At the advice of Ruth Sullivan, Sebastian
resident and former Redford Township Clerk, I called Sid Blitz.
Sid is the Director of. Community Development, who is extremely
proficient in procuring grants according to Ruth. Sid told me to
check on the available State of Florida Community Development Block
Grant Funds. He said 40% of the Block Grant Funds nationally goes
to the states for smaller communities. The governor of each state
designates state agencies to distribute the funds. The money has
to be used for projects where the beneficiaries meet the low and
moderate income definition. He said to contact the Florida
Department of Community Affairs (local Public Works) at 904-488-
1536. He said to contact EDA (the Economic Development
Administration) in Washington DC at 202-482-5113. They may also be
able to help.

SUBJECT: Fiscal Year 1994 Revolving Loan Priority List
The State Revolving Loan Fund provides low-interest loans to
finance the construction of publicy owned wastewater treatment
works. Interest rates for loans made during 1992 ranged from
3.16 to 3.68 percent.
The Department is initiating development of the Fiscal Year 1994
priority list to establish project priorities and schedules for
loans. As much as $100 million could become available for loans
in FY 1994. The Legislature must appropriate funds for the 20
percent match required to obtain federal money. Each State
dollar buys five Federal dollars. Fifteen percent of the money
will be reserved for projects that serve small communities (a
municipality or unincorporated community with a population of
20,000 or less as of the 1990 Census).
Projects may include treatment, collection, transmission,
disposal, reclaimed water reuse, and related facilities. The
principal purpose of the project must be for domestic wastewater
pollution control. Generally, any local governmental entity
which has jurisdiction over collection, transmission, treatment,
or disposal of wastewater may sponsor a project.
Project information for priority listing must be postmarked or
delivered to the Bureau of Local Government Wastewater Financial
Assistance on or before March 15, 1993. Enclosed is a Request
for Inclusion Form and supplemental instructions. A completed
form must be submitted for any new project to be considered for

the FY 1994 priority list. Resubmittal is not necessary if the
project is on the FY 1993 priority list. However, a FY 1994
target date for executing the loan agreement and updated cost
information must be provided by March 15, 1993 for a project
to be scheduled for FY 1994 or FY 1995 funding. Information
affecting priority scores will also be accepted through March 15.
The priority list will include fundable, contingency, .and
planning portions. The fundable portion will consist of projects
scheduled to receive loans from October 1, 1993 through April 30,
1994. Only those requests indicating a target date for.executing
loan agreements during that period will be considered for
fundable or contingency listing. Projects meeting
"readiness -to -proceed" requirements to qualify for fundable
listing but falling below the cutoff line for FY 1994 funds may
be listed on the contingency portion for funding in FY 19.95.
Projects not listed for FY 1994 or FY 1995 funding will be listed
on the planning portion.
"Project readiness -to -proceed" is critical for fundable or
contingency listing. Documentation -that program requirements
have been met must be postmarked or delivered to the Department
by June 1, 1993. In addition, a schedule for completing any
remaining requirements for entering into a loan agreement by the
target date must be submitted by that date. A list of the
requirements is enclosed.
Projects listed on the FY 1994 priority list, which go unfunded,
receive preference for priority listing in FY 1995. Contingency
projects will generally advance in the order listed to the 1995
fundable portion for available funds. Planning portion projects
will get preference over projects not identified on the FY 1994
list.

FUNDABLE AND CONTINGENCY PORTION LISTING CRITERIA
Documentation that the following items have been completed must be
postmarked or delivered to the Department (in Tallahassee) by
June 11 1993.
1. The capital financing plan and public hearing records for
dedicated revenue disclosure.
2. The complete facilities plan adopted by resolution of the
local government, including site specific studies, collection
system studies, major sewer system rehabilitation reports, sewer
system evaluation reports, and other specialized studies; public
participation records; and responses generated by the required
intergovernmental review.
3. The environmental review has been completed as evidenced by
the Department's publication of a notice of availability of the
environmental information document.
4. The Department has established that biddable plans and
specifications conform with the facilities plan;
5. A notice of intent to permit project construction or
documentation of the determination that no construction permit is
required has been issued by the Department.
6. The local government has submitted its certification of
availability of all project sites for the purposes of construction,
operation, and maintenance over the useful life of the facilities.
7. The local government has submitted its interlocal service
agreements, whenever facilities or services beyond its jurisdiction
are involved.
8. The local government has submitted its value engineering
report for operationally related project facilities valued in
excess of $10,000,000.
9. The local government has submitted its sewer use ordinance
and user charge system.
10. The local government has documented and submitted its
dispute resolution procedures.
11. A schedule for completing all remaining requirements to
enable execution of the loan agreement no later than# April 30,
1994. Requirements include the signed loan application and
supporting documentation, such as the pledged revenue schedule,
prior and parity lien schedule, legal opinions, local government
resolution, and the construction permit.

Requests for inclusion on the Revolving Loan Priority List must
be postmarked or received by the Department no later than March
15 preceding the federal fiscal year for which the priority list
is being developed. For each project, submit three copies of the
Request for Inclusion form and applicable attachments to:

We suggest that you review the Revolving Loan Program Rule,
Chapter 17-503, Florida Administrative Code, before completing
the Request for Inclusion form. A copy of the rule may be
obtained by calling the Bureau at SUMCOM 278-8163 or
904/488-8163.
Item numbers in these instructions correspond to the form.
Item 1. Projects must be sponsored by a local government.
Potential applicants include a municipality, county, district or
authority having jurisdiction over collection, transmission,
treatment or disposal of wastewater, industrial wastes or other
wastes. A district or authority with the principal
responsibility of providing airport, industrial or research park,
or port facilities to the public may apply.
Item 2. A project may consist of any cost-effective facilities
or systems associated with wastewater collection, transmission,
treatment, or disposal. This includes facilities to reuse
reclaimed water from publicly owned wastewater treatment plants.
Land that will be an integral part of the treatment process or
used for ultimate disposal of residues resulting from such
treatment may be included. The principal purpose of the project
must be for domestic wastewater pollution control.
Any combination of domestic wastewater facilities, regardless of
their relationship to each other, may be included in a project.
The applicant is encouraged to consolidate, into one project,
facilities expected to qualify for listing on the fundable or
contingency portion of the coming year's priority list.

To qualify for fundable or contingency listing, "readiness -to -
proceed" requirements (outlined in Item 5) must be met for the
entire scope of work described no later than June 1 preceding the
federal fiscal year for which the list is being developed. A
schedule for completing any remaining requirements and executing
the loan agreement before the target date (not later than April
30 of the fiscal year for which the list is adopted), also must
be furnished by the local government no later than June 1 before
adoption of the priority list.
The scope of a project already described on the fundable or
contingency portion of the priority list cannot be increased to
include additional work.
The amount of funds available to any one applicant will be
limited. The limit is set at 25 percent (or less) of the
unreserved funds available for the fiscal year. When a local
government qualifies for more than the limit, its project will be
segmented for funds over two or more years. Subsequent segments
will receive priority for funding in succeeding years. The
"readiness -to -proceed" requirements must be completed for the
entire scope of projects segmented for multiple year funding.
Describe the project specifically. Include the name and capacity
(or size) of facilities. Identify the existing and proposed
capacities if existing facilities will be expanded. For
treatment facilities, explain whether the project is required to
improve the level of treatment or to provide additional capacity
(upgrade or expand, or both).
The following example illustrates the type of information that
should be provided in the project description:
"Expand the 4.5 mgd Main Street Wastewater Treatment Plant to
6.5 mgd and upgrade treatment to comply with the DER
wasteload allocation. Construct a reclaimed water
transmission and spray irrigation distribution system. The
existing discharge to surface water will be eliminated.
Also, construct a collection system for the Loblolly Bay
Subdivision.
Specifically, the project consists of the following
components:
Demolition of old disinfection system, one secondary
clarifier, one aerobic digestor, two sludge presses, two
mixed media filters, disinfection system, reclaimed water
pump station, 20,000 linear feet of reclaimed water force
main, distribution lines and sprinklers, and 70,000 linear
feet of collection system lines and appurtenances."
A figure or schematic showing the major components is suggested
if not included in facilities plan submitted to the Department.

Item 3. Self-explanatory.
Item 4. The responsible local government official means the
official with authority to execute the loan agreement.
Item S. To qualify for the fundable or contingency portion, a
project must meet "readiness -to -proceed" requirements no later
than June 1 before adoption of the priority list. In addition, a
schedule must be provided for submitting the loan application and
supporting documentation for entering into a loan agreement
during the first half ( October through April) of the federal
fiscal year for which the list is being developed.
"Readiness -to -proceed" requirements include completed facilities
planning; financial planning; public hearings and adopting
resolutions; plans and specifications site certification
establishing undisturbed use of project site(s); providing
information for the Department to complete an environmental
review; and the Department's notice of intent to permit
construction. The hearing for adoption of the facilities plan
requires a 30 -day public notice. Site specific and other
specialized studies may be required to complete the facilities
plan. "Readiness -to -proceed" requirements are detailed in
Section 17-503.655(1)(b) of the revolving loan rule.
Several important dates are discussed in these instructions
without identifying the year since the instructions are not for a
particular year's priority list. To clarify, the following
sequence is provided:

Item 6. Generally, estimates of actual costs should be provided
for the line items. However, allowances are used for
administration and basic engineering services. Some Items
warrant explanation:
Note: When bids exceed estimated cost, loan increase
requests receive priority of the second highest order for
ranking on a subsequent year's fundable portion.

Administration. An allowance of up to six -tenths of one percent
of the total eligible amount for construction, equipment, real
property and demolition may be included. An allowance of $12,000
may be requested if the calculated amount is less.
Basic engineering services. An allowance for engineering design
may be included up to the amount obtained from the attached curve
of median compensation for consulting engineering services.
(This curve was published in the American Society of Civil
Engineers' Manual Number 45, "Consulting Engineering, A Guide for
the Engagement of Engineering Services", 1981.) The estimated
total cost of all construction contracts plus the value of all
labor, materials and equipment to be purchased or furnished,
should be used for the net construction cost. If engineering
design services will be provided separately for portions of the
project, the maximum overall allowance may be computed as the sum
of the individual allowances. The allowance represents expenses
for engineering services provided before construction bid
opening.
Eligible land. Land may be eligible if it will be an 'Integral
part of the treatment process or will be used for the ultimate
disposal of residues resulting from treatment. This includes
land used for storage of wastewater or residues. Most project
sites such as for wastewater treatment plants and sewer easements
are not eligible.
Other. The loan recipient will have to establish a loan
repayment reserve account or other means of ensuring loan
repayment. The loan may be used to capitalize the repayment
reserve. The capitalization amount may be estimated as one
percent of the total project cost. That amount should be
identified as a cost item unless the reserve will be established
with other funds. Other project costs may also be identified for
consideration.
Service Fee. A one-time fee of three and one-half percent of
allowable project costs excluding capitalized interest shall be
paid as a loan service fee by the local government. The fee may
be amortized as part of the loan or paid directly. If you plan
to amortize, the fee, include the amount in the estimated project
cost (Items 6 and 7).
Item 7. Self-explanatory.
Item S. The certification must include information clearly
describing the public health hazard and explaining how the
project will eliminate it (Subitems (a) through (d) of the
certification form]. The following example is provided for a
collection system project that will eliminate failing septic
tanks:

(a) Location. The failing septic tanks are located in the
Loblolly Bay Subdivision.
(b) Extent of the hazard. The Subdivision consists of 1,000
single-family homes with septic tanks installed before
standards were developed. Much of the area has a high
water table and soils poorly suited for septic tanks.
Health Department surveys indicate that approximately 20
percent of the septic tanks have failed during the past
five years.
(c) Frequency of occurrence. Septic systems failures,
including drainfield discharge to the surface, occur
throughout the year and are an ongoing problem (42
failures were reported during 1992). During rainy
seasons the failures are more common. At times of heavy
rainfall many drainfields remain saturated for several
days.
(d) The collection system will eliminate the septic tanks.
This information should be provided by the Public Health Official
who signs the certification.
Item 9. Self-explanatory.
Items 10-11. The priority score is based on project category and
wastewater flow as set forth in Section 17-503.650 of the
Revolving Loan Program Rule. Additional consideration is given
to projects which will assist in the restoration of protection of
a water body with an adopted Surface Water Improvement and
Management (SWIM) plan. A project qualifying for priority points
in more than one category will receive the highest priority score
generated by a facility in any one category. For example, a
project may qualify for 700 points in the public health hazard
elimination category and for 803 points (including points for
SWIM preference) in the compliance/reclaimed water category. The
project will receive 803 points --the higher score. The scores
generated in the different categories are not additive. The
details of this example are as follows:
The proposed collection system for the Loblolly Bay
Subdivision will eliminate 200 failing residential septic
tanks with frequent overflows which have been declared
public health hazard by the local Health Department
(certification is required pursuant to Item 8). The
estimated flow to the failing septic tanks is 0.030 million
gallons per day (mgd). The category base score of 140 and
the flow factor of 5.0 is obtained from the rule. A priority
score of 700 points (5.0 x 140) is calculated.

Upgrading the Main Street Treatment Plant and a land
application (reclaimed water) system are required to achieve
compliance with a cease discharge order, qualifying for a
category base score of 80. (An enforcement order, wasteload
allocation or other written document must be provided
pursuant to Item 9 of the request form to show that the
porject is required to achieve compliance with pollution
control requirements). The highest reported existing average
daily flow to the plant for a one-month period was 4.52 mgd.
A flow factor of 8.36 is determined using the formula in the
rule, and 669 priority points (8.36 x 80) are calculated. In
addition, the reclaimed water system is recommended in an
approved SWIM plan to restore a priority water body.
Therefore, the 669 points are multiplied by the 1.2 SWIM
factor generating a priority score of 803 points encourage
smaller flows (conservation).
Explain how the flow was established for each category. In the
example above, 200 failing septic tanks were identified and flow
was estimated at 150 gallons per day per residence. The 4.52 mgd
for the compliance/reclaimed water system represents the highest
average daily flow to the Main Street Treatment Plant obtained
from the file of Monthly Operating Reports for the facility.
Item 12. Fifteen percent of the funds available each year are
set aside for projects that will exclusively serve small
communities. A small community is a municipality or
unincorporated community with a population of 20,000 or less as
of the 1990 census. The applicant must submit documentation
showing how the population is established for an unincorporated
community. A map showing the location and boundaries of the
community and population census tracts will be minimum
requirements. A large community may sponsor a small community
project.
Small community projects that satisfy readiness -to -proceed
requirements will compete for the reserve funds based on priority
scores. Small community projects may also compete for unreserved
funds; higher priority scores would be required to be
competitive.

REVOLVING LOAN PRIORITY LIST
March 9, 1993 Public Hearing
Issue: Management of the Fiscal Year 1993 revolving loan
priority list.
Background: The FY 1993 priority list was adopted last
September. The fundable portion establishes which projects are
in line to receive loans during the current fiscal year. The
contingency portion identifies projects scheduled to receive
funds next fiscal year, and the planning portion identifies
potential projects for future funding.
The Revolving Loan Rule authorizes the Secretary to add projects
to the fundable portion for uncommitted funds that are available
before June 1 and to the contingency portion for next years_
funds. Presently, $14,628,000 are uncommitted. Of that amount,
$7,035,000 is reserved for small community projects and
$7,593,000 is unreserved. In addition, a city has indicated that
it does not expect to apply for all of the money presently
assigned to a project. We are working with that city to resolve
its loan needs and may be able to identify additional money that
will be available before June 1.
To qualify for addition to the fundable or contingency portion of
the list, the sponsoring local government must complete planning,
design, financial disclosure, and other preconstruction
activities for the project before the March 9 hearing. Further,
the Department must publish environmental review information and
the Local Government must submit a schedule for completing a loan
application within 60 days after the hearing. Table I (attached)
identifies projects that will be considered for addition to the
fundable or contingency portion.
Under the rule, the amount of funds that any one Local Government
can receive is limited each year. For the present fiscal year,
the limit is $10,455,000.
The priority ranking system includes considerations in addition
to the "readiness" criteria discussed above. Projects under
construction which need additional money for cost overruns
receive preference over other projects for available funds.
Within these categories, projects compete by priority score
reflecting public health and pollution control considerations.
Recommendation: Add qualifying projects to the fundable or
contingency portions of the priority list for use of funds that
become available before June 1.
